Federal court rules in favour of LHDN over RM1.8bil tax appeal against TNB

Federal court rules in favour of LHDN over RM1.8bil tax appeal against TNB

The Star20 hours ago
PUTRAJAYA: The Federal Court on Wednesday (July 2) allowed the Inland Revenue Board's (LHDN) appeal to reinstate an additional tax assessment of RM1.8bil against Tenaga Nasional Berhad (TNB) for the 2018 assessment year.
A five-member panel chaired by Court of Appeal President Tan Sri Abang Iskandar Abang Hashim unanimously overturned the earlier decisions of both the High Court and the Court of Appeal, which had ruled in favour of TNB and quashed the LHDN's tax assessment.
The other members of the panel were Federal Court judges Tan Sri Nallini Pathmanathan, Datuk Zabariah Mohd Yusof, Datuk Rhodzariah Bujang, and Datuk Abu Bakar Jais.
No order as to costs was made, with the court noting that the matter involved issues of public interest.
Delivering the court's judgment, Justice Rhodzariah held that TNB's claim for reinvestment allowance (RA) under Schedule 7A of the Income Tax Act 1967 (ITA) was misconceived and not in accordance with the provisions of the Act.
She added that TNB ought to have applied for an investment allowance under Schedule 7B of the ITA, rather than seeking RA under Schedule 7A.
She explained that the legislative intent behind Schedule 7A was to incentivise manufacturing companies to reinvest in their existing operations in Malaysia.
In contrast, Schedule 7B provides for investment allowance incentives specifically tailored to companies in the services sector, as approved by the Minister of Finance.
Justice Rhodzariah further noted that TNB is authorised to impose a service charge under the Service Tax Act 2018, which reinforces its status as a service provider.
As such, the court found that TNB falls within the ambit of the services sector and is therefore subject to Schedule 7B, not Schedule 7A.
The LHDN argued that TNB, as a utility provider, does not qualify as a manufacturer and is thus not entitled to the RA granted to entities engaged in manufacturing activities.
On July 21, 2020, TNB filed a judicial review application seeking, among others, to quash the LHDN's decision dated July 13, 2020, which had disallowed its RA claim amounting to RM1,812,506,384.64.
The company also sought a declaration that it was entitled to claim the RA under Schedule 7A of the ITA.
TNB had included its RA claim for the year of assessment 2018 in its tax return. However, the LHDN informed the company that the claim had been disallowed in a letter dated July 3, 2020.
Subsequently, on July 13, 2020, the LHDN issued a notice of additional assessment against TNB for RM1,812,506,384.64 in tax.
TNB then initiated judicial review proceedings to challenge the assessment. In February 2022, the High Court allowed the application and set aside the LHDN's additional assessment for the year 2018.
The Court of Appeal, in a decision delivered in May 2023, affirmed the High Court's ruling. Despite the dispute, TNB has already paid the assessed sum.
At Wednesday's hearing, the LHDN was represented by Datuk Dr Cyrus Das and senior revenue counsel Ashrina Ramzan Ali, while counsels Datuk D. P. Naban and S. Saravana Kumar appeared for TNB. - Bernama

Penang open to renegotiating reclamation off Persiaran Karpal Singh

BATU KAWAN: The state government has signalled its readiness to renegotiate the proposed land reclamation project off Persiaran Karpal Singh following concerns raised by the ProtectKarpal group. Chief Minister Chow Kon Yeow said the state government remained committed to upholding the Environmental Impact Assessment (EIA) process, and any decision would be based on its outcome. The state government has given the project developer until February next year to obtain the EIA approval, he added. "The public hearing ended on June 30 and the company needs to review the concerns raised and address them accordingly," said Chow. "Should the EIA approval not be granted, the project may not proceed. If approved, we can renegotiate and scrutinise the work methods to minimise any issues." He was responding to ProtectKarpal — the Protect Karpal Singh Drive Action Committee, a group protesting the project — which claimed that the state was willing to scale down the reclamation project. Chow confirmed the claim and said the state government was open to considering the group's requests. He also said while an agreement existed between the Penang Development Corporation (PDC) and the developer, the state government was open to renegotiation. "Scaling down the project will not necessarily affect the contract, but will require some 'sacrifices' on our part, particularly the land we are supposed to receive from the reclamation. "Sometimes, we have to make sacrifices or adjust our share to ensure a balanced outcome that benefits Penang and protects the environment." ProtectKarpal met Chow more than a week ago and submitted its demands, including a full rejection of the proposed reclamation due to potential ecological damage. It also called for Middle Bank, a seagrass-rich coastal area near the proposed project site, to be immediately gazetted as a marine sanctuary, citing its importance to local fisheries and ecological stability. In 2020, PDC signed a RM1 billion deal with PLB Engineering Bhd to develop and rehabilitate the Jelutong landfill. The site was originally a sanitary landfill, but since 2002, only construction debris and garden waste have been allowed. Earlier, Chow was met at the groundbreaking ceremony for the first and largest market complex in Batu Kawan. Costing RM46 million including earthworks, the project is expected to be completed by June 2027.

Could an old sod*my case explain PMX's reluctance to extend T. Maimun's service tenure?

IT has surfaced that Prime Minister Datuk Seri Anwar Ibrahim's hesitation to push for a six-month extension to the term of former chief justice Tun Tengku Maimun Tuan Mat could be due to her initial involvement in the prosecution's appeal against his acquittal in his second sodomy case a dozen years ago. This was when the late Karpal Singh who was the Opposition leader's lead counsel had on Sept 17, 2013 applied to have Tengku Maimun recused from the panel hearing the appeal. This piece of information was shared on X by former Barisan Nasional (BN) strategic communication deputy director Datuk Eric See-To probably to insinuate PMX's reluctance to extend Tengku Maimun's service term which ended on Tuesday (July 1) upon her reaching the mandatory retirement age of 66. 'Karpal argued that the reason for the application was Tengku Maimun's previous involvement in a civil suit filed by Anwar against twice former premiere Tun Dr Mahathir Mohamad back in 2007,' penned the pro-Datuk Seri Najib Razak blogger. In 2013, Anwar Ibrahim's lead counsel at the time, the late Karpal Singh, successfully applied to have Justice Tengku Maimun recused from the panel hearing the appeal in the Sodomy II case. Karpal argued that the reason for the application was Tengku Maimun's previous… — Eric SeeTo Lim Sian See (@LimSianSeeEric) July 2, 2025 'He pointed out that in her judgment for that case, Tengku Maimun had adopted findings suggesting that Anwar had a homosexual tendency. Henceforth, Karpal argued that it would be inappropriate for Tengku Maimun to preside over the case'. Following Karpel's submission, Tengku Maimun eventually recused herself from hearing the prosecutor's appeal 'which Anwar eventually lost'. Whether the past has any bearing on today's development is as good as anybody's guess. However, for the record, PMX has hit out at both the legal fraternity and Malaysians at large who rallied for Tengku Maimun's extension on ground of having rendered impeccable service for politicising the matter when an extension is never automatic. On her part, Tengku Maimun has accepted her retirement in good faith while justifying that extending her service a further six months 'is not significant at all' compared to her having completed her six-year tenure as Malaysia's first female chief justice. All-in-all, good governance advocate ksampoh@MyOwn Inc(@ksampoh) verified as true what was shared by the opposition-slant See-To who also goes by the moniker Lim Sian See. 'Now, he (PMX) says no extension for her as chief justice. Officially, it's about respecting retirement age. But fair question – does DSAI still carry a personal grudge from that old court history?' wondered ksampoh@MyOwn Inc. 'Only he knows – but history leaves marks.' – July 3, 2025
