JSW Steel-Bhushan Power & Steel Case: What's The Issue And Why It Matters?
The Supreme Court orders a status quo on the liquidation of Bhushan Power & Steel Ltd, halting NCLT proceedings, thus providing relief to JSW Steel.
In a major development that impacts India's corporate and insolvency landscape, the Supreme Court on May 26, 2025, ordered a status quo on the liquidation of Bhushan Power & Steel Ltd (BPSL), halting all further proceedings in the National Company Law Tribunal (NCLT). This case, involving JSW Steel, one of India's leading steelmakers, has been under the spotlight due to its size, legal complexity, and implications for the Insolvency and Bankruptcy Code (IBC).
Here's is everything what this case is about and why it's important:
What Is the JSW Steel-Bhushan Power Case?
Bhushan Power & Steel Ltd, a major player in India's steel sector, defaulted on large bank loans. In 2017, Punjab National Bank initiated insolvency proceedings under the IBC. JSW Steel, one of India's leading steel companies, submitted a Rs 19,700 crore resolution plan in 2019, which was approved by the Committee of Creditors (CoC) and the National Company Law Tribunal (NCLT).
JSW Steel completed the acquisition in March 2021 and began operating BPSL.
What Did the Supreme Court Say on May 2?
Four years after the acquisition, the Supreme Court on May 2, 2025, had scrapped JSW Steel's acquisition of BPSL, on the grounds that the resolution plan violated the Insolvency and Bankruptcy Code (IBC). This become a major issue within the industry as it indicated uncertainty in the IBC system despite after years of acquisition.
A bench of Justice Bela M Trivedi and Justice Satish Chandra Sharma ruled JSW Steel's resolution plan illegal and a 'flagrant violation" of the IBC, criticising the Resolution Professional, the Committee of Creditors (CoC), and the NCLT.
The apex court directed the NCLT to initiate liquidation proceedings while ensuring refunds of payments made to financial and operational creditors, along with JSW's equity contributions, within two months.
What Happened on May 26?
A separate Supreme Court bench comprising Justice BV Nagarathna and Justice Satish Chandra Sharma on May 26 ordered a status quo on all liquidation proceedings, following a petition by JSW Steel, thus giving respite to JSW Steel that faced uncertainty after the previous SC order.
JSW argued it still has time till June 2 to file a review petition. It informed the Supreme Court that it was considering filing a review under Article 137 and requested a pause on any NCLT move to start liquidation until all legal remedies were exhausted. JSW contended that the erstwhile promoters acted in haste and lacked locus standi.
The Court agreed that no irreversible steps should be taken during the review period.
Why It Matters?
The case is one of the landmark cases in the IBC proceedings. This case has become a major issue within the industry as it indicated uncertainty in Insolvency and Bankruptcy Code (IBC), even years after a resolution plan has been fully implemented. JSW Steel had acquired Bhushan Power & Steel following all necessary approvals, yet the Supreme Court's decision on May 2 to reject the resolution plan and order liquidation shook industry confidence. It raised concerns about the finality and enforceability of approved resolution plans, potentially discouraging future bidders and investors from participating in distressed asset deals under the IBC framework.
However, the latest May 26 Supreme Court judgment to maintain the status quo has boosted industry confidence.

Over Rs 11 lakh crore in loans disbursed to women self-help groups by banks: Minister
New Delhi: Loans worth over Rs 11 lakh crore have been disbursed to women self-help groups (SHGs) through formal financial institutions under the Deendayal Antyodaya Yojana–National Rural Livelihoods Mission (DAY-NRLM), Union Agriculture Minister Shivraj Singh Chouhan said on Wednesday. This milestone reflects the central government's strong commitment under the leadership of Prime Minister Narendra Modi towards inclusive rural development, financial empowerment of women, and fostering self-reliance at the village level, he added. Under the Ministry of Rural Development's DAY-NRLM, rural poor women across the country are strengthening their livelihoods through robust community institutions. Through SHGs, they are being provided collateral-free loans, interest subsidies, and other financial support, enabling them to start their own businesses and increase their incomes. A repayment rate of over 98 per cent clearly demonstrates the initiative's credibility, discipline, and efficient management, said Chouhan. Appreciating the banking community's support, Chouhan said that banking partners have played a remarkable role in turning the dreams of millions of rural women into reality. The tireless efforts of 'Bank Sakhis' have facilitated SHG-bank linkage and ensured timely loan repayment. He further said that the main contribution of this banking partnership is the provision of easy loans to SHGs under the priority sector lending, along with accessible banking services for SHG members through simplified processes. The initiative also promotes Aadhaar and mobile seeding of bank accounts and enhances financial literacy. The repayment systems are being strengthened in the country. 'Bank Sakhis' are increasingly assisting with transactions, loan applications, and documentations, as well as creating awareness about insurance, pensions, and other financial schemes. Moreover, the Community Based Repayment Mechanism (CBRM) is being fortified to ensure timely loan recovery under this significant programme. The central government initiatives like DAY-NRLM and 'Lakhpati Didi' are transforming the economic status of millions of women in rural India, he mentioned.

CBI books builders, bank officials in 22 FIRs for cheating buyers
In a major crackdown on builders accused of defrauding thousands of homebuyers in the National Capital Region (NCR), the Central Bureau of Investigation (CBI) has registered 22 FIRs against various real estate developers and unknown officials of financial institutions. According to a CBI statement, acting on the directions of the Supreme Court, the agency also conducted searches at 47 locations across Delhi, Gurugram, Noida, Greater Noida, and Ghaziabad, seizing incriminating documents and digital evidence. The Supreme Court's intervention came after numerous homebuyers approached it through special leave petitions (SLPs), highlighting how they were cheated by developers and then subjected to coercive recovery actions by financial institutions. The CBI further said that many complaints centred around the misuse of the 'subvention scheme' — a loan model in which builders took loans in the name of homebuyers and promised to pay EMIs until possession — promises that were often broken, leaving buyers saddled with debt and without homes. In April 2025, the Supreme Court observed a nexus between builders and financial institutions and directed the CBI to register seven preliminary enquiries (PEs). The CBI submitted its status report within three months after completing six PEs, upon which the court ordered registration of 22 regular cases. The builders and projects named in the FIRs include Supertech Ltd; AVJ Developers (AVJ Heights); Earthcon Universal Infratech (Casa Royale); Rudra Buildwell Projects (Rudra Palace Height); Geotech Promoters (Geotech Blessing); Shubhkamna Buildtech (Shubhkamna City and Advert Tech Homes); Bulland Buildtech (Bulland Elevates); Decent Buildwell (Shri Radha Aqua Gardens); Rudra Buildwell Construction (KBNOWS Apartments); Saha Infratech (Amadeus); Dream Procon (Victory Ace); Logix City Developers (Blossom Zest); Jaypee Infratech (Orchards); Sequel Buildcon (The Belvedere); Ajnara India (Ajnara Ambrosia); Vatika Ltd (Vatika Turning Point); CHD Developers (106 Golf-Avenue); Ninex Developers (Ninex City); Jaypee Sports International and Jaiprakash Associates (Kove and Kassia projects); Idea Builders (Red Apple Residency); and Manju J Homes India Ltd (Red Apple Homez). The FIRs allege that these developers, in connivance with unknown bank officials, created fake or fraudulent loan agreements and diverted buyer funds for personal gain, violating Reserve Bank of India norms and banking regulations. The CBI has said that investigations are ongoing to identify and prosecute all parties involved in the conspiracy. This court-monitored probe represents one of the most extensive enforcement actions against real estate fraud in the NCR and is expected to bring much-needed accountability to the housing sector.
