Can jury-less trials save our justice system?

It's hard to establish quite where the legal maxim 'justice delayed is justice denied' comes from. The Justice Secretary, Shabana Mahmood, likes saying it, as did her predecessor, Alex Chalk, and his predecessor-but-one, Brandon Lewis. It's often attributed to William Gladstone, but the notion that the timely conclusion of a legal issue is fundamental to a functioning justice system pre-dates the Victorian prime minister by hundreds of years. One such variation can even be found in the Magna Carta: 'To no one will we sell, to no one deny or delay right or justice.'
Echoing the sentiment is the retired judge Brian Leveson, who is chairing the government's review into a broken courts system. Leveson recently warned that radical reform is required to tackle a backlog of almost 80,000 cases that is causing trials for serious criminal offences to be postponed until as late as 2029. Picking up on a theme trailed in recent months by the justice minister, Sarah Sackman, one of the review's key recommendations will be to scale back a pillar of the legal system also enshrined in the Magna Carta: the right to a trial by jury.
There is precedent. Less serious 'summary offences' such as driving violations and minor assaults are already heard not by 12 of a defendant's peers but by a panel, including a district judge and two magistrates (who are unpaid and do not require legal qualifications). Serious offences, such as murder or rape, can only be heard by a Crown court with a jury. In the middle sit offences – burglary, drug possession, fraud – where the defendant can choose where they would like their case to be heard. Leveson's proposal is to restrict these defendants' right to a jury, setting up an intermediate court to hear some of these 'either way' cases. 'There's no choice. We cannot carry on with the present system,' he told the Observer. 'Justice delayed is justice denied.'
The disintegration of the justice system is one of the most underexamined crises of the past decade. In December 2019, before reports of coronavirus hit the headlines, the Crown court backlog was more than 37,400, and it already took more than a year for the most serious cases to come to trial. Then, in the early months of the pandemic, hearings were suspended completely. This came after a decade in which the Ministry of Justice became a poster department for austerity, its budget slashed and a third of court buildings sold off between 2010 and 2019 in the name of economy.
The money received into government coffers in return was pitiful: the sale of 126 courts yielded just £34m. Several of these buildings subsequently became film sets for legal dramas. In January 2021, when the court backlog was more than 54,000 and so-called Nightingale courts were being hurriedly set up to deal with it, Blackfriars Crown Court was filled not with judges, defendants and legal personnel, but with Netflix producers shooting the crime thriller Top Boy. Her Majesty's Court & Tribunal Service even inquired about hiring the building it had once owned to hear actual cases, rather than fictional ones.
The consequences of this catastrophe are lives put on hold: defendants losing jobs and relationships as they await the chance to clear their name; victims trapped in limbo, unable to process their trauma. As trials are listed far in the future, witnesses withdraw and cases collapse, enabling dangerous perpetrators to walk free and reoffend. The witness attrition rate for rape and sexual assault is particularly dire, with 325 out of 4,317 prosecutions derailed last year – a fivefold increase since 2019.
This national scandal should be a source of shame for the Tories – but no one wants to relitigate the Covid era now, any more than they want to look too hard at whose decision it was to scale back access to justice, as though fewer courthouses would lead to a decline in crime. It is the job of Mahmood to mitigate the damage inflicted by the likes of Chris Grayling.

And so jury trials, which cost ten times that of magistrate hearings, are in the firing line. Replacing them with a judge will not be an easy case to make (not least as there is a 300,000-case backlog in magistrates courts too). Back in June 2020 when I interviewed legal professionals about the impact of the pandemic, one leading barrister warned that the 'jury trial has a Magna Carterish Brexity resonance to it that brings liberals and traditionalists together; restricting it would be picking a fight with Keir Starmer and Jacob Rees-Mogg at the same time'. Five years and a doubled courts backlog later, expect the backlash to Leveson's proposals to be furious. There will be much railing about 'two-tier justice' – a favourite phrase of the shadow justice secretary, Robert Jenrick. It will be interpreted as yet another Labour betrayal, a sign of this country's decline, the hacking away at public services to save cash.
The government will be hoping that radical reform can speed up cases and thus restore faith in a system that is failing everyone except criminals. The status quo is both unjust and unjustifiable, and the idea of trading the right to a jury for swifter trials has been backed by many legal specialists, among them five former lord chancellors (several of them Tories) and two former lord chief justices. But the public may not be so easily convinced. The risk is that, with confidence already damaged by years of deterioration, this creates the perception of justice on the cheap, removing a right etched into the British consciousness by centuries of tradition and cemented there by legal dramas filmed in the very courthouses we sold off.

