KZN man sentenced to life for girlfriend's brutal murder

The Citizen3 days ago
The Vryheid Regional Court has sentenced a 51-year-old Mondlo man to life imprisonment for the brutal murder of his girlfriend, bringing justice in a case that sent shock waves through the local community.
According to Northern Natal News, Innocent Fanyane Dubazane was found guilty of killing 45-year-old Nonsikelelo Nqobile Xaba, whose body was discovered in a ditch in the C-section area of Mondlo on February 8, 2024. Xaba, who was well known in the community, was found wrapped in a duvet cover and shade netting. She had suffered severe blunt force trauma and was fully clothed but barefoot.
Although the couple had been in a romantic relationship, they had kept it hidden from their families. It later emerged that Xaba was last seen alive at Dubazane's home.
During police questioning, Dubazane made admissions that linked him to the murder. Investigators discovered the victim's blood-stained shoes hidden in a plastic bag in an outside toilet at Dubazane's home. Drag marks at the back of the house led to the spot where her body was found. Police confirmed that the duvet and netting used to conceal the body came from Dubazane's home and that of his brother, who shared the property.
The state, represented by prosecutor Andre Symington, presented compelling evidence from community witnesses, family members and police officers. Witnesses identified the victim's shoes and the duvet as belonging to her and the accused respectively. A relative also testified to having seen the couple together before the murder.
Symington highlighted the frequency of gender-based violence in South Africa during sentencing arguments, stressing that Dubazane showed no remorse and that the attack was both brutal and calculated.
The court found Dubazane and the deceased had been in a domestic relationship and ruled there were no compelling reasons to deviate from the minimum prescribed sentence for femicide. As a result, Dubazane was sentenced to life imprisonment and declared unfit to possess a firearm.
In response to the outcome, NPA regional spokesperson Natasha Ramkisson-Kara reaffirmed the organisation's commitment to fighting gender-based violence and femicide.
'There is no place in our society for perpetrators of such cruelty. We will continue to prioritise these cases and ensure that justice is delivered swiftly and decisively,' she said.
The sentence brings closure to a case that deeply affected the Mondlo community and stands as a strong warning to perpetrators of violence against women.

City Power condemns intimidation of technicians and suspends service in Kanana Ext. 4 and 5

City Power has strongly condemned what it called 'the growing incidents of threats, intimidation, and hostage situations' involving their technicians as they carry out critical repair and maintenance work across various areas. The power entity spokesperson Isaac Mangena said in recent weeks, the Midrand Service Delivery Centre (SDC) has experienced a worrying rise in such incidents. He said most notably, on July 11 community members from Kanana Extensions 4 and 5 stormed the Midrand SDC, blocked the gates for several hours, and disrupted operations by preventing technicians from attending to an outage in the area. Also read: City Power works around the clock to audit Mayibuye residents' meters 'Last night [July 10], City Power technicians responded to an outage in the area and discovered that the fault was linked to a problem on the overhead line, an issue that could only be safely addressed during the day. The task was then handed over to the day-shift team. However, while our teams were preparing to conduct the repairs and sourcing the necessary materials, community members blocked the gates and refused to let them leave the SDC,' said Mangena. He said this then further delayed the process of repair work in that area as well as in other areas. Mangena said on the same day, a team of electricians dispatched to Rabie Ridge were held hostage and threatened by residents, only being released after intervention from their Security Risk team. 'Two weeks ago, services to Mayibuye had to be suspended for nearly a week after technicians were similarly threatened and held hostage while attempting to conduct legitimate maintenance work in the area, including work to normalise the area by installing prepaid meters. Another incident occurred about three weeks ago in Klipfontein, where City Power technicians and a contractor were held hostage at a substation during a power outage,' added Mangena. Also read: City Power confirms power supply restoration in Mayibuye township He said due to these continued safety he risks, City Power has taken a decision to temporarily suspend services in Kanana Extensions 4 and 5, where technicians can no longer operate safely. 'We will continue to monitor the situation and will only resume work once it is safe to do so,' concluded Mangena. Life sentence for father convicted of raping his daughter

