IGP granted leave to initiate committal proceedings against Papagomo again

KUALA LUMPUR: The High Court today granted Inspector-General of Police Tan Sri Razarudin Husain leave to initiate committal proceedings for a second time against blogger Wan Muhammad Azri Wan Deris over his allegedly "insincere" apology.
Judicial Commissioner Gan Techiong granted the leave after hearing submissions on Razarudin's application to initiate committal proceedings against Wan Azr i, also known as Papagomo, for breaching the terms of the apology previously ordered by the High Court.
Earlier, the court was told that Wan Azri's apology to Razarudin was described as insincere and a joke.
Razarudin's lawyer, Raam Kumar, said Azri had uploaded the apology to his social media accounts on 30 April, using Maafkan Kami, a song by the late Tan Sri P.Ramlee from the classic film Pendekar Bujang Lapok, as background music.
"The apology is a joke. Why do we say this? This is a court order. There must be solemnity. You must be serious.
"The apology was not re-read, not in still (image) and not done in good faith.
"There is no solemnity at all. This is a court matter, not some joke where you play music.
"The unconditional apology is not sincere and he had not purged his contempt," Raam said.
Raam also said Wan Azri had also committed contempt of court by uploading
videos on his YouTube and TikTok accounts explaining his apology in court.
"The apology is unconditional, which means the defendant (Wan Azri) cannot make excuses for his apology.
"He is supposed to apologise with no conditions attached and he should just keep quiet. Rather than that, he published the videos.
"He had said he did not apologise to the IGP, but to the court. He is not acknowledging at all that he has an issue with the IGP, but he is fighting with the court.
"In other words, he is not acknowledging at all his contemptuous action against the plaintiff (Razarudin).
"He had also said he apologised because he did not want to be jailed. But nowhere in our affidavit or submission we askedfor him to be jailed in Sungai Buloh Prison.
"It is mere insertion as we asked only for committal. The issue of the plaintiff wanting to send him to prison did not arise. This is a made up story," he said.
Lawyer Muhammad Rafique Rashid Ali said they had sent a letter to Raam's firm, stating that they published the apologies on YouTube, TikTok, X and Telegram; and had removed the Jan 14 and 15 defamatory statements.
"The court should take judicial notice that not only was the apology tendered in open court, not only was the apology put up in social media and remaining now, it has been vastly reported by the mainstream media, which confirmed Wan Azri apologised to the IGP," he said.
Gan had also questioned Azri's action, saying that the matter should have been over when the first committal proceedings ended.
"Why did he not let the matter rest? Why did he publish that video, which is quite negative?" he said.
After hearing the submissions, Gan said, "I am of the mind to grant leave for this application."
The court set 30 June for the inter partes hearing.

REUTERS/Yurii Kovalenko KYIV (Reuters) -Ukraine's top anti-corruption investigator said on Friday that he did not expect attempts to derail his agency's work to end, despite an abrupt U-turn by President Volodymyr Zelenskiy on curbing their independence that fuelled rare wartime protests. Semen Kryvonos, director of the National Anti-Corruption Bureau of Ukraine (NABU), said he was taken aback by attempts this week to curtail his agency's fight against graft but did not name those who may have been behind the legislation. "Everyone united around the idea of ruining our independence," Kryvonos told Reuters in an interview in Kyiv, referring to parliament passing the controversial measures. "This was a shock for me - how much demand had built up to destroy us." He spoke a day after Zelenskiy sought to defuse tensions by submitting legislation restoring the independence of NABU and its sister agency, the Specialised Anti-Corruption Prosecutor's Office (SAPO). Thousands of protesters took part in protests in Kyiv and other Ukrainian cities this week after lawmakers fast-tracked a bill granting a Zelenskiy-appointed general prosecutor power over the two bodies. The move had also threatened Kyiv's ties with the European Union and Western donors which have been a critical source of financial and military support during Russia's war in Ukraine. Kryvonos applauded Zelenskiy's reversal, but said NABU and SAPO remain a high-priority target for vested interests aiming to stymie their closely watched efforts to clean up. Parliament will consider Zelenskiy's new bill in a special session next week. But Kryvonos worries corrupt actors will step up a "dirty information campaign" already being waged against NABU on widely read anonymous Telegram channels, casting the agency as slow or ineffective. He did not identify the exact sources of resistance to his agency's work, saying only that they are "various representatives of the government, various financial groups". "Everyone who is offended by NABU and SAPO will be pushing out this message," Kryvonos said. 'SYSTEMIC WORK' AND THREATS Since Russia's February 2022 invasion, Ukraine has stepped up a campaign to eradicate the pervasive graft that has plagued its political culture for decades. Stamping out corruption is both critical to Kyiv's bid to join the EU and its effort to erase a legacy of autocracy and Russian rule. NABU and SAPO, launched with Western support after a 2014 revolution toppled a pro-Russian president, have levelled charges against lawmakers and senior government officials. In recent months, Kryvonos's agency has uncovered huge real estate schemes in the capital Kyiv and accused a then deputy prime minister of taking a $345,000 kickback. Kryvonos suggested such efforts had led to a sweeping crackdown this week that paved the way for the rollback of NABU's and SAPO's powers. Two NABU officials were arrested for suspected ties to Russia and nearly 20 other agency employees searched over lesser alleged infractions in a campaign critics said went too far. "All of this was a result of systemic work by NABU and SAPO, especially over the past half-year," he said, adding that he had also received "a huge amount" of threats. Despite winning a hard-fought victory this week, he said resistance was still widespread enough across the political landscape to pose a serious challenge. He cited the controversial law that had been supported by most of Zelenskiy's political party as well as opposition lawmakers and those associated with former pro-Russian factions. The customer in question had initially made a complaint about the service at one of the bubble tea brand's outlets in the capital. Tealive said that in line with its standard process, the case was handed over to the area manager responsible for the outlet to reach out to the customer and take the appropriate action. It said a screenshot of the feedback containing the customer's contact information was inadvertently shared with the outlet team, leading a staff member to reach out to the customer directly. 'Such conduct is a violation of our standard operating procedures and does not reflect the values we uphold as a brand,' it said in a statement. 'Although we have contacted the affected customer privately, we would also like to take this opportunity to publicly express our sincere apologies. 'Despite this being an isolated case, we sincerely regret what has transpired. Rest assured, we are dedicated to protecting our customers' personal data, to be in full compliance with applicable laws and regulations.' In a video posted on Instagram yesterday, the customer alleged that the outlet staff did not follow proper SOPs regarding hygiene and took too long to prepare his order, despite several employees chatting and using their mobile phones. He claimed a woman he did not know reached out to him via WhatsApp about the complaint to defend the staffs' behaviour, and was hostile to him in the conversation. 'How is Tealive headquarters carrying out their job and leaking information of customers who complain in this manner? And who is this woman?' he said. Tealive said a thorough inquiry would be conducted and the appropriate disciplinary action taken against the staff involved.
