Interfaith marriages without religious conversion illegal: Alld HC

Prayagraj: The Allahabad high court ruled that interfaith marriages without religious conversion are illegal and refused to quash criminal proceedings against a man accused of marrying a minor at an Arya Samaj temple, reports Rajesh Kumar Pandey.
The Allahabad High Court directed the state home secretary to investigate how Arya Samaj temples are issuing marriage certificates without following rules and submit a compliance report. The court declined to set aside the criminal proceedings against the man who married a minor after allegedly kidnapping her.
In his order dated July 24, Justice Prasant Kumar made it clear that the investigation has to be made by an officer not below the rank of deputy commissioner of police.
Before passing the above directions, the court found that the applicant and the victim belong to different religions. "There is averment in the application that they have solemnized marriage in Arya Samaj Mandir at Prayagraj. However, the same could not have been done without proper conversion as per the existing law," added the court.
With these observations and directives, the court dismissed the petition filed by one Sonu alias Shahnur, who had moved the court to quash summoning order dated September 12, 2024 issued against him as well as the entire proceedings of criminal case going on against him under section 363 (punishment), 366 (kidnapping a woman to compel her to marry) 376 (rape) of IPC and sections 3/4 of the Protection of Children from Sexual Offence (Pocso) Act at Nichlaul police station of Maharajganj district.
During the course of hearing, the counsel for the applicant submitted that Shahnur had solemnized marriage with the victim on February 14, 2020. He further submitted that since the girl was minor, she was sent to Nari Niketan and when she became an adult, she started living with the applicant.
On other hand, the government counsel submitted that the girl is minor as per her high school certificate and she could not have solemnized marriage with the applicant.
He submitted that the applicant and the victim come from different religions, as such, their marriage cannot be considered valid until and unless proper conversion is carried out in accordance with the provisions of the UP Prohibition of Unlawful Conversion of Religion Act, 2021.
He further submitted that the marriage certificate has been issued by Arya Samaj Mandir, which seems to be a fabricated document.
In support of his arguments, the state counsel quoted an earlier order passed by this court, in which the court pointed out that certain people who claim themselves of Arya Samaj and are getting marriages solemnized illegally with mala fide intentions without even verifying the age of the couple.
The court will hear the case next on August 29.

Nagpur: In two separate incidents of burglary reported in the city, valuables worth more than Rs4.7 lakh were stolen from industrial and residential premises, prompting police to launch investigations. The complainant, 45-year-old Prashant Shivhare of Pension Nagar, had locked the premises and left for the night on July 18. When he returned the next morning, he discovered the locks had been broken. A total of five hydraulic jacks, several iron pipes, structural components, and tin sheets were reported missing, with the total loss estimated at Rs1.65 lakh. A case has been registered against unidentified persons under relevant sections of the IPC at the MIDC police station. In a separate case under the Mankapur police station, 50-year-old Ashish Sawashere of Zingabai Takli reported a burglary that took place while he was away in Raipur with his family between July 22 and July 25. Upon his return, he found the locks of his house's compound gate and main door broken. Intruders had ransacked the bedroom closet and stolen gold and silver ornaments, along with a sports bike from a well-known Japanese brand. The total value of the stolen items was pegged at Rs3.11 lakh. A case has been registered, and further investigation is underway.

Pune: Former state minister Eknath Khadse's son-in-law Pranjal Khewalkar and six others, including two women, were arrested after a Pune police team claimed to have busted a house party early on Sunday in a Kharadi studio flat off Pune-Ahmednagar highway where cocaine, marijuana and hookah pots were used along with liquor consumption. Police later took Khewalkar, who is an MD (medicine) and the husband of Rohini Khadse, who heads the NCP (SP)'s state women's wing, and others to Sassoon General Hospital for medical tests and then to his bungalow in Hadapsar where searches were carried out as part of an investigation to trace the source of the drugs. "A laptop, three pen drives and a hard disk were among the articles seized from the bungalow," a police officer said. Lawyer Sachin Zalte, appearing for co-accused Shripad Yadav, submitted that police have failed to mention in their arrest report the quantity of cocaine seized from the accused. The omission is crucial, as possession of less than two grams qualifies as a bailable offence under the current law. The court, while granting two-day custody, said the allegations of illegal arrest can be taken up in subsequent hearings.

Noida: The additional sessions cum fast-track court of GB Nagar has acquitted a man of dowry death charges after 21 years. Judge Saurabh Dwivedi, after hearing both parties, concluded that the prosecution failed to establish charges against the accused. The case concerned the death of a woman who was found hanging at her house in Nov 2004. A complaint under section 304B (killing for dowry) and sections 3/4 of the Dowry Prohibition Act of 1961 was registered against the deceased's husband, Neeraj Gupta, and his brother Rajiv Gupta, along with his two family members. The CJM court of GB Nagar on Jan 13, 2005, transferred the case to the additional district and sessions court–II for trial on March 4, 2008, following which the trial began on Jan 15, 2008. It was later transferred to the fast-track court on Jan 6, 2015. The prosecution failed to prove the culpability of other family members in the case, as all three family members of the deceased, who were presented as prosecution witnesses, turned hostile. The complainant in the case, Krishna Kumar, who is the woman's uncle, said that he did not name Rajiv in his statement before the police. Admitting to naming Rajiv in his deposition before the court 19 years ago, Kumar said that at that time, the entire family was in shock and grief, and he named him in an emotionally charged state of mind. "They, however, failed to prove that the prosecution witnesses were making false claims," the defence counsel said. The court concluded that since the prosecution failed to prove beyond doubt the involvement of Rajiv Gupta in demanding dowry or attacking the deceased, he deserved to be released from section 304B of the IPC and sections 3/4 of the Dowry Prohibition Act.
