
Imran's fate hinges on high courts
Imran Khan's legal team is consistently alleging that due process and the requirements of fairness enshrined in Article 10-A of the Constitution have not been adhered to during his trials.
Though the PTI leadership has been unable to evolve any effective strategy for the release of Imran Khan during the last two years, the non-adherence to due process during his trials has raised serious doubts among the masses, which is also giving political advantages to his party.
Despite the absence of a joint symbol and the non-availability of a level playing field, the February 8 general election results were shocking for other major political parties. Until Imran is considered a political victim, his opponents cannot defeat him in a free and fair election, says a senior lawyer.
He said that the two major political parties, the PML-N and the PPP, should have realized that if they want to defeat Imran on the political ground, then the victim card should have been taken away.
First, Imran Khan was convicted in the Toshakhana case on August 5, 2023. The trial court, presided over by Additional Sessions Judge (ASJ) Humayun Dilawar, had given a three-year sentence.
However, some lawyers believe that there were serious defects in the judgment. They questioned why the trial court was in such a hurry to decide the case without recording statements of the witnesses whom Imran Khan wanted to present in his defence.
Even the trial court did not wait for his counsel, Khawaja Haris, to give his final arguments. Faisal Siddiqi, while commenting on the judgment on August 5, had expressed grave concern over the trial court's decision, viewing it as a symbolic destruction of political justice in the country.
Siddiqi also asserted that the judgment was "a result of revenge politics on the part of the PDM government and political manipulation by the deep state." He not only called for the judgment to be overturned but also urged the superior judiciary to investigate the author judge for tarnishing the entire judicial system's reputation.
Soon after the announcement of the decision, Imran Khan was arrested in Lahore.
After a couple of weeks, the Islamabad High Court led by then Chief Justice Aamer Farooq suspended the trial court decision. The main appeal in this case is still pending in the IHC.
Later, Imran was convicted in three cases wherein trials were conducted in Adiala Jail. These convictions were awarded before the general election of February 8, 2024. There are serious allegations of manipulation of trials in those matters.
Interestingly, Imran's conviction in the Cypher case has been set aside by a division bench of the IHC led by Justice Aamer Farooq. Likewise, in a second matter, the appellate court also quashed Imran and his wife Bushra Bibi's convictions in the Iddat case.
The IHC suspended their convictions in the Toshakhana case. The final appeal is still pending in this matter before the IHC. Meanwhile, the trial court conducted the jail trial of Imran and his wife in the 190 million pounds case.
Though the judge fulfilled all procedural requirements during the trial in the 190 million pounds case, questions are being raised on the maintainability of the case after the NAB law amendments. Likewise, the judge postponed the date for the announcement of judgment three times.
Despite the passage of more than five months, the IHC is yet to decide Imran and Bushra's petitions seeking suspension of the judgment in the 190 million pounds case. Imran's legal team is consistently filing early hearing applications, but the high court is yet to decide the case.
Now, two trials of Imran Khan are continuing in Adiala Jail. One is related to Toshakhana and the other to the May 9 rioting. Recently, the Lahore High Court (LHC) rejected the post-arrest bail of Imran Khan in the May 9 cases.
Subsequently, the legal team has approached the apex court against the LHC order. The matter is listed for hearing in the SC on August 12. Post-26th Amendment, as well as the transfer of judges to the IHC, Imran Khan is struggling to get relief in the superior courts.
Though the IHC passed an order conditionally allowing meetings with Imran Khan in Adiala Jail, the decision has not been implemented by jail authorities.
At present the government is in a strong position and Imran Khan is still receiving massive support, the only loser is the justice system, which has so far failed to adhere to due process and the requirements of fairness enshrined in Article 10-A of the Constitution during the last two years.
Recently, Supreme Court judge Syed Mansoor Ali Shah issued an additional note in the ex-PM Zulfiqar Ali Bhutto presidential reference case. He said judges must uphold their oaths with courage in the face of oppression, for only then can the judiciary truly safeguard democracy and the rights of the people.
"Let the lesson of transitional justice be clear transitional justice, however, often becomes necessary because, during oppressive rule, some judges fail to uphold their constitutional duty, succumbing to the pressure of illegitimate authority.
"This failure not only enables violations of due process and fair trial rights but also erodes public trust in the judiciary," wrote Justice Shah. He said the Bhutto case serves as a classic example of a political trial, illustrating how such trials can be manipulated to advance authoritarian designs.
Likewise, present CJP Yahya Afridi in a similar case said that the extraordinary political climate of the time and the pressures inherent in such an environment appear to have influenced the course of justice in a manner inconsistent with the ideals of judicial independence.

