Garda colleagues gather for service in memory of Kevin Flatley
Colleagues of the Garda who died after being struck by a motorcyclist on Sunday embraced in emotional scenes at Dublin Castle on Monday evening as they met ahead of the memorial service.

Those in attendance included colleagues both past and present from across Ireland who came to pay their respects, and Garda Commissioner Drew Harris.

Prayers were led by the Rev David Pierpoint and Father Joe Kennedy, both longstanding chaplains at An Garda Síochána.
Mr Flatley, 49, died after being hit by a motorcycle as he was recording vehicles' speeds on the R132 at Lanestown on Sunday afternoon.
President Michael D Higgins, Taoiseach Micheál Martin and Tánaiste Simon Harris are among those who have expressed their sympathies and shock following the death of the married father of two who had served for 26 years.

He was the 90th officer to die on duty since the creation of the force in 1922.

Man (32) caught with child sex abuse images sent to prison after suspended sentence is overturned
A man who received a fully suspended term for sending 2,500 sexually explicit messages to a 15-year-old boy and having thousands of child abuse images has been jailed for three years after the Court of Appeal found his original sentence was too lenient. James Varian (32), with an address at Lois na Greine, South Douglas Road, Cork, was found to have 7,781 child sex abuse images on his mobile phone, with the majority of the files related to prepubescent children under the age of 12. Advertisement Varian pleaded guilty to using information and communication technology to facilitate the sexual exploitation of a child contrary to section 8 (1) of the Criminal Law (Sexual Offences) Act 2017. He also pleaded guilty to the possession of child pornography contrary to section 6 (1) of the Child Trafficking and Pornography Act 1998, as amended by section 14 of the Criminal Law (Sexual Offences) Act 2017. The judge also took into consideration an offence of attempting to pervert the course of justice contrary to common law. On November 19th 2024, Varian was sentenced by Judge Dermot Sheehan in Cork Circuit Criminal Court. Advertisement He received four years fully suspended for the charge of facilitating the sexual exploitation of a child, and two years fully suspended for the possession of child pornography. The Director of Public Prosecutions had appealed the sentence on the grounds that it was too lenient. At the original sentencing hearing, Detective Sergeant Brendan Corry said that on January 4, 2022, gardai were called to an address and spoke to a father who said that images and other media files of a sexual nature were found on a home computer a 15-year-old boy had been using. Det Sgt Corry said that gardai found messages of a sexually explicit nature were being sent to the boy, mostly through the messaging site Telegram. Advertisement He said that on January 5th the respondent phoned gardai to say that he was the subject of a garda enquiry and on January 6 a warrant was obtained to search his home. He said that the communication discovered by gardaí was 'alarmingly excessive, with in excess of two thousand five hundred messages exchanged over a period of nine days spanning between December 26, 2021 and January 4, 2022." At the time of offending, Varian was 28 years old, while the boy was 15. Det Sgt Corry said that on January 4th upon discovering that gardai were investigating, Varian also directed the boy to 'purge chats, delete everything'. Advertisement He said that Varian was arrested on May 30th 2022, was detained and interviewed on two occasions, where he made no admissions at interview. He said that the seized phone was found to contain 7,781 images classed as child pornography, with 6,431 of these images deemed as 'child animation'. Counsel for the DPP, Emmet Boyle BL, told the Court of Appeal that the sentencing judge erred in failing to attach appropriate weight to aggravating factors in the case. He said these factors included the amount of messages sent to the child, the disparity of age between the defendant and the victim, his urging the boy to delete the messages and his risk of reoffending which was outlined by the probation services. Advertisement Mr Boyle also said that the sentencing judge put undue weight on the mitigating factors in the case, like Varian's lack of previous convictions and his early guilty plea. Defence counsel for Varian, Jane Hyland SC, said that the decision to fully suspend his sentence was justified and the judge was exercising within his discretion in the sentencing. She said that her client lost his job as a result of the incident, that he suffers from mental health problems and that he also suffered reputationally from the incident. Returning judgement, Mr Justice John Edwards said that the sentencing judge's reasons for fully suspending the sentences were 'relatively sparse', giving only Varian's age and the fact that he was a first time offender. He said that the judge acted in error to fully suspend the sentences and that the decision was not proportionate to the gravity of the offending. He said that the sentencing was 'outside the norm and unduly lenient'. He also said that although the court noted Varian's assertions of his remorse, his letter of apology presented to the judge failed to mention his young victim at all. He said that the court also accepted the discount of two years for both counts given in mitigation by the sentencing judge. They also sentenced him to two years in custody for the count of possession of child pornography, to run concurrently with the first.

