
Gujarat HC rejects petition challenging election of BJP MP from Bhavnagar seat

Ahmedabad, May 6 (PTI) The Gujarat High Court has rejected a plea challenging the election of Lok Sabha MP and Union minister Nimuben Bambhaniya from Bhavnagar, observing the petitioner has failed to establish 'improper acceptance' of her nomination form materially affected her election.
Bambhaniya, a first-time MP from the Bharatiya Janata Party (BJP), is currently serving as the Minister of State for Consumer Affairs, Food and Public Distribution in the Modi government.
Mere non-compliance or breach of the Constitution or statutory provisions, as alleged by the petitioner, by itself does not result in invalidating the result of the candidate under section 100(1)(d)(IV) (of Representation of People Act, 1951, dealing with grounds of election to be declared as void), the court observed.
For the election of (winning) candidate to be declared void under clause 4 of section 100(1)(d)(IV) of the Act, there has to be a proof of the fact 'that such a breach or non-observance has resulted in materially affecting' the final outcome, the HC maintained.
'In other words, the violation of breach or non-observance or non-compliance with the provisions of Constitution or the Act, 1951 or the rules or the (apex court) orders made thereunder, by itself does not render the election of written candidates void under section 100(1)(d)(IV),' it said.
'The language of section 100(1)(c) clearly places the burden upon the objector to substantiate the objection that the result of the election has been materially affected,' the court contended.
Since the petitioner has failed to establish that improper acceptance of the nomination form was fatal to the elections, the court found no merits in her submission and dismissed the plea. PTI KA PD RSY

ECI appoints returning officer for Vice President election
New Delhi, July 25 (UNI) The Election Commission of India (ECI) has initiated preparations for the Vice-Presidential Election, 2025 after Jagdeep Dhankhar resigned early this week from the constitutional post. An official order issued today said, Rajya Sabha Secretary General has been appointed the Returning Officer for the election in accordance with the Presidential and Vice-Presidential Elections Act, 1952. The appointment was made in consultation with the Ministry of Law and Justice and with the approval of the Deputy Chairman of Rajya Sabha. Alongside the Returning Officer, two Assistant Returning Officers have also been named: Garima Jain, Joint Secretary, Rajya Sabha Secretariat, and Vijay Kumar, Director, Rajya Sabha Secretariat. As per Article 324 of the Constitution, the Election Commission of India is responsible for conducting the election to the office of the Vice President. 'Under Section 3 of the Presidential and Vice-Presidential Elections Act, 1952, the Election Commission, in consultation with the Central Government, appoints a Returning Officer, who shall have his office in New Delhi, and may also appoint one or more Assistant Returning Officers. As per convention, either Secretary General, Lok Sabha or the Secretary General, Rajya Sabha is appointed as the Returning Officer by rotation. "During the last Vice-Presidential election, the Secretary General of the Lok Sabha was appointed as the Returning ,' the official order said. The requisite gazette notification is being issued separately today, the notice further added. Vice President Jagdeep Dhankhar had tendered his resignation on Monday evening, citing health concerns. Itanagar, Jul 25 (PTI) Arunachal Pradesh Chief Minister Pema Khandu on Friday joined thousands of devotees at the revered Karsha Photang in Zanskar to participate in 'Yarchos Chenmo', the great summer dharma gathering, hosted by the Karsha Monastery in Ladakh. The sacred congregation witnessed the presence of nearly 30,000 spiritual seekers who assembled under the vast Ladakhi skies to receive teachings from the Tibetan spiritual leader, the Dalai Lama. Khandu, in a social media post described his encounter with the Dalai Lama in Ladakh as a deeply humbling and spiritually uplifting experience, highlighting the quiet power of compassion and the timeless wisdom radiated by the revered Tibetan leader. Khandu is currently on a visit to Ladakh. The revered Tibetan spiritual leader delivered a powerful discourse on key Buddhist principles, including compassion, dependent origination, the Four Noble Truths, the concept of emptiness, and the path of the Bodhisattva.
