SC cracks down on NCR waste crisis, orders officials to ensure 100% segregation

The Supreme Court on Thursday tightened oversight on solid waste management in the National Capital Region (NCR), directing Delhi and the states of Uttar Pradesh, Haryana and Rajasthan to appoint senior officials as nodal officers to ensure 100% segregation and timely collection of solid waste.
The directive came in response to a petition by lawyer-activist MC Mehta, seeking action against pollution. A bench led by justice Abhay S Oka also recommended that the Centre consider reducing the 18% goods and services tax (GST) on products made from recycled construction and dust waste, noting that the sector needs incentives.
The court ordered states to submit realistic projections of municipal solid waste (MSW) generation over the next 25 years and to present corresponding action plans to handle the growing volume. It also mandated that nodal officers submit quarterly compliance reports starting September 1, 2025.
Urban local bodies across NCR were tasked with clearing legacy waste from landfills and furnishing data to the Commission for Air Quality Management (CAQM) on actions taken in response to complaints about pollution at construction and development sites.
Additionally, the court directed a widespread awareness campaign on the Solid Waste Management (SWM) Rules, 2016, which penalise failure to segregate waste at source. Bulk waste generators—those producing over 100kg of waste daily—must ensure no dumping, burning, or burying of waste in public spaces or water bodies.
The Municipal Corporation of Delhi (MCD) informed the court that it aims to achieve full segregation at source—including dry and wet, biodegradable and non-biodegradable waste—by January 2027. The Greater Noida authority said it plans to clear landfill legacy waste by August 2025. Haryana reported current segregation at 45%, with a target of 100% by year-end.
Senior advocate Aparajita Singh, assisting the court along with senior advocate Udita Babbar, submitted recommendations to enforce strict timelines and proposed designating a high-ranking official responsible for implementation.
The bench, also comprising justice Ujjal Bhuyan, said, 'We direct the states of Haryana, Rajasthan, UP and National Capital Territory of Delhi, as well as MCD, to designate a high-ranking nodal officer to supervise compliance to achieve 100% segregation of waste. The same officer shall supervise 100% collection of solid waste... The nodal officer, in both cases, shall file regular compliance reports, starting from 1 September 2025 and every quarter thereafter.'
On the high GST charged on recycled products, the bench said, 'We direct Union government to consider this issue by placing it before the concerned authority. We recommend that the activity needs to be incentivised for the cause of environment.'
The court also questioned the absence of a standing committee in the MCD and said it would revisit the issue at the next hearing.
'Considering large-scale construction and development activities, generation of MSW is bound to increase. All NCR states must make a realistic estimate of MSW generation in the next 25 years, so authorities are prepared to deal with the rising quantum.'
The court directed states to outline measures being taken by September 1. It also asked the CAQM to file an affidavit detailing complaints received by state pollution boards and urban local bodies regarding dust and construction waste violations, and actions taken.
'The affidavit shall give categorical data, indicating number of complaints filed against individuals and government entities,' the court said, pointing out that states are empowered under the CAQM Act to act against violators.

Opposition legislators on Wednesday (July 2, 2025) staged a protest at the Maharashtra legislature complex, accusing the BJP-led government of favouring a private firm for a major tunnel project in Thane, and alleged that it involved a ₹3,000 crore scam. The tender process for the Thane-Borivali twin tunnel project was cancelled by the Mumbai Metropolitan Region Development Authority (MMRDA) in May after the L&T, which had been disqualified, moved the Supreme Court. Standing on the steps of the Vidhan Bhavan complex here, MLAs and MLCs of the Maha Vikas Aghadi (MVA) shouted slogans and claimed that the government cancelled the contract only because it feared action by the Supreme Court. The monsoon session of the state assembly and legislative council is underway since Monday (June 30, 2025). Among those who took part in the protest were the Leader of Opposition in the council, Ambadas Danve (Shiv Sena UBT), Satej Patil of Congress, and NCP (SP) leader Jayant Patil. "Despite serious concerns being raised about the project, the government continued to push it. This is not just a technical lapse. It is a ₹3,000 crore scam which the people of Maharashtra must not ignore," Mr. Danve said. Satej Patil alleged that the contractor who won the contract was a known donor of electoral bonds. "This is not a coincidence. The government is rewarding the same company that has funded it. This raises fundamental questions about transparency and fairness," he said. Jayant Patil demanded an immediate review of all contracts awarded to Megha Engineering and Infrastructure Ltd, the company in question. Megha Engineering and Infrastructure had become the state's "preferred contractor", opposition leaders alleged. "Megha gets the cream, farmers remain hungry," was one of the slogans shouted by opposition leaders. Mr. Danve said the opposition would continue to raise the issue in both Houses until action was taken. "This is not just about one company. It's about governance being compromised," he said.

Later, the Yogi Adityanath-led Uttar Pradesh government extended the order across the state. The petition, filed by Raghavendra Bagal, an Indian citizen living in Oman, contests the government's revised Request for Proposal (RFP) issued in February 2025, which mandates a uniform fee for CPV services regardless of whether applicants opt for additional Value Added Services (VAS). STORY CONTINUES BELOW THIS AD A bench comprising Justices KV Viswanathan and Nongmeekapam Kotiswar Singh took note of the petitioner's grievance that the uniform fee structure forces all applicants to pay for VAS even if they do not avail themselves of such services. The bench remarked, 'The grievance is that whatever service the individual avails, a uniform fee is fixed irrespective of the nature of the service.' This policy, the petitioner argues, results in an arbitrary price hike — up to 1,617 per cent in some cases — and creates cross-subsidies benefiting third-party vendors appointed to provide these services. The controversy stems from a shift in the 2025 RFP compared to the original 2014 framework. Earlier, third-party vendors charged separately for VAS, which applicants could choose at their discretion. The new policy, however, requires vendors to quote a single all-inclusive cost, effectively bundling VAS charges with basic consular services, irrespective of actual usage. The petitioner had earlier filed a Public Interest Litigation in the Delhi High Court, which dismissed his plea, citing lack of jurisdiction. The high court had pointed out that only certain RFP conditions were challenged, while other bidders had filed separate petitions on related issues. The petitioner, represented by advocate Dheeraj Malhotra, then approached the Supreme Court, arguing that the Delhi High Court erred by conflating the petitioner's case with unrelated vendor petitions and thereby wrongly denied the petitioner his right to be heard. The counsel emphasised that as an Indian passport holder residing abroad, the petitioner is directly affected by the pricing policy and thus has locus standi to challenge it.
