Hearing over Budaun temple-mosque row deferred

News18a day ago
Agency:
Budaun, Jul 24 (PTI) The hearing in the Neelkanth Mahadev v. Shamsi Jama Masjid case in a local court was on Thursday deferred to August 30 owing to the judge's absence.
The case file was transferred to the fast track court (FTC) as civil judge (senior division) Suman Tiwari went on maternity leave.
The court previously reserved its order after hearing arguments from Anwar Alam, counsel for the Shamsi Jama Masjid Management Committee.
Alam argued according to Supreme Court directions, subordinate courts were not authorised to hear such religious structure disputes, and the case should be dismissed.
The temple's legal team, led by advocate Ved Prakash Sahu, said the hearing on August 30 would determine whether the case can proceed in the civil court or not.
The legal battle has seen multiple adjournments since February, mainly due to absent counsel, court vacations, and judge transfers.
On May 28, the judge reviewed the case file and instructed both parties to present their arguments on July 5.
However, the Masjid committee sought an adjournment as their lawyer, Asrar Ahmad, was on Haj pilgrimage. The judge then fixed July 5 for regular hearings to commence, and both parties were told to be present with full preparations.
On July 5, advocate Alam reiterated under the Places of Worship Act, 1991, and related Supreme Court rulings, the subordinate judiciary lacked jurisdiction to hear such cases.
He submitted relevant documents, including a Supreme Court order, saying no court could pass orders on matters falling under the 1991 Act.
In response, temple counsel Vivek Kumar Render contended that the Supreme Court orders did not bar the ongoing or pre-existing suits from being heard.
He maintained that the case should be heard in full. PTI COR CDN AMK AMK

Muslim bodies urge govt to ensure end of Israeli aggression in Gaza

New Delhi, Jul 25 (PTI) Prominent Muslim bodies and Islamic scholars on Friday appealed to the government to stand against injustice and take swift action to ensure that the 'continued Israeli aggression" in Gaza ends, asserting that India has historically aligned itself with the oppressed and it is time to reaffirm that legacy. In a joint statement, prominent Muslim organisations and Islamic scholars called on both the Indian government and global powers to intervene and stop the 'continuing atrocities" in Gaza. 'We, the undersigned leaders of Muslim organisations in India, Islamic scholars and peace-loving citizens strongly condemn the deepening genocide and humanitarian catastrophe unfolding in Gaza. On behalf of over 200 million Indian Muslims and all peace-loving citizens of our beloved country, we express our unwavering support and solidarity with the people of Palestine," the statement said. 'We appeal to the government of India, international leaders, and people of conscience worldwide to stand against the injustice and take swift action to end the continued Israeli aggression," it said. 'The relentless assault on the Palestinian people has taken the form of a brutal genocide, characterised by systematic destruction of homes, hospitals, schools, and refugee camps. Since October 2023, nearly 100,000 innocent Palestinians, including a significant number of women and children, have lost their lives," the statement claimed. The international community cannot afford to remain silent, it said. 'We call upon all states to sever military and economic ties with Israel and back the UN General Assembly's call to end the illegal occupation. We urge all Muslim-majority nations to put strong pressure on Israel and the US to halt this catastrophe," the statement said. 'India has historically aligned itself with the oppressed; this is the moment to reaffirm that legacy," it asserted. 'We call on the Government of India to honour its long-standing moral and diplomatic tradition by standing firmly with the Palestinian people in their struggle. India must denounce Israel's brutal actions, halt all military and strategic cooperation with it, and actively back global efforts to ensure peace and stability in the region," the statement said. The statement was signed by Jamiat Ulema-e-Hind president Maulana Arshad Madani, All India Muslim Personal Law Board president Maulana Khalid Saifullah Rahmani, Jamaat-e-Islami Hind chief Syed Sadatullah Husaini, Markazi Jamiat Ahl-e-Hadees Maulana Ali Asghar Imam Mehdi, Fatehpuri Mosque Imam Mufti Mukarram Ahmad, and former Rajya Sabha MP Maulana Obaidullah Khan Azmi, among others. (Image for representation)(Hindustan Times) The commission said the woman was found in possession of incriminating material that qualified as the use of unfair means during an exam. "As the candidate has violated the rules of the Examination and is found to be guilty under the rule of the Examination - 12(1)(h) 'being in possession of or using unfair means during the examination'," the UPSC said in a post on Linkedin. The commissions announced the cancellation of the aspirant's candidature for this year, and said she was debarred from appearing in all future examinations conducted by the UPSC for a period of 3 years. The UPSC said that the decision was in line with standardisation of penalties, and also shared a document outlining how violation of rules is dealt with. "Any candidate found guilty of indulging in unfair means or misconduct during examinations faces strict disciplinary action as per rules, including debarment from future examinations, as the strictest action," UPSC Chairman Ajay Kumar was quoted as saying by news agency PTI. The official termed UPSC 'an epitome of merit and fair system' and said that the commission ensures that candidates get selected purely on merit basis. The action against the UPSC aspirant comes over an year after the commission cancelled former IAS probationer Puja Khedkar's provisional candidature. Puja allegedly misrepresented her identity and used forged documents to clear the 2022 civil services examination. She submitted fake Other Backward Class (OBC) and disability certificates, and claimed that her family income was ₹6 lakh per annum, to qualify for the OBC non-creamy layer category. A detailed probe later revealed that her father had declared assets of ₹40 crore when he contested general elections as an Independent, and her family owned several immovable properties and vehicles.
