Kota Kinabalu: A man, who was detained on his 24th birthday this year, was jailed five years and ordered given a stroke of the cane for repeatedly taking syabu. Sessions Court Judge Amir Shah Amir Hassan handed the sentence to Mohammad Zulkarnain who admitted to the charge against him on Tuesday. Mohammad was found taking the drug at 8.30am on Feb 24 this year after his urine was tested positive for drug at the Papar police station. He has two previous conviction records of taking the drug. The offence under Section 39C(1) (b) of the Dangerous Drugs Act carries a jail term of between five and seven years and whipping, on conviction. After completing the jail sentence, Mohammad was ordered placed under police supervision for three years. In meting out the sentence, the court advised Mohammad to not repeat to take the drug, seek for a job and find a soulmate since he is still single.
Advertisement In another court, the court set July 24 for further pre-trial case management for a 38-year-old lorry driver charged with committing criminal breach of trust involving frozen products worth RM39,326. The court set the date for Azlan Limin when his counsel discharged herself from representing him. Azlan informed the court that he could not engage a counsel because of financial problems. He is accused of breaching the trust given to him as a lorry driver who was entrusted by the Evergrowth Intergrated Food Industries Sdn Bhd with the 316 cartons of frozen goods on Apr 9 this year at the company premises in Kg Mook, Kinarut, Papar. He claimed trial to the offence under section 407 of the Penal Code which carries a jail between one and 10 years, with whipping and liable to a fine, on conviction. The court extended Azlan's bail. The incident reportedly stemmed from a disagreement during a dive trip to Pulau Timba-Timba on Tuesday when a gas tank belonging to the victim accidentally fell and injured the 38-year-old suspect's foot. The next day, the suspect, after receiving medical treatment in Tawau, returned to the tour company's premises to confront the victim and allegedly demanded compensation. During the confrontation, an argument broke out, and the suspect is accused of physically assaulting and threatening to injure the victim. SEMPORNA: A local scuba diving instructor has been arrested after allegedly assaulting and threatening a 34-year-old tourist following a dispute stemming from a diving trip incident. The altercation traces back to Tuesday (July 22), when both men were on board a boat heading towards the waters off Pulau Timba-Timba for a scuba diving session. During the trip, the tourist's oxygen tank accidentally toppled over and landed on the instructor's foot, which caused him to become upset. The situation escalated the next day when the 38-year-old instructor, after receiving medical treatment at Tawau Hospital, returned to the tour company to confront the tourist and demand compensation. A heated argument ensued, during which the suspect allegedly assaulted the man and threatened further harm. A video of the altercation has since gone viral on social media. In the footage, the instructor is seen slapping the tourist in the face while arguing with him and a woman believed to be accompanying the tourist. The trio were speaking in Mandarin during the exchange. After being slapped, the tourist is heard asking someone off-camera, 'Have you called the police?' Meanwhile, the woman can be heard repeatedly telling the instructor, 'Does it have anything to do with us?' Semporna acting OCPD Deputy Supt Jaafar Hakim confirmed that the suspect was arrested and the case is being investigated under Sections 323 and 506 of the Penal Code for voluntarily causing hurt and criminal intimidation. Police are urging eyewitnesses to come forward and assist in the investigation.
