NGT seeks report on removal of legacy waste in Bargarh town

National Green Tribunal
(NGT) has directed the state housing and urban development department to file an action taken report (ATR) regarding complying of orders issued earlier for removal of legacy waste dumped for the past 10-15 years in western Odisha's Bargarh town.
NGT's east zone bench in Kolkata gave the direction while hearing a petition on July 28 seeking criminal proceedings against the authorities for non-compliance of orders the tribunal had issued on March 23, 2023. Ramakanta Rout and six other residents of Purushotam Nagar in ward 15 under Bargarh Municipality filed the petition.
Delay in remediation of legacy waste dumpsites had resulted in huge damage to the environment and posed health hazards for people living in the vicinity, the petition contended.
Advocates Sankar Prasad Pani and Ashutosh Padhy represented the petitioners.
In its March 2023 order, the tribunal had directed the complete treatment of the waste through bio-mining, micro-composting centres or material recovery facilities by Dec 31, 2023. State govt was also instructed to deposit Rs 1.84 crore in an escrow account to fund the remediation.
During the hearing, the tribunal examined an inspection report filed by the Odisha State Pollution Control Board and reviewed the Bargarh Municipality's response to a notice.

According to the response, a detailed project report (DPR) was prepared but returned by the govt with directions to provide a detailed cost estimate for a wastewater treatment plant. The DPR has since been resubmitted to the engineer in-chief of the Odisha Water Supply and Sewerage Board (OWSSB), Bhubaneswar.
Taking it on record, the bench comprising Justice B Amit Sthalekar (judicial member) and Dr Arun Kumar Verma (expert member), said: "We direct the housing and urban development department to file an affidavit within four weeks to show what action has been taken. It may be noted that Rs 1.90 crore has already been released by the state govt to the Bargarh Municipality."
The bench also directed the municipality authorities to file a separate affidavit detailing how the funds are being utilised in line with its directives. The matter was listed for next hearing on Sept 10.

New Delhi: The dissolution of the State Level Environment Impact Assessment Authority (SEIAA) and the State Level Expert Appraisal Committee (SEAC) has led to delays in issuing environmental clearances, a builder informed the National Green Tribunal (NGT) on July 31. In an affidavit submitted to NGT, Delhi Pollution Control Committee (DPCC) stated that environmental clearances cannot currently be issued by the state as the two authorities remain defunct. In the absence of the state bodies, the Union environment ministry is granting clearances. NGT is considering a plea by a builder who approached the tribunal in May after applying for environmental clearance (EC) in Feb last year. The plea highlighted that the tenure of SEIAA and SEAC ended in Sept 2024 before the EC process could be completed. The builder was seeking permission for a group housing project in Kirti Nagar. Formed in 2021 through a notification by the Union environment ministry, SEIAA and SEAC were responsible for reviewing all construction projects requiring an EC under the Environmental Impact Assessment (EIA) notification of 2006. These projects included large apartment complexes, hotels, commercial developments and infrastructure works exceeding a certain built-up area. Former members of the dissolved bodies mentioned that while MoEFCC or Delhi government can initiate the reconstitution process, there has been no progress since their terms ended. "Often, there is a lot of back and forth before EC is granted. With the Centre overseeing the process, the process may take longer," said a former member, requesting anonymity. State Level Expert Appraisal Committee, comprising three members, was headed by a former Public Works Department chief, Delhi's former environment special secretary and a functionary appointed by the previous Aam Aadmi Party govt. SEIAA had 11 members and was chaired by a former Delhi Development Authority commissioner.

New Delhi: A day after the closure of a corruption case against former minister Satyendar Jain, Delhi govt on Tuesday alleged irregularities in the construction of a block at LNJP Hospital during the tenure of the previous AAP dispensation. "The budget sanctioned for the construction increased by Rs 650 crore. (Former) PWD minister Satyendar Jain got changes done. He would go on inspection and suggest changes, which led to cost escalation. There was a scam of Rs 650 crore," Verma alleged. LG will forward the file to either ACB or CBI, he added. AAP responded by claiming that every day, BJP hatched conspiracies against AAP functionaries and squandered taxpayers' money on these directionless investigations. "Just a day ago, the court taught them a lesson by closing one of the CBI cases against Satyendar Jain. The court clearly stated that CBI had registered a baseless case with no corruption, no criminality and no evidence," it said. Saxena set up a committee last year to examine the "procedural lapses" in the LNJP project and it was found that the original contract amount was Rs 465 crore, which escalated by almost 243% to Rs 1,139 crore. The committee highlighted alleged irregularities and violations in the consultancy work under Jain, the then health minister. It suggested that a favoured architect consultant was appointed without a proper tender, violating procurement and general financial rules, sources said. Although six consultants were empanelled, it was noted that financial bids must be called separately for each project. This requirement was ignored and an arbitrary decision was taken to appoint consultants district-wise or region-wise, they said, claiming that this effectively meant that a single consultant was allowed to handle all projects.
