Mike Lee Shoves Another Bad Land Sale Provision into the Senate's Final Budget Bill

UPDATE: Facing overwhelming opposition from all Democrats and a growing number in his own party, Utah Republican Senator Mike Lee tonight withdrew his proposal to sell millions of acres of public land to help balance the federal budget.
Universally reviled legislation that will sell up to 1.25 million acres of BLM land around the West starting this fall has been placed in the Senate's final budget bill which will face floor votes as early as today.
Utah Sen. Mike Lee (R), chairman of the Senate Energy and Natural Resources Committee that oversees the Interior Department's budget, released new language Friday night that doubles down on his longstanding desire to reduce the federal estate, using veiled language that justifies land sales to alleviate housing shortages in fast-growing Western cities.
The bill's latest draft tightens problematic language of earlier versions that risked being flagged by the Senate parliamentarian as non-conforming for a reconciliation bill, say sources who reviewed Lee's draft late last night. But it contains the most unacceptable provisions to public-land advocates, and could open some of the West's most remote and cherished public lands for sale. Because it now includes unallocated mineral leases, it could also balloon the amount of land eligible for sale.
Specifically, the final draft expands the definition of eligible BLM land, which Lee says is designed to promote affordable housing and urban infrastructure, by prioritizing federal land sales within five miles of the border of 'population centers.' Instead of using the commonly accepted definition of a population center as a municipality of 2,500 or more people, the new draft defines a population center as 'a census-designated place or incorporated municipality with a population of not less than 1,000 persons.' This provision greatly expands the eligibility of BLM land that could be sold surrounding unincorporated rural communities.
Last night's draft also now allows leasing of some previously protected lands, omitting national preserves, national seashores, lakeshores, national historic sites, and national memorials and battlefields from the categories of land that could not be considered for sale. It includes unallocated subsurface mineral leasing as a qualifying covenant for land sales, along with earlier drafts that omit active surface uses and BLM land with active livestock-grazing leases from sale consideration.
This allowance of unsubscribed mineral rights could greatly increase the number of eligible acres for sale to something over 3 million, say sources. That's because the BLM administers subsurface mineral rights on some 700 million onshore and offshore acres. If millions of those acres now qualify for sale because of Lee's new language 'we could be talking about the sale of way more than 1.25 million acres,' says a land-use expert who was still researching the question as of this morning. 'We could be talking 3 million and more, depending on the answer to the question of whether the BLM owns those rights or simply administers them.'
Lee's latest draft also changes the definition of who can bid on this 'surplused' public land. Nominations for tracts can come from what Lee defines as 'qualified bidders.' That term is not defined in the bill.
The bill extends the mandatory sale deadline from five to 10 years and increases the amount of federal money that will be used to execute these sales from $5 million to $15 million.
But what's especially galling to critics of the bill, who note the many loopholes that allow disposal of federal land for purposes other than affordable housing, is that the new draft adds criteria for disposal of our most valuable lands to include a mechanism for consolidating large ranches and for including 'isolated tracts that are difficult to manage.' That last provision could list for sale some of the most valuable hunting and fishing acreage in the West.
Sources noted, with rising alarm, that Lee's latest draft appears to be calibrated to make it through Senate parliamentary scrutiny.
'This appears to be an effort to try and survive parliamentarian review,' says David Willms, associate vice president for public lands for the National Wildlife Federation. 'Adding a priority of selling the highest value lands, and including subsurface rights along with the surface rights seems to be an effort to sell the provision as one with primarily budget impacts, which is necessary to survive the Byrd Rule' that requires items in reconciliation bills to have budgetary, rather than policy, implications.
'Obviously, to anyone that cares about public lands, however, that's simply a smokescreen to sell an area more than twice the size of Rocky Mountain National Park to an as-yet-undefined 'qualified bidder,'' says Willms. 'But it's also an indication of the sloppy and haphazard nature of this latest bill.'
Lee's new draft is so contrary to and tone-deaf to the hundreds of thousands of calls, letters, and emails to congressional offices over the past week that some critics of the bill suggest that it's designed to fail in full Senate voting that starts today. In an Instagram reel, New Mexico Sen. Martin Heinrich (D) noted that the groundswell of calls to congressional offices is the 'broadest and deepest coalition that I have ever seen for public lands in my life. Keep it up. We are winning.'