Boss of gun-running ring that smuggled weapons from US could face up to 14 years in jail
The boss of a gun-running ring that supplied weapons and ammunition smuggled by air from the US to criminal organisations could face up to 14 years in jail, a court has heard. Before the Special Criminal Court on Thursday was Mark McCourt (34), of Edenrieve, Newry, Co Down, who previously pleaded guilty to firearms offences and participating in a criminal organisation's efforts to import restricted weapons. Advertisement Counsel for the State, Simon Matthews BL said the Director of Public Prosecutions had placed the offending at the higher end of the scale, which carries a sentence of 10 to 14 years. The matter has gone back to November 3rd next for sentencing, with the accused remanded in custody. When McCourt appeared before the Special Criminal Court earlier this week, a senior garda said in evidence to the three-judge court that he was 'fully satisfied' that there was a criminal organisation in existence under the 'control and direction' of McCourt 'whose function was the importation of firearms components from the USA to Ireland, and the reassembly of these restricted firearms for onward distribution to other criminal organisations'. Detective Inspector Shane McCartan of the Garda Drugs and Organised Crime Bureau, who led an investigation into the gang's activities last year, said a firearms technician had been able to assemble 82 gun parts seized in a raid on a property in Co Louth last year into six assault rifles and a dozen pistols. Advertisement Det Insp McCartan said McCourt had already been identified in connection with the suspected importation of firearms when the defendant was arrested for something else on May 24th 2024 and had his phone seized. Gardaí were able to extract data from the phone shedding light on the activities of the smuggling ring in the preceding year, along with conversations with prospective customers in messages on Signal, WhatsApp and Snapchat, the witness said. Det Insp McCartan said McCourt and his co-accused both flew to Las Vegas, Nevada on three occasions in April and May 2023. The witness told the court that in one text message, McCourt told one prospective customer -- who used the alias 'The Keeler' – that '€75k cash is [the] best price' for a number of firearms, adding: 'I'll throw in the 10 pipes for free.' Det Insp McCartan said: 'It's my belief that refers to pipe bombs.' He told the court the defendant has some 42 previous convictions including assault causing harm, theft, and dangerous driving 'on the high end'.

Man (46) jailed for taking photographs of his teenage stepdaughter in the shower
A man who took photographs of his teenage stepdaughter in the shower has been jailed for production of child abuse material. The 46-year-old man, who cannot be named to protect the identity of the girl, pleaded guilty at Dublin Circuit Criminal Court to production of child pornography in that he knowingly produced 11 images of a female child which would be considered child pornography at a Dublin hostel on April 12th, 2018. Advertisement Sergeant Brendan Casey told John Griffin BL, prosecuting, that gardaí were called to a hostel in Dublin on April 9th, 2018, because there were concerns about a man with a child. The child was 16 years old at the time and hostel staff told gardaí that there had been inappropriate contact between the man and the child. The man was 39 years old at the time and when staff tried to engage in conversation with him, he became protective of the girl and said she was fine. He left the hostel. Gardaí viewed CCTV footage to assist in identification of the man. Advertisement The man and the child moved on to another hostel but ultimately returned to the original hostel and staff contacted gardaí. Gardaí arrived at the hostel and seized the man's phone where the images were discovered. The photographs had been taken on April 12th, 2018. Sentencing the man on Thursday Judge Martina Baxter said it was a monumental breach of trust where the man 'took complete advantage of a young person' and that he was the person in control. The reason given was 'self-serving and I'm satisfied it was for his own gratification' …'and that was exploitation,' said the judge. 'Some pathetic excuse was provided' saying she asked him to take pictures of her to send on to her boyfriend, Judge Baxter noted. Advertisement She set a headline sentence of three years. She noted there was a European Arrest Warrant and said gardaí were to be commended for their very thorough investigation. In mitigation she noted his plea, as the young person who is now 23 was unavailable to give evidence. She also noted he has engaged with the Probation Service and appeared to have genuine insight. Judge Baxter sentenced him to one year imprisonment and backdated it to February, for time spent in custody. Sgt Casey told Mr Griffin that a statement was taken from the teenage girl. She said she was originally from a different country. She lived with her mother and stepfather in Ireland. Advertisement The man was interviewed three times and admitted taking photographs of his stepdaughter while she was in the shower. He said he had been drunk at the time. He failed to appear for his trial date on November 9th, 2020, and had fled Ireland. He was later extradited back here and remanded in custody. The court heard that the relationship had ended with the child's mother and the child had stopped attending school when the relationship broke down. It was accepted that the photographs had been deleted by the man but retrieved by the gardaí. Counsel said her client had remorse and shame for his involvement and asked the court to accept that as the teenager is no longer reachable, his plea of guilty was valuable to the prosecution. Counsel asked the court to take into account that the images had been deleted, that it had been an isolated incident and that he had not distributed the images.
