Legal fees add nearly R40m more to the total bill for province department
The Mpumalanga department of agriculture, rural development, land and environmental affairs has come under fire for spending more than R20 million paying two former employees for unfair dismissal.
This information is contained in the department's portfolio committee's recently released report.
Mpumalanga department employees dismissed unfairly
According to the report, the Labour Court ordered the department to pay R21 million to the two senior officials as their dismissal was found to be both procedurally and substantively unfair.
'The court ordered the department to pay retrospective compensation from the date of dismissal (2009 to 2024) and reinstate the employees,' the report says.
The department told the committee that the payments would not affect service delivery because they were drawn from the compensation of employees' allocation.

According to the document, the department incurred more than R30 million in legal fees associated with the two employees.
'In some circumstances, the department incurred no cost orders as the court did not make an order against the department. The department paid R1 554 000 between October 2024 and March this year, bringing the total amount paid during the 2024-2025 financial year to R39 516 536,' the document reads.
Factors that could lead to wrongful dismissals
Labour analyst Bukani Mngoma said there were many things that could have contributed to the situation that the department finds itself in. He said it might happen that they were given bad legal advice.
'Sometimes dismissals are wrong and management may know, but they pursue it because it may serve a political consideration, or they want to get rid of an employee who knows too much, or is a stumbling block to doing a corrupt act.

'It is rare that such dismissals are a result of sheer incompetence, as there are too many people involved before an employee is finally dismissed.
'There is no way that in this chain of involvement no-one is picking up that the dismissal will cost the entity heavily,' said Mngoma.
Public sector dismissals generally costly
Mngoma said dismissals in the public sector were generally costly because of the high salaries employees get compared to those in the private sector. He said the seniority of the employee also made the dismissals even more costly.
He added that the other factor was that it takes time before the matter can be finally decided, particularly if the employee was reinstated, because they may need to be paid from the date of dismissal.
'So, the longer the matter has taken, the more expensive reinstatement becomes. I say this because if the employee wins the case but is only compensated, there is a legal capping of 12 months' payment of compensation, irrespective of the period the matter dragged on.
'What I have also noticed is that investigations in the public sector take too long, as they want to get absolute proof as if the matter is in a criminal court.'

Tersia Marshall, a DA member in the provincial legislature, has called on the department of public service and administration to consider placing a cap on the number of times it takes government departments to resolve cases of suspended or fired public service employees.
Department spokesperson Zanele Shabangu did not respond to questions sent to her on Wednesday.

