HC disposes of PIL on land compensation, upholds district judges verdict
Shillong, Jul 23 (PTI) The High Court of Meghalaya has disposed of a long-standing public interest litigation (PIL) relating to alleged excess compensation paid during a land acquisition in Ri Bhoi district, upholding the findings of a Special Judicial Officer.
A division bench examined a 2017 direction of the Supreme Court which had sought a probe into whether public money was squandered through inflated land compensation.
Under the apex court's order, a district judge-level judicial officer was appointed to examine the compensation paid.
The Special Judicial Officer, who is also a district judge, held on June 20, 2025, that the compensation was not excessive and had been computed in accordance with the law.
The petitioner had already received 80 per cent of the compensation and sought the remaining 20 per cent through this appeal..
However, respondents opposed the claim, arguing the compensation received exceeded what was due, and questioned the petitioner's entitlement.
The high court observed that the reference to the special judicial officer stemmed from a Supreme Court directive in a public interest litigation, and not under any statutory provision.
Treating the officer's decision as a final judgment/decree in original jurisdiction, the court stated that any aggrieved party is at liberty to seek appropriate remedies as per law.
The remaining 20 per cent of the compensation amount will continue to be withheld for eight weeks from the date of the high court order, after which it will be released to the transferor unless directed otherwise..
The intervening period since June 20 will not be counted towards the limitation period for any legal appeal or proceeding.
With this, the HC disposed of the PIL. PTI JOP NN

"Pollution Should Be The Criteria": Minister On Old Vehicles' Ban In Delhi
New Delhi: The Delhi government has approached the Supreme Court seeking a review of its 2018 order, which bans diesel vehicles older than 10 years and petrol vehicles older than 15 years in the Delhi-NCR region. The petition argues that the age-based ban is outdated and unfairly targets even roadworthy, non-polluting vehicles, hitting middle-class owners the hardest. The plea comes amid growing backlash over the Commission for Air Quality Management's (CAQM) July order to stop fuel supply to vehicles that fall under the "end-of-life" category. That order has now been deferred till November 1 after strong public opposition and intervention by the Delhi government. Environment Minister Manjinder Singh Sirsa confirmed the development, saying the situation has changed significantly since 2018. "The situation of 2025 is totally different from 2018, and there are many modern technologies available now. We want to apprise the honourable court, and that's why we have filed the review," Mr Sirsa told NDTV. Mr Sirsa added, "If a vehicle is polluting, it should be banned, regardless of whether it's five years old or fifteen. Pollution should be the criteria, not the age of the vehicle." The petition warns that continuing with the 2018 ruling will lead to even BS-VI compliant vehicles being taken off the roads in the coming years, without scientific justification. It questions why even BS-IV vehicles that pass Pollution Under Control (PUC) tests are being sidelined and calls for decisions to be based on updated emissions data. The government has urged the court to order a comprehensive, scientific study on how older vehicles contribute to pollution, rather than relying on blanket age-based rules. The petition also cited that other countries like Japan, the US, and those in the EU do not ban vehicles solely based on age. Instead, they rely on regular testing and real-time emissions data to decide if a vehicle should remain on the road. The debate has struck a chord with vehicle owners across NCR, many of whom say they've suffered despite owning well-maintained cars. Naresh Malik, a South Delhi resident, shared his ordeal, "I had to sell my Corolla Altis, which had only run 34,000 km in 15 years, at a throwaway price. It was in perfect condition. Today's cars can easily last 2.5 lakh kilometres. Why are we judged just on age?" "If the aim is to reduce pollution, the focus should be on traffic congestion and stricter PUC (Pollution Under Control) checks, not arbitrary rules. I'm hopeful the court will understand the practical concerns of people like us, especially the financial burden we face," he added. The CAQM's July 1 directive to stop refuelling ELV vehicles had triggered widespread public outcry. Minister Sirsa wrote to the commission asking for a pause, and Lt Governor VK Saxena later advised the government to take the matter to the Supreme Court. The case is now listed for hearing on Monday, and its outcome could impact thousands of vehicle owners across the capital region, as well as future national policies on vehicle retirement and pollution control.

Congress seeks court-monitored CBI probe into organic cotton scam in MP
New Delhi, Jul 26 (PTI) The Congress on Saturday demanded a court-monitored CBI probe into an alleged scam in the sale of normal cotton as organic cotton in Madhya Pradesh. Former Madhya Pradesh chief minister and senior Congress leader Digvijaya Singh alleged that India's image is being hurt globally as the country has lost credibility in the certification of organic products. Addressing a press conference here, Singh alleged that the scam is estimated to be of the tune of Rs 2.1 lakh crore in the name of selling normally produced cotton as organic cotton. There was no immediate comment available from the Madhya Pradesh government. Giving details, Singh said that in 2001, the Ministry of Commerce and Industry launched the National Programme for Organic Production (NPOP), which is implemented by the Agricultural and Processed Food Products Export Development Authority (APEDA). He said its objective is to certify and regulate the export of organic products. Under this framework, NPOP accredits certification bodies (CBs), which in turn verify internal control systems (ICS). The ICSs are groups of 25 to 500 farmers who grow organic cotton. As of 2025, there are approximately 6,046 ICSs and 35 CBs. Singh, however, alleged that most farmers who are shown as registered under ICSs are neither growing organic cotton nor are they aware of their presence in the system. 'In short, ICS groups have deliberately committed fraud by adding farmers' names to obtain transaction certificates," Singh alleged. With the result, he claimed, while the farmers struggle to get fair prices for their produce, some powerful traders are selling non-organic (Bt) cotton as 'organic', earning up to six times the profit. While these exporters are also committing massive tax and GST evasion, at the international level, he claimed that India is now being seen as a 'hub of fraud in the organic market", leading to cancellations of recognition by global agencies. He also claimed that raids on just two commercial entities uncovered Rs 750 crore in GST evasion, revealing a Rs 7,500 crore scam from just these two, as tax evasion accounted for only 5 per cent of the total fraud amount. Referring to the international fallout, the former chief minister claimed that in October 2020, GOTS (Global Organic Textile Standard) caught 'fake transaction certificates" in India, banned 11 companies, and revoked the accreditation of a major certifier. In June 2021, the USDA (USA) ended India's automatic recognition for organic certification, Singh claimed, while revealing that in November 2021, the EU cancelled the recognition of five Indian certifiers due to restricted chemicals found in supposedly organic products. Singh said on August 27, 2024, he highlighted the organic cotton fraud in Madhya Pradesh through a letter to the prime minister. The Congress leader demanded the constitution of a special investigation team (SIT) led by the CBI under the supervision of a sitting high court judge. Seeking transparent inspections by the certifying bodies, he also demanded fair compensation for the exploited farmers.