Fellow Republican Senators, including Montana's Steve Daines and Tim Sheehy and Idaho's Mike Crapo and Jim Risch, have publicly stated their opposition to the bill. The news site NOTUS yesterday reported that Daines has the votes to kill Lee's draft in the budget reconciliation process. That's the expedited process that requires only a simple majority in both the House and Senate for passage. Republicans hold a 3-vote majority in both chambers.
At least five Republicans in the House of Representatives have said they won't vote for any version of the budget bill that contains the land-sale provision. They include Montana's Ryan Zinke, Mike Simpson from Idaho, Dan Newhouse from Washington, Oregon's Cliff Bentz, and David Valadao from California — all Westerners with large public-land holdings in their congressional districts.
'At the end of the day, I would bet on this [bill language] getting kicked out, but it's gonna be a slog,' says a public-land advocate who asked not to be named as they were still reviewing the bill draft. 'I'm still wondering if, in the long run, Lee is doing more to help public lands, by inspiring so much advocacy, than to hurt them.'
Land Tawney, whose group American Hunters and Anglers has been a vocal opponent of the land-sale legislation, says the latest draft confirms Lee's inability to read the national mood.

'Regardless of how Mike Lee polishes his public lands sell off proposal, it's still a piece of shit,' says Tawney. 'Not a square inch of our public lands should be used to pay off tax breaks for billionaires.'

DALLAS — Former Texas congressman Colin Allred launched another run for the U.S. Senate on Tuesday after the Democrat's challenge against Republican Sen. Ted Cruz last year broke records for spending but did not deliver his party the breakthrough it has sought for decades in the state. This time, Allred is seeking the seat of Republican Sen. But his campaign drew criticism early on from some Democrats who grew restless with Allred's strategy of not packing his schedule with raucous rallies or investing more in smaller corners of Texas, including cities along the border with Mexico. In the end, Texas Democrats' streak of losses in statewide races continued while Republicans kept making gains along the predominately Hispanic border with Mexico, which had long been a Democratic stronghold. Allred played four seasons in the NFL, all with the Tennessee Titans, after being undrafted out of Baylor University. He entered Congress after flipping a Republican district in Dallas in 2018. Former astronaut Terry Virts also entered the U.S. Senate race as a Democratic candidate. Looming over the GOP primary between Cornyn and Paxton is whether and when President Donald Trump will make an endorsement. In April, Trump praised both candidates and said he would make a decision later.

Drivers hitting the road this Fourth of July weekend won't need to break the bank to fill up at the gas pump. Gas prices are expected to average between $3.10 and $3.15 per gallon nationally this Fourth of July, according to GasBuddy, which tracks fuel prices. That's down sharply from $3.49 per gallon last year and would represent the cheapest gas for the summer holiday since at least 2021. If the national average drops below $3.12 per gallon, it would be the lowest Fourth of July price for gas since 2020 during the height of the Covid-19 pandemic, according to GasBuddy. Muted gas prices represent one of the biggest bright spots in the US economy, which has suffered from softer consumer spending and vast uncertainty caused by the global trade war. Last month's Israel-Iran conflict interrupted the trend of cheaper gas prices – but only briefly. Oil prices skyrocketed after Israel and then the United States launched attacks on Iran, fanning fears of a regional war that could derail the region's vital energy supplies. Gasoline prices started climbing sharply, threatening to make Fourth of July a much more expensive time to travel by car. But energy prices have since tumbled as Israel and Iran reached a ceasefire, reducing the risk of a disastrous disruption in the flow of oil out of the Strait of Hormuz. US crude oil settled at $65.11 a barrel on Monday – down sharply from an intraday peak of $79 on June 22. 'The pendulum swung very rapidly,' said Patrick De Haan, GasBuddy's head of petroleum analysis. That's very good news for the many Americans set to travel this holiday weekend. According to AAA, a record-setting 61.6 million people are expected to travel by car this Fourth of July weekend. That's up by 2.2%, or 1.3 million people, compared with last year. Based on the current forecast, Americans are expected to spend about $500 million less on fuel than last Fourth of July, according to GasBuddy. Gas looks even cheaper from an inflation-adjusted basis. Americans are making significantly more money, on average, than they did in 2021 or 2020. That means filling up at the pump is swallowing up a smaller and smaller chunk of paychecks. Consider that inflation-adjusted gasoline prices averaged $3.68 per gallon in June 2021 and $5.43 in June 2022, according to the US Energy Information Administration. That's well above today's prices of around $3.15 to $3.20 a gallon. Drivers in some US states are enjoying significantly cheaper gas prices compared with last year, including Ohio (56 cents cheaper), Florida (43 cents), Kentucky (42 cents) and Michigan (42 cents), according to AAA. As always, there's a risk that gas prices could start climbing again if something else goes wrong in the Middle East, US refineries suffer outages or hurricanes season interrupts energy supplies. But short of that, analysts say the outlook remains favorable to drivers this summer when it comes to gas prices. Not only have Israel-Iran fears eased, but OPEC continues to aggressively add more supply, and US oil production remains near record highs. That's why GasBuddy says it's possible gas prices will slip below $3 per gallon nationally by Labor Day weekend. 'There's limited ability for gas prices to rise above last summer's levels. All in all, it's not a bad time to hit the road,' De Haan said.