In the judgment, the High Court of South Africa, KwaZulu-Natal Local Division, Durban ruled that the provisional preservation order granted on February 27, 2025 against the ninth and tenth respondents (South African Revenue Service v Kajee and Others) is confirmed. TJSA said that the KwaZulu-Natal High Court has dismissed challenges to the South African Revenue Service's preservation order, allowing Sars to continue securing assets while investigating more than R96 million in suspicious financial transfers involving the Pietermaritzburg-based cigarette maker. TJSA founder Yusuf Abramjee said that this case demonstrates exactly why Sars needs robust investigative powers and why the illicit tobacco trade continues to devastate our fiscus. 'When a court finds a tobacco manufacturer has a case to answer over millions in under-declared income, it confirms what we've been saying for years – the industry is riddled with tax dodgers who are bleeding our country dry.' TJSA said that Amalgamated Tobacco – as well as local industry body the Fair-Trade Independent Tobacco Association (FITA) – is fighting Sars's legal right to install surveillance cameras in cigarette factories. Abramjee said that while legitimate manufacturers should welcome transparency measures, those opposing surveillance systems clearly have something to conceal. 'If the allegations in this case are true, then it will vindicate Sars's approach to enhance monitoring of the tobacco sector. The illicit cigarette trade now commands more than 70% of the South African cigarette market, robbing the country of approximately R30 billion in tax revenue annually. 'The Government must ensure that Sars has the resources to expand these investigations to other major players in the illicit tobacco trade.' FITA chairperson Sinenhlanhla Mnguni said that they note the recent judgment delivered by the High Court of South Africa, KwaZulu-Natal Local Division, Durban, in the matter of Commissioner for South African Revenue Service v Kajee and Others (Case No. D1514/2025). 'FITA respects the judicial process and the role of the courts in upholding the rule of law. FITA has consistently and unequivocally supported all legitimate efforts by the state, regulatory authorities, and industry stakeholders to combat smuggling and the illicit trade in cigarettes. These illicit activities undermine the integrity of the market, deprive the fiscus of vital revenue, and harm legitimate businesses across the sector.' Mnguni added that they commend any actions that promote transparency, accountability, and fair competition, and stand ready to collaborate with Sars and other entities to eradicate these threats. 'Compliance in the tobacco industry must be approached holistically, taking into account the full spectrum of challenges and dynamics at play. It is concerning when enforcement appears to be selectively focused on isolated aspects, potentially overlooking broader systemic issues that contribute to non-compliance. This narrow lens risks distorting the true picture of the industry, which is far more complex.' Mnguni said that they urge all stakeholders, including Sars, to adopt a comprehensive and equitable strategy that addresses root causes such as economic disparities, regulatory gaps, and unfair trade practices affecting smaller, independent players. 'Only through such a balanced approach can we achieve sustainable compliance and a level playing field for all participants in the South African tobacco market.' Professor Corné van Walbeek, the director of the Research Unit on the Economics of Excisable Products, from the University of Cape, said that illicit trade in South Africa is a very serious matter. 'The illicit trade in cigarettes accounts for more than 50% of the total market. A large proportion of illicit cigarettes in South Africa are under-declared local production. The fact that Amalgamated Tobacco Manufacturing Company has been charged for tax evasion by Sars is long overdue.' Trade Minister Parks Tau said it was mildly comforting that 35% of SA exports remained exempted from the tariffs with the exceptions published in the previous US Executive Order to remain in force. The exceptions cover products such as copper, pharmaceuticals, semi-conductors, lumber articles, certain critical minerals, stainless steel scrap, energy and energy products. Tau said the impact of the tariff was still subject of scrutiny with various conclusions, citing AgriCulture South Africa reporting an understated impact than initially modelled. "Drawing a straight line is a mistake we all have been making over the past few months when we are saying the auto sector is going to be affected and can't export to the US market," Tau said. "But when you drill down to the detail, most of the Original Equipment Manufacturers (OEMs) in the country do not go into the US market. So you have to go to the OEM that goes into the US market to determine what percentage of products [is exported to the US] to then determine impact. Last month, US President Donald Trump stated that the 30% tariff was "necessary to correct the many years of South Africa's Tariff, and Non Tariff, Policies and Trade Barriers," blaming Pretoria for what he called "unsustainable Trade Deficits against the United States." However, Tau and Dirco Minister Ronald Lamola said the calculation of US-SA "trade deficit" ignored the substantial US trade surplus in services, as well as the complementary nature of the bilateral trade and investment relations between the two countries. "South African exports do not compete with US producers and do not pose a threat to the US industry," they said in a joint statement. As a result, the government has embarked on the diversification of markets and strengthening trade and investment partnerships with various trade partners, targeting markets across Africa, as well as in Asia, Europe, Middle East, and Americas. "Our announcement on the Clean Trade and Investment Partnership with the European Union in March has unlocked a R90 Billion Investment Package that has been initially committed," read the statement. "This Clean Trade and Investment Partnership also aims to unlock new market access opportunities for South Africa, including the export of Sustainable Aviation Fuel (SAF) by Sasol and the exports of hybrids and Electric Vehicles. "While facing global trade challenges, South Africa is proactively building a more resilient agricultural sector. We've made significant progress in opening up vast new markets like China and Thailand, securing vital protocols for products like citrus and others." The government said that with China alone being a $200bn market, South Africa was confidently expanding its reach and creating new opportunities for agricultural producers. "We're making significant inroads into new, high-growth markets across Asia and the Middle East, including the UAE, Qatar, and Saudi Arabia. We have also developed a number of Trade and Investment Packages with a number of countries, including Japan that aim to unlock new market access opportunities," it said. "While the current measures present challenges, it also presents opportunities to build and accelerate the implementation of the African Continental Free Trade Agreement and to develop new partnerships in markets that have remained untapped, including ASEAN and Turkiye."
