An unsurprising judgment
According to the 2014 Act, the number of seats in the Legislative Assemblies was to be increased from 175 to 225 in Andhra Pradesh and from 119 to 153 in Telangana. However, the delimitation process was stalled as the Census could not be conducted in 2020-21 — first because of the COVID-19 pandemic and later for various other reasons.
Telangana has represented the matter to the Central government on many occasions. The State government brought it up during meetings convened by the Union Home Ministry to resolve bilateral issues between Telangana and Andhra Pradesh post-bifurcation and also during Southern Zonal Council meetings held under the chairmanship of Union Home Minister Amit Shah from time to time.
In a letter addressed to Union Home Secretary Rajiv Mehrishi in June 2016, the then Telangana Chief Secretary, Rajiv Sharma, recalled the provision made under Section 26 of the Act for delimitation of constituencies in the two States. As the new State of Telangana came into existence with effect from June 2, 2014, Mr. Sharma requested the Home Ministry to place the matter before the Election Commission of India (ECI) for increasing seats in the Telangana Legislative Assembly from 119 to 153 as envisaged in the Act as soon as possible. Telangana's former Chief Electoral Officer, Rajat Kumar, also spoke of the impact of transferring a few mandals of Khammam district in Telangana to neighbouring Andhra Pradesh post-bifurcation. He said that the three constituencies were reserved for Scheduled Tribes.
Professor K. Purushottam Reddy filed a plea in the Supreme Court seeking readjustment of seats in the Assemblies of the two States, pointing to the exercise in Jammu and Kashmir as a precedent. In its judgment last week, the Supreme Court ruled out delimitation of constituencies till the completion and publication of the Census, which is expected to start in 2026. The Court dismissed his petition saying granting relief would be 'contrary to the letter and spirit of constitutional design'. It said that 'Article 170 [which deals with composition of Legislative Assemblies in States] has no application to Union Territories...' It said that the Centre therefore did not discriminate against the electorates of Andhra Pradesh and Telangana, nor dampen their legitimate expectations by conducting delimitation of constituencies in the Union Territory of J&K, which was being governed by a distinct constitutional and statutory regime. Justice Surya Kant also explained that there was a specific constitutional embargo in Article 170 stating that delimitation in States was barred until after the completion of the first Census post 2026. Article 170(3) lays down that 'upon the completion of each Census, the total number of seats in the Legislative Assembly of each State and the division of each State into territorial constituencies shall be readjusted by such authority in such a manner as Parliament by law determine'.
The next Census, scheduled to begin in 2026, is likely to be conducted in two phases. The official headcount and house-listing process that will precede it are expected to be completed by March 1, 2027. The numbers will take a few years to be finalised and released. The Delimitation Commission can base its work only on the published Census figures and this could further delay the delimitation exercise in the two States. This means that the exercise will start only after the publication of the next Census data.
While the verdict has dashed the hopes of the States, it is also unsurprising. No political party, including the Bharat Rashtra Samithi which claims to have played a crucial role in drafting the Act, seems to have paid notice to the wording of the Act. As former MP B. Vinod Kumar rightly said at a press conference, simply adding the words 'notwithstanding Section 170 sub clause 3' in the 2014 Act would have resolved the problem. If that had been done, delimitation in these two States would possibly not have been clubbed with delimitation across the country.

‘BJP's J&K policy a failure': Mehbooba says party's agenda of alliance offers respectable solutions
Claiming that BJP's policy for J&K was an utter failure, the president of the Peoples Democratic Party (PDP) Mehbooba Mufti, on Saturday, said that saffron party should implement 'agenda of alliance' that was reached between PDP and BJP in 2015 when they formed a coalition government in Union territory. The former chief minister strongly advocated a dialogue, firstly with the people of J&K and then taking it on a higher pedestal with Pakistan. 'There is still time and scope to implement 'agenda of alliance' that late Mufti Sahib reached with the BJP. It was an agenda of alliance of the people of J&K and this nation,' she said. She recalled how her father advocated opening border routes like Kargil-Skardu, Sialkot-Suchetgarh and other routes with Pakistan in a bid to make borders soft and encourage people to people contact. 'My father Mufti Mohammad Sayeed Sahib had a vision for J&K, and had formed a common minimum programme with the Congress when it formed the government in alliance with the BJP in 2002. 'After that, we worked out an agenda of alliance with the BJP and the only purpose behind it was to bail J&K out of the morasses,' she said. 'The agenda of alliance talked about opening cross-border roads so that caged J&K could be opened. It was for the transfer of power projects, removal of Armed Forces (Special Powers) Act and other measures to bring peace and progress to the region. What you (BJP) do? You separated Ladakh after bifurcating the state into two UTs. That was the day when J&K was ruined on the pretext of improving the situation and restoring peace,' she said. Mufti claimed that since August 5, 2019, the situation has deteriorated, especially across Jammu region. 'In the last six years, crime graph has gone up in Jammu because criminals have come here. Livelihood of the people of Jammu are being jobs, everything is being given to the outsiders,' she said while recalling that people of J&K were promised 'rivers of milk and honey,' she said. 'J&K continue to be the flashpoint between India and Pakistan with clouds of war hovering over the region,' she said. The PDP chief claimed that BJP has also realised that stern policy in Kashmir has not brought any positive change. 'In fact, this approach has pushed J&K further back. I appeal to the government to relook into the agenda of alliance and implement it,' she said. The PDP leader also claimed that Prime Minister Narendra Modi enjoys authority like his predecessors Indira Gandhi and Vajpayee, and he should adopt a humanitarian approach rather than using J&K as a 'vote bank'.