What to expect from New York City's ranked-choice vote results

Democratic mayoral candidate Zohran Mamdani could clinch victory Tuesday when the New York City Board of Elections releases the first look at the ranked-choice voting results from the June 24 primary. The board's report will also provide more data on how primary voters viewed Mamdani's candidacy after a week of conversations about what his performance means for the party and the city. Under the city's ranked-choice voting rules, if no candidate wins a majority of the first-choice votes, the race is decided by how voters ranked other candidates on their ballots. Mamdani, a 33-year-old state assemblyman and democratic socialist, emerged on Election Night with 43.5% of the first-choice votes and a significant lead over former Gov. Andrew Cuomo. The results Tuesday made clear that Mamdani would be heavily favored to cross 50% once ranked-choice tabulation was complete. Mamdani had a cross-endorsement with the only other candidate who won more than 10% of the vote, city Comptroller Brad Lander. And much of the rest of the field had encouraged voters to leave Cuomo off their ballots entirely. Cuomo saw that writing on the wall and conceded the race on Election Night (although he will still be included in today's results). The New York City Board of Elections will release a full, but unofficial, look at the ranked-choice tabulation based on all the ballots processed so far. In the ranked-choice voting process the city is using, the results are tabulated in rounds with the candidate with the fewest votes being eliminated and people who ranked that candidate first having votes reallocated to their next-highest choice still in the running. That process continues until only two candidates are left and there's a winner. Election officials will run that tabulation on the more than 990,000 ballots the city released last Tuesday, plus any additional ballots processed since then (mail ballots that arrived after Friday weren't included in the Election Night report). However, these results won't be final. There will still be a small number of ballots added to the count between now and when the board certifies the election on July 15. While these ballots could shift the order in which lower-rated candidates are eliminated, it's highly unlikely they'll have any impact on the final results. There's very little reason to think the results won't show Mamdani beating Cuomo in the final round. About 20% of voters ranked someone other than Mamdani or Cuomo first. Without accounting for the additional ballots that will be added to the count, that means that for Mamdani to win, he needs to be ranked ahead of Cuomo on only about one-third of ballots for that went for other candidates in the first round. Realistically, an even smaller number would secure his victory since a sizable number of votes will drop out of the calculation as voters' top choices are eliminated, reducing the number of votes required to win a majority. Because of these 'exhausted' ballots, Mamdani's percentage of the vote in the final round will be higher than it is now, even before accounting for other voters who had ranked him lower on their ballots. All that being said, it's theoretically possible Cuomo wins. Until the board releases the results, there's no way to know for certain how that 20% of the vote breaks down. The ranked-choice system will give a rare peek at how voters who supported lower-ranking candidates feel about their likely nominee. If a large share of those 20% ranked Mamdani ahead of Cuomo, it could demonstrate Mamdani's ability to expand his coalition beyond his core supporters. On the other hand, if many voters are more supportive of Cuomo or left both men of their ballots, it could indicate wider uncertainty about the progressive candidate.