Who would have thought that a generation after the collapse of communism, freedom of speech would become controversial? Surely we had definitively settled this question of whether governments should prohibit or limit the expression of opinions. The Free World, as it was then known, had won the argument without even having to take up arms. Those peoples who had been subjected to the official suppression of ideas and information had repudiated that tyranny of their own accord. In East Germany, they simply walked out from under it. In Soviet Russia, Gorbachev's attempt at a more open, liberalised regime ended in ignominious collapse because a little bit of freedom just increased the longing for more. So surely there can be no doubt: liberty of thought and expression is what modern peoples demand. Yet here we are. A democratically elected government in a nation which gave the world Magna Carta has apparently installed a dedicated bureau to monitor all opinions put forward in public discourse. Further, it proposes legislation which would compel any forum that gave a platform to opinions considered to be unacceptable, to remove them. This is, prima facie, outrageous: a betrayal not only of the historic principles of open democracy but of the victories of freedom over totalitarianism that marked the last century. So how on earth could anyone – any political party or governing class – in the Western world possibly think that such a move was necessary or desirable? It would be easy (indeed it is easy) simply to condemn it as the arrogant imposition of what a smug elite considers the limits of morally acceptable opinion. Any statement or assertion that appears to be encouraging or condoning racism, or even prejudice against an approved social minority, must be policed out of existence. It is scarcely necessary to warn where this policy could lead – or what it implies about the attitude of the current Government to its own population. But perhaps this is a more complex and confusing situation than it appears and paradoxically, some of the factors that contribute to it may be the result of precisely the ideological successes of which the West is most proud. What is it exactly that has produced this panic over unlimited public expression? It is the unbridled, unchecked and irresponsible dissemination of supposed 'information', or opinions based on deliberately deceptive information, on publicly accessible platforms often augmented by fake videos, AI doctored photographs and false 'evidence'. This is a new thing for which traditional democratic societies have no previous experience. We have become aware quite suddenly of the possible consequences in terms of civil disorder and mortal risk that the dissemination of such material can produce – and that it now spreads remarkably, and terrifyingly, quickly. Suspicion, distrust and their anarchic effects can be ignited and propelled at a speed that those responsible for keeping order in the streets have not previously encountered. So yes, as you will have gathered, I do believe that the rise of social media – which has no enforced codes of practice or legal liability – is presenting civil authority with an unprecedented set of problems. That observation, of course, is not original. It is, in fact, the official justification used by the government for its repressive measures. The added element in this toxic mix which has received less attention is the use that these media serve in the infiltration by professional activists of any convenient social cause. As a youthful Trotskyite, I was tutored in the techniques of exploiting any social discontent as a force for undermining trust in capitalism and what was considered to be the sham of democratic freedom. At the end of every meeting of what was then called International Socialism (IS), now known as the Socialist Workers Party, a list was recited of the latest venues at which we were expected to appear, brandishing pre-printed posters and demonstrating solidarity with whatever protest group was currently disrupting the functions of an industry, government department or public agency. When I see all those disparate agitator groups now, whether they are demonstrating on behalf of the environment or against racism – carrying identical placards (generally with the words 'Socialist Workers Party' emblazoned at the top), I can guess what instructions they have been given. Make as much noise and monopolise as much of the television news coverage as you possibly can. Try to make the story about you and your message, even if you have been bussed in to compete with a genuine spontaneous protest over a local issue. I thought of this again when the police got into big trouble for apparently offering protection to, or even escorting, 'Stand Up to Racism' counter protestors at the site of a migrant hotel demonstration. Their presence appeared to be endorsed by the police who seemed to be shielding them from the anger of unworthy locals. But what should be done if, say, an anti-racist group's planned arrival makes it necessary for the police to prevent any potential violent confrontation and breakdown of public order? That would be, in my experience, a classic professional activists' technique. They would exploit the fact that it is the first responsibility of the police to maintain order in the streets whatever the issue. The ultimate irony may be that this phenomenon has been given extra propulsion by the collapse of communism. Back in the dark days of the Cold War, infiltration by the Left was a serious business run by serious people. The Communist party loathed what they considered to be juvenile, undisciplined Trotskyist messing around. My friends and I were regularly warned that our indiscriminate, ill-thought out negativism was going to discredit the sacred Marxist cause. While IS (now the SWP) handed out copies of the Socialist Worker newspaper on street corners, the Communist Party members maintained their terrifying diligence, their 'cover' identities and their dedicated take over of trade unions and nuclear disarmament campaigns. That's all gone now. Anti-capitalism in its most inchoate, incoherent and irresponsible form is running the show and it is making use of all the opportunities modern technology offers to spread dangerous lies and inflammatory messages. There is no easy answer to this.

