Murder most foul: on custodial torture and deaths

Nearly 15 years after the Supreme Court of India described custodial torture and deaths as the most heinous crime committed by men in uniform, brutal third-degree treatment of suspects remains a chilling reality. Emboldened policemen, with contempt for procedure, show no hesitation in resorting to violence, not just within but also outside police stations. In Tamil Nadu, the recent death of a young man, Ajith Kumar, who was detained and tortured by a special police team, in plain clothes, for alleged theft in Sivaganga district, underscores the deeply ingrained authoritarian and intimidating nature of the police force. The impunity with which he was detained, without a formal complaint or the registration of a First Information Report, illustrates just how normalised such disturbing behaviour has become in policing. Under the direction of the Manamadurai Deputy Superintendent of Police (DSP), Ajith Kumar was taken by the team to several secluded spots and subject to lathi blows to force him into confessing to have committed the theft — a woman visiting a temple in Madapuram had asked him to park her car; she later claimed that jewellery in the car was missing. Ajith collapsed under the brutality and the theft remains unproven. Justice S.M. Subramanian of the Madras High Court (Madurai Bench) aptly said, 'It is almost police-organised crime... Very crudely, we have to say it is the state killing its own citizen.'
Most victims are from oppressed backgrounds, making them easy targets. In this case, attempts at a cover-up failed due to protests and political outrage. With the custodial murder of a father and son in Sattankulam during the COVID-19 pandemic still fresh in public memory, Chief Minister M.K. Stalin wasted no time in damage control. Seven policemen, including the DSP were suspended; later, five were arrested. The case was transferred to the CBI. Mindful of a political fallout, with the Assembly elections nine months away, Mr. Stalin apologised to the victim's mother. Solatium was offered, including a cooperative society job to his brother, and a housing plot to the family. Mr. Stalin said that such incidents are 'unforgivable' and 'unjustifiable' — views he has not aired in suspected custodial death cases in the past four years. However, these measures alone will not bring closure to the families. As directed by the High Court, he must ensure there is action against senior police officers, if their involvement is proven. A fast track trial is needed. It is time for the law-keepers to fall in line and for such killings to end.

'Both leaders also acknowledge the importance of the agriculture sector and its significant contribution to the economies on both sides... To take this forward, they directed their teams to convene the Joint Working Group on Agriculture at the earliest opportunity,' he said. Kumaran further informed that PM Modi briefed Milei about India's Drone Didi initiatives aimed at increasing agricultural productivity. He added that the PM also informed Milei about India's innovative use of drones for emergency transport of medicines to remote areas during the COVID-19 pandemic. 'The Prime Minister also briefed President Milei on India's Drone Didi initiative and how it is being used to improve agricultural productivity by involving rural women in the use of drones to administer fertilisers and for land surveys. The Prime Minister also mentioned how drones had been used in India for emergency transport of medicines to remote areas during COVID, and also now how companies use drones to transport vegetables and fish to remote areas,' he added. 'The Prime Minister briefed the President on how the Indian satellite system, Navic, is used to help fishermen identify schools of fish... The PM also discussed how he utilises drones to monitor progress in projects of special interest to him, as part of his monthly project reviews. That was something that interested President,' he said. PM Modi also sought Argentina's support to expand India-MERCOSUR Preferential Trade Agreement. The preferential trade agreement (PTA) is aimed at expanding economic ties between India and the MERCOSUR bloc, which includes Argentina, Brazil, Paraguay, and Uruguay. 'The Prime Minister requested Argentina's support in expanding the India-MERCOSUR Preferential Trade Agreement, noting that such an expansion can bring mutual benefits to both sides and open up new opportunities,' Kumaran said. PM Modi arrived in Buenos Aires on Friday on a two-day trip in the third leg of his five-nation tour. The PM is now headed to Brazil for the fourth leg of his five-nation tour, where he will also attend the BRICS Summit in Rio de Janeiro. During the 17th BRICS Leaders' Summit, Prime Minister Modi will exchange views on key global issues, including peace and security, strengthening multilateralism, responsible use of artificial intelligence, climate action, global health, and economic and financial matters. According to the official statement, the Prime Minister is also likely to hold several bilateral meetings on the sidelines of the Summit. For the State Visit to Brazil, the Prime Minister will travel to Brasilia where he will hold bilateral discussions with President Lula on the broadening of the Strategic Partnership between the two countries in areas of mutual interest, including trade, defence, energy, space, technology, agriculture, health and people to people linkages. In a harsh post on social media platform X on Saturday, Stalin said the language rights struggle, waged by the Dravida Munnetra Kazhagam (DMK) in Tamil Nadu, 'is swirling like a storm of protest in Maharashtra.' 