Accusations of fraud: Charges laid against against Higher Education Minister Nobuhle Nkabane

The Democratic Alliance (DA) has opened a criminal case against Higher Education Minister Nobuhle Nkabane, accusing her of lying to Parliament about the appointment of ANC-linked individuals to Sector Education and Training Authority (SETA) boards.
On Tuesday morning, DA Federal Chairperson Helen Zille and DA MP Karabo Khakhau, who serves on the Parliamentary Portfolio Committee on Higher Education and Training, laid the charges at the Cape Town Central police station.
Khakhau said the charges relate to Nkabane's alleged deliberate misrepresentation of the appointment process for SETA board members, during which she claimed an 'independent' evaluation panel was responsible for the selections.
'She falsely claimed an 'independent' panel made the appointments — including a chair who confirmed he wasn't involved,' said Khakhau.
'The DA has laid criminal charges against Minister Nkabane for lying to Parliament about ANC cadre appointments. We will vote against her department's budget and other budgets led by corrupt ANC ministers.'
Khakhau accused Nkabane of facilitating 'fraudulent' appointments by misleading the Parliamentary committee, and said the so-called independent panel had included her own Chief of Staff and an ANC Youth League leader.
'Most damningly, she falsely named Advocate Terry Motau SC as the chair of this panel, a claim he has unequivocally denied in writing. He made it clear he had no knowledge of, nor participated in, the process,' she added.
In a statement, the DA said: 'This is not a case of poor judgement; it is a flagrant and deliberate attempt to deceive Parliament and the South African people. Minister Nkabane has broken the law and violated her oath of office. The DA will not stand by while ministers who lie, manipulate processes, and protect ANC cronies remain in office.'
The party said it would not support the Department of Higher Education and Training's budget while Nkabane remains in office and vowed to oppose all budgets led by ministers 'under criminal investigation for corruption or misconduct'.
Zille said the party was taking this step because of President Cyril Ramaphosa's 'inaction' in the face of corruption within the executive.
'We're here today for the simple reason that President Ramaphosa refuses to be as good as his word and act against corruption, act against criminality in our Parliament,' Zille said.
'Serious fraud and the misleading of Parliament are somehow condoned by President Ramaphosa's government. That is an enormous double standard.'
Zille described the SETA appointments as a 'blatant lie to a committee of Parliament,' and added that in previous cases, such acts were treated as both fraud and a criminal offence.
She said an investigation by Khakhau had revealed that the people responsible for selecting board members included three senior employees from the Minister's department: 'We have the Minister's Chief of Staff, we had the Chief Director for the SETAs, accountable to the Minister, and we had the Director of Corporate Services who's very close to the Minister.'
Zille also criticised the inclusion of known ANC deployees on the selection panel and said the Minister's conduct amounted to misleading Parliament.
'This matter concerns Minister Nkabane of Higher Education. She announced certain appointments to the SETA boards, which are crucially important in the higher education sector of South Africa,' Zille said.
'Far from being independent people who had come in as experts, it turns out several of them were either her employees or deployed ANC cadres from various positions. This was a blatant lie to a committee of Parliament, which is considered to be a lie to Parliament. Misleading Parliament and fraud are two criminal contraventions.'
The DA called on Ramaphosa to act swiftly and remove Nkabane from office, warning that continued inaction would implicate him in enabling corruption.
Presidency spokesperson Vincent Magwenya and Nkabane's spokesperson Camagwini Mavovana had not responded to questions. This story will be updated when they comment.