Congress leaders who joined BJP ahead of Delhi elections get key posts
BJP MLAs Arvinder Singh Lovely and Raj Kumar Chauhan, who had switched to the party from Congress ahead of the Assembly elections in the Capital, have been appointed to key positions in the Delhi government. Lovely, the Gandhi Nagar MLA, has been named Chairman of the Trans-Yamuna Development Board, while Mangolpuri legislator Chauhan has been appointed the Chairman of the Village Development Board. The posts are equivalent to the rank of a Cabinet minister, underlined a government document. 'The Council of Ministers decided to designate the positions of Chairperson of Delhi Village Development Board (DVDB) and Chairperson of Trans Yamuna Area Development Board in the rank of Cabinet Minister in GNCT of Delhi,' stated a government document on Saturday. It added that other members of DVDB will be nominated by the government. 'The function of the Board will be to advise the government on issues connected with the infrastructural development works in rural and urban villages of Delhi,' it further said. Both Lovely and Chauhan had previously served as ministers in the Sheila Dikshit-led Congress government. The latest appointments are seen as a reward for their role in strengthening the BJP's campaign in the Assembly election. 'This was a much-awaited reward. Both leaders bring administrative experience and will play key roles in developmental initiatives and in the party's civic poll strategy,' said a senior BJP functionary. Officials said the nominations received approval from Chief Minister Rekha Gupta a few days ago. Lovely, who also served as the pro-tem Speaker of the Delhi Assembly, quit the Congress last May, citing disagreement with the party's decision to ally with AAP for the 2024 Lok Sabha elections. He had then joined the BJP for the second time and said: 'The last time I left Congress, it was in anger. This time, I did so with a cool head and after deep thought. Now, it's BJP or nothing—either we do politics here, or we don't do it at all.' Chauhan resigned from the Congress after being denied a ticket in the 2024 Lok Sabha polls. Contesting on a BJP ticket from the Mangolpuri (SC) seat earlier this year, Chauhan emerged victorious. Chauhan on Saturday said, 'The party has given us recognition equivalent to Cabinet rank and given the opportunity to work for the welfare of the people. I thank Prime Minister Narendra Modi ji and Chief Minister Rekha Gupta ji for this and under their leadership, will work on the vision of 'Viksit Delhi'.'

Govt chalking out plan to construct 10 lakh houses for poor, says Delhi CM
The Delhi government is chalking out a strategy to construct 10 lakh houses for the poor, Chief Minister Rekha Gupta said on Saturday while directing officials to allot 50,000 flats to slum dwellers for resettlement in the first phase of the initiative. 'The government is preparing a comprehensive strategy to meet the demand for 10 lakh houses. These efforts are fully aligned with Prime Minister Narendra Modi's vision of providing a house to every poor,' the CM said. Her remarks came as she inspected the government flats built to rehabilitate slum dwellers in Northwest Delhi's Sultanpuri. She directed the officials to prioritise the immediate repair of salvageable flats and reconstruct those beyond repair. Constructed in 2016 for rehabilitation of slum-dwellers with government expenditure running into crores of rupees, the flats in Sultanpuri have remained unallocated due to the apathy and lack of intent of the previous administration, Gupta said. A similar situation prevails for another 50,000 flats in Outer Delhi, she underlined, adding that many units have deteriorated so severely that substantial funds will now go into repairs. The Union government has already sanctioned around Rs 732 crore to repair thousands of these flats, Gupta said. On criticism from the Opposition over recent demolition drives in slum clusters in the Capital, Gupta said, 'Parties that failed to act for years are now making noise for political gain. When they were in power, why didn't they distribute these houses? Why were these flats allowed to turn into ruins? Were they waiting for our government to come and do the job?' A day after she made similar remarks, the CM reiterated her promise for a flat for every slum dweller. 'No one will be forced to live under the open sky, shiver in the cold, or struggle for basic sanitation. Our government is determined to guarantee every poor family security, essential facilities, and the right to a dignified life.' A total of 1,060 houses have been built in ground plus four floor structure in Sultanpuri's C-Block for economically weaker sections under the Jawaharlal Nehru National Urban Renewal Mission (JNNURM). The construction of the project was completed in March 2016. The one BHK flats were to come up at a cost of Rs 52.81 crore, which later escalated to Rs 67.84 crore. The per-unit cost, as per the initial amount, was Rs 4.98 lakh. It was revised to Rs 6.40 lakh. The tender cost of the project was set at Rs 51.72 crore, while the total expenditure reached Rs 63.83 crore.
