Asyraf serves RM1mil legal notice on Papagomo over alleged slander
KUALA LUMPUR: Mara chairman Datuk Dr Asyraf Wajdi Dusuki today served a letter of demand on Wan Muhammad Azri, better known as Papagomo, over allegations that he had abused his power and misappropriated agency funds. In a Facebook post, Asyraf said the notice was delivered by his lawyer to Wan Azri at his residence at 2.15pm today. "Enough of the culture of hateful politics and baseless slander. We must instil a sense of responsibility for one's words and actions. "Even if one has no fear of consequences in this world, may there still be some fear of Allah's punishment for spreading lies. "See you in court!" he wrote in the post. Earlier, Asyraf, who is also Umno secretary-general, had announced in a video post that he would be filing a RM1 million lawsuit against Wan Azri for defamation. He also refuted claims that he had awarded Mara food supply contracts and other projects to UMNO division leaders, or used agency funds for the recent sacrificial slaughter in Gerik in conjunction with Aidiladha. He said that not a single sen of Mara money was used for the religious ritual. "Instead, many individuals came forward to donate as a charitable act for the people of Gerik. One of the sacrificial cows was my personal contribution to the local Mara office," he said.

Court to decide on blogger's sedition case on Sept 24

(Bernama pic) KUALA LUMPUR : The sessions court has fixed Sept 24 to deliver its decision in the sedition trial of blogger Wan Azri Wan Deris, also known as Papagomo, over a statement involving the Yang di-Pertuan Agong. Wan Azri's lawyer, Rafique Rashid Ali, said the court fixed the date on Tuesday after the prosecution closed its case. Seven witnesses were called to testify. Wan Azri, 41, is accused of making the statement in a post on X, under the account sir_azri, at a condominium in Bukit Bintang at 12pm on April 29. If convicted under the Sedition Act, he faces a maximum fine of RM5,000, up to three years in prison, or both. The court is also expected to rule on July 9 in a separate sedition case involving Wan Azri. In that case, he is accused of claiming in a Facebook video on Nov 8, 2023 that the government is 'pro-Israel and pro-Western nations'.

IGP granted leave to initiate committal proceedings against Papagomo again
KUALA LUMPUR: The High Court today granted Inspector-General of Police Tan Sri Razarudin Husain leave to initiate committal proceedings for a second time against blogger Wan Muhammad Azri Wan Deris over his allegedly "insincere" apology. Judicial Commissioner Gan Techiong granted the leave after hearing submissions on Razarudin's application to initiate committal proceedings against Wan Azr i, also known as Papagomo, for breaching the terms of the apology previously ordered by the High Court. Earlier, the court was told that Wan Azri's apology to Razarudin was described as insincere and a joke. Razarudin's lawyer, Raam Kumar, said Azri had uploaded the apology to his social media accounts on 30 April, using Maafkan Kami, a song by the late Tan Sri from the classic film Pendekar Bujang Lapok, as background music. "The apology is a joke. Why do we say this? This is a court order. There must be solemnity. You must be serious. "The apology was not re-read, not in still (image) and not done in good faith. "There is no solemnity at all. This is a court matter, not some joke where you play music. "The unconditional apology is not sincere and he had not purged his contempt," Raam said. Raam also said Wan Azri had also committed contempt of court by uploading videos on his YouTube and TikTok accounts explaining his apology in court. "The apology is unconditional, which means the defendant (Wan Azri) cannot make excuses for his apology. "He is supposed to apologise with no conditions attached and he should just keep quiet. Rather than that, he published the videos. "He had said he did not apologise to the IGP, but to the court. He is not acknowledging at all that he has an issue with the IGP, but he is fighting with the court. "In other words, he is not acknowledging at all his contemptuous action against the plaintiff (Razarudin). "He had also said he apologised because he did not want to be jailed. But nowhere in our affidavit or submission we askedfor him to be jailed in Sungai Buloh Prison. "It is mere insertion as we asked only for committal. The issue of the plaintiff wanting to send him to prison did not arise. This is a made up story," he said. Lawyer Muhammad Rafique Rashid Ali said they had sent a letter to Raam's firm, stating that they published the apologies on YouTube, TikTok, X and Telegram; and had removed the Jan 14 and 15 defamatory statements. "The court should take judicial notice that not only was the apology tendered in open court, not only was the apology put up in social media and remaining now, it has been vastly reported by the mainstream media, which confirmed Wan Azri apologised to the IGP," he said. Gan had also questioned Azri's action, saying that the matter should have been over when the first committal proceedings ended. "Why did he not let the matter rest? Why did he publish that video, which is quite negative?" he said. After hearing the submissions, Gan said, "I am of the mind to grant leave for this application." The court set 30 June for the inter partes hearing.

‘Papagomo' at risk of second contempt proceeding
Top cop Razarudin Husain brought a RM3 million lawsuit against blogger Wan Azri Wan Deris, alleging that he was defamed in four video postings published in December last year. KUALA LUMPUR : Blogger Wan Azri Wan Deris is at risk again of being cited for contempt of court over two allegedly derogatory postings about Inspector-General of Police Razarudin Husain published last week on social media. On Monday, Razarudin filed an application in the High Court here for leave to bring committal proceedings after the blogger posted a video recording claiming he only issued the apology to escape punishment. Wan Azri is alleged to have uploaded the video on TikTok and YouTube at about 8.30pm on May 1. This time, Razarudin wants the blogger arrested and sent to prison. On April 30, Wan Azri, also known as Papagomo, decided to purge his contempt just prior to the start of proceedings before judicial commissioner Gan Techiong over defamatory and demeaning remarks made earlier this year. 'The statements on social media and his refusal to remove earlier postings (on Jan 14 and 15) show he is not sincere in extending the apology,' Razarudin said in the court papers cited by FMT. In a statement read in court, Wan Azri, a former cop, expressed his unreserved and unconditional regret for referring to Razarudin in a demeaning manner in a social media posting on Jan 14. He also apologised for publishing a doctored photo of Razarudin on the same media platform the following day. Wan Azri gave an undertaking to the court that he would post his statement of apology on YouTube, Telegram, X and TikTok on April 30, which would remain on the social media platforms for at least seven days. The judge also directed Wan Azri to remove the postings made on Jan 14 and 15, which were the subject matter of the contempt of court proceedings. Gan also ordered Wan Azri to pay RM5,000 in costs. Lawyer S Raam Kumar, who represents Razarudin, said the ex-parte leave application would be heard on Friday. On Dec 26 last year, Razarudin filed a RM3 million lawsuit against Wan Azri alleging defamation. He filed the first application for contempt on Jan 24 after the blogger failed to comply with an injunction order issued on Jan 10. The injunction prohibits Wan Azri or his agents from publishing or disseminating defamatory statements against Razarudin, both in his official and personal capacities, on any social media platform until the defamation suit is resolved. Wan Azri was also ordered to retract, remove, and delete video postings on his YouTube, TikTok, Facebook, Telegram, and X accounts dated Dec 14, 15, 20 and 22 last year, which contained the alleged defamatory statements against Razarudin.