Ramaphosa met US President Donald Trump in May, accompanied by businessman Johann Rupert, some Cabinet ministers and South African golfers Ernie Els and Retief Goosen. However, Mulder told reporters at the OR Tambo International Airport on Wednesday that Ramaphosa's meeting with Trump was a failure. He had just returned from a trip to the US, where he met with US government officials and businesspeople. 'We all took notice of the events in the Oval Office, and we saw that it did not look like a success. Our delegation came back to South Africa and said everything went well, the problem is that no one we met, including the appointments, told us that the meeting was a success. 'On the contrary, they are concerned about what happened and they desperately want to reset relations between South Africa and the US, but there are certain problems that need to be solved,' he said. 'We met with people from the office of the Vice President; we met people in charge of the National Security Council as well as the Homeland Security Council. 'The current situation is that the current administration has reached out by name to the Afrikaner people, we would be foolish not to act on that,' he said. Mulder also said he did not view Trump's involvement with South Africa's policies as 'interference'. 'I do not think the US is interfering with South Africa. If South Africa prefers the US to have nothing to do with South Africa, we should just ignore these four preconditions and it will happen automatically,' he said. Presidency dismisses 'personal ambitions' of FF Plus Meanwhile, Presidency spokesperson Vincent Magwenya told The Citizen on Wednesday that the FF Plus had gone to the US as non-state actors. 'Our experience is that state actors do not use non-state actors as intermediaries; therefore, the FF Plus visit and subsequent pronouncements will be viewed as nothing more than their personal ambitions,' he said. Political analyst Ntsikeleo Breakfast told The Citizen that he believes that FF Plus did not go to Washington DC with good intentions. 'I do not believe what they are saying, that the relationship has not been fixed. From my understanding, that issue was fixed,' he said. More strain in the GNU? Breakfast said the FF Plus visit to the US further complicates matters for Ramaphosa, who just fired a DA minister for going to the US without permission. The FF Plus is a partner in the government of national unity (GNU). 'This complicates matters for the GNU. These political parties, they need to work together as a united force and as a team of the GNU. You can't want to be a member of the GNU and still take a step back and draw swords with another member,' he said. Undercover police arrested three men after discovering a counterfeit money operation linked to a Lyttelton shopping centre in Pretoria on Tuesday, 01 July 2025. Officers noticed a man loitering near ATMs and stopped him for a search. The officers uncovered fake banknotes hidden in the man's bag, mixed with blank sheets of paper. The discovery raised red flags and prompted further investigation. Acting on leads from the arrest, police raided a nearby house suspected to be the operation's base. Inside, they seized more counterfeit South African rand and US dollar notes, as well as a printing machine used to produce the fake money. Police arrested two more men at the house during the raid, bringing the total number of suspects to three. The three suspects will soon appear in court on charges of possessing and producing counterfeit currency. Police have confirmed that further charges may be filed as the investigation continues. KZN flood victims face eviction as housing criteria excludes many from government support

After three years in shelters waiting for homes to be built, some 2022 flood victims are now scrambling to prove that they do indeed need help from the government despite not meeting the criteria. In April, some of the 2022 KwaZulu-Natal flood victims living in shelters received eviction letters – the deadline being 30 June 2025 – and now they are scrambling to write affidavits explaining their circumstances and why they cannot afford different housing or to build their own homes. Transport and human settlements spokesperson Ndabezinhle Sibiya told Daily Maverick the verification process of flood victims had uncovered foreign nationals and individuals who did not qualify because they already had RDP houses or earned more than the amount to qualify for RDP houses. The 2022 floods were among the deadliest natural disasters in the region's history, resulting in at least 436 deaths and extensive damage to infrastructure and homes. The department is applying the same criteria to disaster victims as it does to people applying for government housing in general: they must have an income of under R3,500 per month, must never have had a home and an RDP house before and must be South African citizens over 18 years of age with dependants. Sibongile Mkhize from KZN Flood Victims and The Poor Dwellers said they have a number of questions because when the criteria were finally shared with them, they were told that those earning above R3,500 would be partially helped to secure homes. 