'The language rights struggle, waged generation after generation by the Dravida Munnetra Kazhagam and the people of Tamil Nadu to defeat Hindi imposition, has now transcended state boundaries and is swirling like a storm of protest in Maharashtra,' CM Stalin said in a post in Tamil. Shiv Sena (UBT) Chief Uddhav Thackeray and his cousin, MNS chief Raj Thackeray, held a joint victory rally over the Maharashtra government's withdrawal of two Government Resolutions (GRs) implementing the three-language policy. 'The BJP, which acts lawlessly and anarchically by stating that funds will be allocated only if Hindi is taught as a third language in Tamil Nadu schools, has been forced to back down for the second time in Maharashtra, where they govern, due to fear of the people's uprising,' the CM. Unaware of the history of numerous Indian languages being 'destroyed due to Hindi imposition' and failing to understand the agenda of 'turning India into the Hindi nation,' some naive individuals here parrot phrases like 'learning Hindi will get you jobs.' They must reform now. The 'uprising in Maharashtra will open their eyes of wisdom!' 'We will not allow the discrimination in fund allocation for Tamil or the arrogance of refusing to recognise the Keezhadi civilisation to continue. The BJP must atone for the betrayal it has committed against Tamil and Tamil Nadu. The Madras High Court dismissed an appeal seeking NEET re-exam, stating it would severely impact over two million students across the country. The Madras High Court on Thursday dismissed an appeal filed by a group of medical aspirants seeking a re-examination of NEET UG 2025. The court observed that allowing such a request would significantly impact over two million students who took the test across the country, as reported by news agency PTI. The appeal was filed by S Sai Priya and 11 others against the High Court's earlier order on June 6, which had rejected a batch of petitions requesting that the National Testing Agency (NTA) be restrained from declaring the results of NEET UG 2025. The petitioners had argued that they experienced power outages at four examination centres in Chennai and urged the court to direct the NTA to conduct a re-exam for affected students. However, a division bench comprising Justice J Nisha Banu and Justice M Jothiraman upheld the earlier verdict and dismissed the appeal. The bench stated, 'It is to be noted that the integrity of the exam is particularly ensured through human supervision including the presence of the Centre Superintendent, Invigilators, NTA appointed Observers and City Coordinator. All these officials have examined and confirmed that the examination was conducted smoothly. A factual enquiry was undertaken by the NTA and the enquiry was conducted with regard to the field verification through the reports of the examination functionaries and an independent statistical analysis of candidate performance data." The court further noted that an expert committee conducted a statistical analysis using anonymised data, comparing the average number of questions attempted by students at the concerned centres with those from other centres in Thiruvallur District. 'This analysis found no statistically significant difference in the number of questions attempted, confirming that the alleged power outage did not materially impact candidate performance. Furthermore, NEET (UG) 2025 is a time sensitive and large scale national examination," the bench observed. Highlighting the importance of maintaining the integrity of educational assessments, the court said, 'This Court cannot sit in an appellate jurisdiction against the considered decision of the speaking order passed by the NTA, after field verification of examination centre and statistical analysis by an independent expert committee with no affiliation to the NTA, unless such decision is demonstrated to be manifestly arbitrary, mala fide or illegal." The bench concluded that allowing a re-exam under such circumstances would severely disrupt the process and disadvantage the larger pool of candidates. 'In such circumstances, if any re-examination is permitted, the same would severely affect more than two million candidates. Therefore, we do not find any reason to interfere with the order impugned and the writ appeal lacks merit and the same is liable to be dismissed. In the result, this writ appeal stands dismissed," the court ruled.