A father, who raped his daughter on her sixth birthday, was sentenced to life imprisonment by the Ladybrand Regional Court and his name has been permanently entered into the National Register for Sex Offenders. Image: Independent Newspapers Archives A father who raped his daughter on at least two occasions, one of which was on her sixth birthday, will serve a lifetime behind bars. The man, who tried to evade justice and accountability when he attempted to cover his reprehensible acts, was sentenced by the Ladybrand Regional Court and his name has been permanently entered into the National Register for Sex Offenders. This week, the National Prosecuting Authority (NPA) welcomed the sentence handed down to the 48-year-old man, who pleaded not guilty, maintaining his innocence throughout the trial. NPA spokesperson, Mojalefa Senokoatsane, said the sentence reflected the NPA's unwavering commitment to combating gender-based violence (GBV) and protecting vulnerable children from heinous acts of betrayal. Next Stay Close ✕ 'In 2020, the accused, entrusted with the care of his daughter, raped her on two separate occasions, with the first assault occurring on her sixth birthday, a day meant for celebration. The court heard harrowing details of the premeditated crime, during which the accused cleaned blood from the victim's private parts with an orange gauze bag to conceal his actions. 'In a further attempt to evade accountability, he opened a false criminal case against the victim's now-deceased stepfather, deflecting suspicion from himself. The abuse came to light through the victim's disclosure, supported by medical evidence confirming the assault, leading to the accused's arrest,' said Senokoatsane. The regional court prosecutor, Marie Yzel, presented compelling evidence, including the victim's testimony, medical reports, and a victim impact statement compiled with the assistance of a court preparation officer. 'The statement detailed the profound psychological trauma and lasting fear inflicted on the victim, now scarred by her father's betrayal. Yzel exposed the accused's calculated efforts to cover up the crime, including the false case against the stepfather, and highlighted his complete lack of remorse, which further aggravated the offence,' said Senokoatsane. In aggravation of sentence, Yzel argued that the accused's actions were malicious and premeditated, exploiting his role as a father to violate the victim's trust and dignity. Further to this, she emphasised the devastating impact of GBV within families, urging the court to impose the prescribed minimum sentence of life imprisonment under Section 51(1) of the Criminal Law Amendment Act. The presiding magistrate delivered a scathing rebuke, and said: 'A father's sacred duty is to protect, yet this accused turned predator, inflicting unspeakable harm on his child.' The NPA commended the extraordinary courage of the young victim, whose disclosure, supported by meticulous police work, secured this conviction. The Free State Director of Public Prosecutions, Advocate Navilla Somaru, praised Yzel and investigating officer Tshepo Olebile for their relentless dedication. 'This sentence sends a resolute message: the NPA will pursue predators who target children with the full might of the law, ensuring justice restores dignity.' The NPA's collaboration with Thuthuzela Care Centres (TCCs) provided critical psychosocial support to the victim, reflecting its victim-centric approach. The NPA urged families and communities to remain vigilant, report abuse promptly, and support survivors through TCCs, which offer medical, psychological, and legal assistance. 'This case underscores the devastating impact of familial GBV and the critical role of survivors' voices in achieving justice. The NPA calls on South Africans to unite against the scourge of GBV, fostering safe environments where children are protected, and their constitutional rights to dignity and privacy are upheld,' said Senokoatsane.

Middelburg court jails security guard for shooting municipal workers

Nqubeko Brian Mchunu (43) was yesterday sentenced in the Middelburg High Court for the 2022 shooting of municipal workers at the Steve Tshwete Local Municipality. According to Middelburg Observer, Mchunu was employed as a security guard by PPP Protection and Security, a company hired to protect municipal infrastructure during a spate of strikes that, at times, turned violent, with the assault of contractors and damage to vehicles. He was convicted of one count of murder for the shooting death of Tshepo Maseko and three counts of attempted murder in respect of Sarel Vilakazi, Harris Sithole and Sibusiso Thabang. Acting Judge GB Herman, in sentencing, said Mchunu had shown no remorse during the trial, insisting he only shot the victims to protect himself. He added that the lives of the victims would never be the same again and that those who lost a loved one would remain with only memories. Mchunu was sentenced to 25 years for murder. He received 14 years for three counts of attempted murder (seven years on each count). The sentences will run concurrently. He will serve 25 years' imprisonment. The court also declared him unfit to possess a firearm. Members of the South African Municipal Workers' Union and the victims said that although they were disappointed by the number of years Mchunu received, they were grateful he had been punished for his acts.