'I feel like there has been a lack of communication. People should have been told what the meaning of 'we will assist those who don't qualify' is. Right now it looks like they are being kicked right out,' Mkhize said. Mkhize was employed and lost her job while in the shelter and had to go to the Department of Labour and other places to verify that she is indeed unemployed and qualifies for housing. Mkhize said that in previous engagements with officials they said R3,500 was too low as a threshold to disqualify people for housing. 'If you earn R5,000 you still cannot afford to build yourself a house. Some of the people who will get evicted lived in RDP houses that were destroyed in the floods, so now they are disqualified for the new housing. Is this right and just? That is the question we have.' Gladys Nongoboza (47) has seven dependents, the youngest of whom is four. She doesn't qualify for housing because she earns R6,000 a month. Before the floods they lived in a three-bedroom shack in Megaville. She said she had been hopeful the government would help her build a home, as officials had said. 'They said no one would get left behind. I can only afford rent that is below R1,000 and that will not fit a family of eight. Any assistance from the government would make a difference. After we received the notice, I have been looking for rentals everywhere. I just cannot manage with my salary. We have waited in hope for three years but now we are helpless. I have no idea where to go when we get kicked out of this flat – my children and I will end up on the streets. Any help we can get would be great to just find a place to live.' The KZN human settlements department said it submitted a detailed report on the matter to the South African Human Rights Commission. The commission 'agreed with the department on the correct steps undertaken to manage this matter. The 2022 flood victims have been accommodated in private self-catering accommodation across eThekwini since December 2022. More than R185-million has been paid so far by the Department of Human Settlements for private self-catering accommodation for the 2022 flood victims and those who were affected recently,' it said. The department needed a further R128-million for self-catering accommodation for the victims. Transport and human settlements MEC Siboniso Duma said every cent should be saved and used to build permanent houses for the victims. 'In order to ensure that there is no irregular or fruitless expenditure, in line with prescripts of the Auditor-General, a verification process of individuals and families in self-catering accommodation was conducted months ago.' Sibiya said his department had written letters informing individuals who do not meet criteria that they would no longer be put up in self-catering accommodation after the verification process. 'Living in self-catering accommodation is not viable for these individuals because those that live in self-catering accommodation are linked to houses that are currently being built by the department.' The findings of the verification exercise had included: Currently there are 179 individuals who do not qualify to live in self-catering accommodation; The verification process uncovered that some individuals have government-built RDP houses. And the government cannot build a RDP house twice. It is against government policy; Some individuals earn enough and above the stipulated amount of money to qualify for an RDP house. Therefore they should not be accommodated in self-catering accommodation; Some individuals claimed not to have identification documents. When we offered to assist them to obtain IDs through the Department of Home Affairs, they refused and others disappeared; We uncovered that some individuals are foreign nationals; and We also uncovered that some individuals that have benefited from the government in the form of newly built houses have brought relatives to the self-catering accommodation. 'The department asked them to look for alternative accommodation as they will never qualify for government-built houses in the future. Some houses for individuals have been built in the land acquired from traditional leaders and these will be handed over by the MEC in the next few days,' Sibiya added. Despite the 30 June deadline, people have not been evicted, while the authorities consider their motivations to remain in self-catering accommodation. Sizilwethu Chili explained in his affidavit that he earns R5,000. He pays R2,500 to support his two children, whose combined school fees come to R6,000 per month, in addition to about R1,000 for transport. He pays R850 for transport to work and R155 for a funeral policy, as well as other costs. His affidavit ends with a plea: 'I need assistance to find a house.' Chili's affidavit is similar to a number shared with Daily Maverick – people explaining their particular circumstances, hoping for a different outcome to eviction. Noting this, Sibiya said: 'Critically, there are individuals who have pleaded and asked to bring more concrete evidence to back up their position that they still qualify to be accommodated in self-catering accommodation. The MEC for transport and human settlements, Siboniso Duma, has supported the decision to give such individuals an opportunity to provide evidence. He believes that this will ensure that in the future the department is not accused of being involved in fruitless and irregular expenditure.' DM
