
Draft data rules introduce potential for data localisation requirements: trade associations to IT ministry
The Information Technology Industry Council, one of the signatories to the letter, counts Big Tech companies like Amazon, Apple, Google, Meta, Microsoft, Nvidia, and OpenAI as its members.'We urge the government to narrow and align these rules to bring them into alignment with the original intent of the DPDP Act,' the letter's nine signatories said. The other signatories are US India Business Council, Software and Information Industry Association, ACT | The App Association, Asia Internet Coalition, Asia Video Industry Association, Coalition of Services Industries, Computer and Communications Industry Association, and K-Internet. The industry bodies were referring to Rules 12 and 14 of the draft DPDP rules.
'This could be achieved by setting out a clear process, including timelines and safeguards, as well as adequate consultations and timelines for implementing any potential localisation requirements, and determining when and how such data localisation determinations will be made,' the associations said in their letter to The Ministry of Electronics and Information Technology (MeitY), a copy of which was seen by ET.
'We would also urge the government to view any potential restrictions on data free flows from a future "bilateral digital trade "agreement perspective,' the signatories said. The associations also want that Rules 3-15, 21 and 22 shouldn't take effect until or after two years from the date of notification. Rule 22, as currently drafted, provides the potential for an excessively broad scope of government access to private sector data without making clear that this will follow a robust, proportionate, and transparent process with proper avenues of redress and review, they said. Giving further clarity on this process, including by referencing globally-recognised Trusted Government Access principles, would be an effective way to provide clarity and reassurance on this point, they added.
The associations supported the Global Cross Border Privacy Rules (CBPR) forum and similar regimes that facilitate the free flow of data across borders, promote interoperability between privacy regimes, and encourage responsible data use and strong privacy protections, they said.
Also, personal data breach reporting requires clear, risk-based reporting thresholds to ensure reporting timelines and processes do not end up compromising the efficiency of risk mitigation measures, the associations wrote in their letter dated May 21.
They have also asked the MeitY to 'strongly consider' adding back language proposed in previous drafts of the DPDP Act to give critical exclusion for data pertaining to credit reporting to facilitate financial transparency and fraud prevention while supporting financial inclusion. Credit bureaus such as TransUnion CIBIL, Experian, Equifax, and CRIF High Mark are approved by the Reserve Bank of India for operating in the country.

Amazon's New Appraisal System From this quarter's mid-year review cycle, Amazon managers will evaluate employees as per three criteria like Leadership Principles adherence, performance, and potential. These factors combined will be used for Overall Value score that will decide employees career progression and compensation decisions. Amazon Employees On Role Model Status The initiatives are taken after CEO Andy Jassy's created a disciplined workforce and improved corporate culture. Since last year, Jassy has started full work from office policy, reduced management layers, and revised compensation models to reward top performers. According to internal documents as per Business Insider report, only 5% of employees will qualify for the top 'role model' grade while Leadership Principles behavior will be measured. The company's spokesperson Sam Stephenson said these changes 'streamline the process for managers and help to ensure greater consistency.' Amazon Stack-ranking System Amazon maintains its stack-ranking culture, where managers categorize employees into five performance tiers as per predetermined percentages. Teams with over 50 employees must place 20% in the top tier, while 5% will be designated as 'Least Effective'. This system gained criticism as it gives managers authority to rank capable employees poorly to meet this distribution requirements. But other tech giants like Microsoft, Google, and Meta also have stricter performance management policies this year.

Government officials have claimed in a Parliamentary panel meeting that incidents of cyber-crime are low although lawmakers were not entirely convinced and sought new measures, stronger laws and more focus in rural areas where financial literacy and awareness campaigns are limited, people familiar with the matter said, asking not to be named. Incidents of cyber-crime low, officials tells House panel In the home affairs panel meeting, the Union finance ministry's Department of Financial Services (DFS) told the lawmakers that for every ₹ 10,000 of transaction only 9 paisa is fraud—which is a very 'low level' . But MPs, cutting across party lines argued that government agencies must strengthen their financial and digital literacy drive in rural areas where a vast section of the population receives government aid digitally through direct benefits transfer. According to one of the people cited above, a government official, TDP's Krishna Prasad Tenneti and others raised the issue of the vulnerable population and pointed out that at least 65% of the Indian population lives in rural areas. While appreciating DBT (direct benefits transfer), the lawmakers, the official added, pointed to the importance of educating people on being safe online. ASP KR lawmaker Chandra Shekhar, Congress' Amrinder Singh Raja Warring, and BJP's Soumitra Khan were among the other members who spoke about the same issue. Some lawmakers argued that parking proceeds of cybercrime abroad is a matter of national concern. According to the NCRB data, 50035, 52974 and 65893 cyber crime cases were registered across the country in 2020, 2021 and 2022, respectively. The NCRB has not released its data since then. The officials informed the lawmakers that on June 30, the Reserve Bank of India asked all Scheduled Commercial Banks, Small Finance Banks, Payments Banks, and Co-operative Banks to integrate the Financial Fraud Risk Indicator (FRI) developed by DoT into their systems. This is a risk-based metric that classifies a mobile number to have been associated with Medium, High, or Very High risk of financial fraud, according to a government press release issued on Wednesday. In 2023, a RBI report to the standing committee on finance had said that a number of steps including a threshold for transactions in new accounts, a Central 'negative registry' of the accounts of known fraudsters and a standard operating procedure to stop the downstream flow of funds once a fraud is reported have been suggested by Indian banks to stop online frauds. The two-day meeting on 'Cyber Crime - Ramifications, Protection and Prevention' of the parliamentary standing committee on home affairs started here on Wednesday. Officials from Department of Financial Services, Public and Private banks, Department of Telecommunications Telecom Regulatory Authority of India (TRAI), Ministry of Electronics and Information Technology (MeitY); and Indian Computer Emergency Response Team (CERT-In), MeitY briefed the MPs. The panel is headed by BJP's Radha Mohan Das Agrawal. On Thursday, the panel invited external affairs ministry officials, and CBI and NIA officials to discuss the issue. The Ministry of Home Affairs has set up the 'Indian Cyber Crime Coordination Centre' (I4C) to deal with all types of cyber crime in the country, in a coordinated and comprehensive manner.