The consultation on the proposal has ended with nearly 80% of the 225 responders saying they strongly agreed the prison should become A-listed. Historic Environment Scotland (HES) launched the bid in December last year to preserve parts of the Victorian building with potential plans to create a museum or tourist attraction. Glasgow responds (Image: Newsquest) Dara Parsons, head of designations at HES, said at the time: "Listing is a way of ensuring that the importance of Scotland's most historically, culturally and architecturally significant buildings is taken into account in decisions about their future." An overwhelming majority of the responses were in favour of the proposal, mostly citing how integral the jail is to Glasgow. David Docherty said: "The site of Barlinnie plays an important part in Glasgow and its history. The buildings should be protected as they are of a high standard of workmanship from a very long time ago. "I am a stonemason and I appreciate the work that these men gave. It speaks volumes that they still stand the test of time and are still used today." Dr Edward Stewart added: "I think Barlinnie represents an important monument in Glasgow's social history, representing both the city's at times infamous connection to criminal gangs which formed an important aspect of youth culture both in the 1930s, and 60-90s. "Many Glaswegians will have connections to this monument as a notorious prison looming over the east end of the city used to warn children of the dangers of Ill behaviour and a smaller number will have experienced the prison as inmates or visitors (as I have)." Andrew Kelly responded: "Barlinnie is an iconic building for Glasgow and recognised Scotland-wide, we need to retain the buildings considered for listing. "There is much potential to create an experience unique to Scotland, which could incorporate museums, hostels, workspaces, studios, film and TV sets." What else are we going to do with a knackered old prison? Listing the building will just create an expensive albatross around society's neck." Others also called it a waste of money and said housing should be built on the empty land instead. Amongst them was the Scottish Prison Service, who argued the listing "would seriously restrict any future use of the site of HMP Barlinnie and limit the positive legacy the regeneration of the site could have for the local community and the city". Glasgow City Council said: "While the site is of architectural, social and historic interest, the Council questions whether Category A listing of the stated extent of buildings and structures is proportionate, particularly when balanced against the practical implications for redevelopment and reuse of the site."

Joint FAIs to be held into drowning deaths of schoolboy and man in River Tay

A joint inquiry is to be held into separate fatal water incidents involving a schoolboy and a man five years apart in the River Tay. A Fatal Accident Inquiry (FAI) will be held into the deaths of Kayden Walker, 12, from Glasgow, and Ruaridh Stevenson, 39, from Cupar. Kayden, from Bridgeton, died in the river after getting into difficulty while boogie boarding with a youth group at Stanley, north of Perth. The 12-year-old became separated from his board during the activity and was trapped on the upstream side of a weir while on a day trip with the Church House community group. The schoolboy, whose activity consent form stated that he was unable to swim ten metres without the assistance of a flotation device, was the last child to go over the weir between two Church House employees. After it was noticed the schoolboy's board had resurfaced, an instructor from Outdoor Pursuits Scotland went to the top of the weir and reached into the water to locate the missing 12-year-old. He discovered Kayden at an arm's length under the water's surface, but was unable to pull him out. After around three and a half minutes he eventually managed to free him but the force of the water carried Kayden down the weir where the company's director caught him and immediately started to perform CPR. Kayden was airlifted to Ninewells Hospital, Dundee, before he was transported to Glasgow's Royal Hospital for Children. He died the following day on July 29, 2019. Perth and Kinross Council launched an investigation following the death and found that the company's risk assessment for river boarding did not have adequate health and safety control measures in place. A further inquiry carried out by the Crown included taking opinion from a water activities expert. The expert's view was that the company should have always had one instructor directly below and one instructor in a kayak above the weir until all the group members had successfully negotiated the rapid. The FAI's announcement comes after Outdoor Pursuits Scotland Ltd pleaded guilty to breaching health and safety legislation at Perth Sheriff Court on October 21, 2024, and was fined £10,000. It will also investigate the death of Ruaridh Stevenson, 39, who drowned after attempting to assist a client who experienced difficulties in the waters flowing through Dollar Glen, Stirlingshire on April 13, 2024. Mr Stevenson was a director of a company which offered 'canyoning' experiences on Scottish rivers. The inquiry into Stevenson's death is mandatory because it happened during working hours, while the Crown said it was voluntarily holding an FAI into Kayden's death. A preliminary hearing has been set for September 2, 2025, at Falkirk Sheriff Court. The purpose of a Fatal Accident Inquiry (FAI) includes determining the cause of death; the circumstances in which the deaths occurred, and to establish what, if any, reasonable precautions could have been taken, and could be implemented in the future, to minimise the risk of future deaths in similar circumstances. Procurator Fiscal Andy Shanks, who leads on fatalities investigations for COPFS, said: 'The Lord Advocate considers that the deaths of Ruaridh Stevenson and Kayden Walker occurred in similar circumstances, both deaths occurring while they were engaged in water based outdoor activities. 'The lodging of the First Notice enables FAI proceedings to commence under the direction of the Sheriff. The families of Ruaridh and Kayden will continue to be kept informed of significant developments as court proceedings progress.'