The Islamabad and Rawalpindi administrations have imposed Section 144, banning public gatherings and processions in the twin cities. The PTI on its social media platforms has said numerous of its workers, including PTI leader Usman Dar's mother Rehana Dar, were arrested in various parts of the country in a bid to stop them from staging rallies, as the former ruling party is marking the second anniversary of incarceration of PTI founding chairman and former prime minister Imran Khan today, with 'peaceful protests', demanding his release. A day ago, PTI Punjab released a 12-page white paper titled 'Detention of Former Prime Minister Imran Khan: Political Victimisation and Human Rights Abuses (August 2023-August 2025).' Addressing a presser along PTI senior leader Barrister Ali Zafar, Head of the Media Cell for PTI Punjab Shayan Bashir said his party has decided to organise peaceful protests to mark second anniversary of Imran's imprisonment. When he spoke with Khan, the former prime minister expressed his commitment to fighting for the rule of law and his faith in the judiciary to deliver justice, he said. Currently, the PTI leader stated, Khan is confined to a 10-foot room, and the authorities do not permit him to meet with his family freely. Recently, even his lawyers have been denied access, and cases have been filed against his wife to apply pressure on him, he maintained. The PTI's dossier outlines a series of issues including political persecution, judicial manipulation, electoral interference, and state-led repression. It claims that Imran Khan has faced over 186 politically motivated FIRs across the country since August 2023. According to the report, convictions in controversial cases, such as the Toshakhana reference, the cipher case, and the Al-Qadir Trust case, were delivered through closed-door trials that were characterised by procedural violations and media blackouts, in blatant defiance of Articles 10-A and 14 of the Constitution. From the party's perspective, the dossier emphasised violations of court orders, human rights abuses, electoral engineering, subversion of democracy, and suppression of peaceful protests. The white paper makes several demands, including the immediate release of Imran Khan, Bushra Bibi, and all political prisoners who are jailed for peaceful expression or association. It also calls for the reversal of all politicied convictions and the initiation of fair retrials overseen by independent benches and international observers. Furthermore, the document demands the formation of an impartial judicial commission to investigate police brutality, forced disappearances, attacks on peaceful protesters, and custodial torture.

PTI supporters mobilise nationwide ahead of protest call
Supporters of Pakistan Tehreek-e-Insaf (PTI) began mobilising from various parts of the country on Monday, ahead of the party's official protest call. The movement comes as PTI marks two years since the imprisonment of its founder and former prime minister Imran Khan. Early mobilisations were reported in various regions, where PTI workers voiced demands for Imran's immediate release. More than six MPAs have been arrested in Lahore. Deputy Opposition Leader Moin Qureshi has been detained. Furthermore, preparations for protests have also been completed in various constituencies across Lahore. Section 144 has been imposed in Rawalpindi, and authorities have vowed to ensure its full enforcement. According to the CPO, law enforcement is monitoring the situation through Safe City cameras and other surveillance tools. Any violation of the law will prompt immediate action, he said, adding that no individual or group will be allowed to disturb public life. Police pickets and patrolling teams have been activated citywide as part of efforts to maintain law and order. The CPO reiterated that the rule of law and public peace will be upheld at all costs.

PTI no longer a political party: Azma
LAHORE: Punjab Minister for Information and Culture, Azma Bokhari, has said that Pakistan Tehreek-e-Insaf (PTI) is no longer a political party but has turned into a fascist group determined to damage state institutions and disrupt national unity. On August 5, the people of Pakistan will completely reject the politics of chaos and stand in full solidarity with their Kashmiri brothers and sisters, Azma said, adding: 'The person who raises slogans of 'Haqiqi Azadi' is the same individual whose $18 million advertisement was published in the United States, exposing his double standards. This man once begged for freedom from America, and now his son is repeating the same narrative.' Speaking at a news conference held at DGPR on Monday, Azma Bokhari said that the arrival of the Iranian President in Lahore was a historic occasion, but a particular segment of society tried to malign it through negative propaganda. She emphasised that the Iranian nation holds a deep intellectual connection with Allama Iqbal and considers him the Poet of the East. She added that Iran has expressed its commitment to enhancing trade with Pakistan up to 10 billion dollars. The warm welcome extended to the Iranian President by Nawaz Sharif and Maryam Nawaz is a reflection of the strong bilateral relations between the two countries, she added. The Information Minister said that anti-smog guns have now been delivered in Punjab, with 15 already stationed in Lahore. The Punjab government is fully prepared for the upcoming smog season starting from October. Millions of trees are being planted with QR code tagging to ensure transparent monitoring. Public schools are being equipped with new furniture, proper boundary walls, and washroom facilities. In Dera Ghazi Khan and Rajanpur, women have been inducted into the armed forces; a clear sign of gender inclusion, she said. For students, the Punjab government is offering scholarships, laptops, and has planned a 1,000-bed cancer hospital, all of which reflect the government's top priorities, she added. Azma further said that on August 5, the entire nation will enthusiastically observe 'Kashmir Exploitation Day' and express complete solidarity with the people of Kashmir. She criticised PTI's call for protests on the same day, terming it highly regrettable. She said that when Kashmir was being brutalised, the same person was in power, and now he continues to conspire against the state by issuing statements about guerrilla warfare. She asserted that anyone who talks about waging guerrilla war against the state must be dealt with an iron hand. Referring to PTI's past protest calls, she said that the so-called 'final call' given on November 26 failed miserably. The movement announced after Ashura also died down, and the announcements made for April 9 and other dates were withdrawn. She mockingly said that PTI always seems eager for a showdown, but in the end, they end up defeating themselves. The Information Minister said that the current government has initiated over 90 projects and continues the journey of development, while those creating chaos only want to spread unrest. She said that when the country is on the path to economic stability, these elements call for anarchy and plot conspiracies. Azma Bokhari urged the public to demonstrate complete national unity on August 5 and send a loud and clear message to anti-state forces that there is no space for chaos and sabotage in Pakistan.
