
eBay worker loses constructive dismissal claim
The employee told the Workplace Relations Commission (WRC) earlier this year he had "people dying left, right and centre" in his personal life at the time of the events that led to the warning, including a friend who "went into the river in Navan".
His former manager said: "Anything over 60 seconds is considered work avoidance."
A claim for constructive dismissal brought by the worker, Eanna Donoghue, under the Unfair Dismissals Act 1977 eBay Europe Services Ltd, has been rejected by the tribunal.
Mr Donoghue quit on 5 March 2024, the day he was told a company appeals officer had decided to leave a written warning for "work avoidance" on his personnel file – effectively barring him from seeking promotion for a time, he said.
He had been in the €41,000-a-year job for just short of seven years.
The tribunal heard Mr Donoghue's former line manager, Niamh Seoighe, wrote to him on Thursday 21 December 2024 telling him that she had observed on a screen recording that he closed off a customer issue by email in a minute and 36 seconds, but left the page open for a few minutes.
"I couldn't take it any longer," Mr Donoghue said, telling the WRC the reprimand for "work avoidance" followed a period when he had "people dying left, right and centre" in his personal life, including a friend who "went into the river in Navan".
"For some reason that was just ignored. A perfect record for seven years, and she [his line manager] still thought it was reasonable and fair to give me a warning on that incident," he said.
Mr Donoghue's position was that the reprimand over the four-minute inactivity incident in January 2024, and informal "verbal counselling" on 28 November 2023 for lateness, was linked to filing grievances, starting with complaints against two operations managers on 16 November that year.
He said he was aggrieved to get "a warning for going to the bathroom for four minutes, for not closing off an email" when he claimed he had called out people "doing ten times worse" in the past.
Mr Donoghue had "informal verbal counselling" for lateness in the months before the downtime issue arose, the tribunal heard. Three instances of lateness were officially recorded on Mr Donoghue's file. The company submitted he had actually arrived late on eight occasions.
The tribunal heard that Mr Donoghue had car trouble at the time and was trying to get from Navan, Co Meath, to Blanchardstown, Dublin 15, by bus. He told the WRC the Minister for Transport had admitted to a newspaper "the NX [bus] didn't turn up".
"That was out of my control, I couldn't get to work," he said.
Mr Donaghue's position during a disciplinary meeting had been that he "forgot to close the email" before taking a break, and that he might have gone to get a cup of tea," counsel for the respondent Mark Curran BL said in cross-examination.
"To this day I'm not sure," Mr Donaghue said. "I took a couple of calls in this time," he said.
"You did say you took a personal call about the person in the river," he said.
"I took a personal call, but I'm not sure if it was in that four minutes," the complainant said.
Ms Seoighe said in her evidence that she wrote to Mr Donoghue before Christmas that year looking for an explanation after observing on a screen recording from his computer that he had finished responding to the email but failed to mark himself as available for up to five minutes.
"It was call avoidance," she said. "If I'm going on the 'break unpaid' ops code, I'm being skipped; it's going to someone else on the team, they're getting additional calls," she said.
"[For] idle time on an email, anything over 60 seconds is considered work avoidance," she said. Her position was that the issue was exacerbated by Mr Donoghue's failure to use an hour specifically allotted for him to answer her queries on the downtime and because she "had to follow up several times".
The written warning given to Mr Donoghue by Ms Seoighe was upheld in a paper-based appeal.
In her decision, adjudicator Eileen Campbell wrote that she had "every sympathy" for the difficulties Mr Donoghue had experienced in his personal life.
She wrote that Mr Donoghue "appears to feel that he has been treated unfairly by the imposition of a first written warning for behaviour of a type he would have called out in respect of agents in the past".
"When his team leader does her job and addresses an issue with the complainant he considers it to be unreasonable behaviour and alleges he is being targeted," she wrote.
She noted further that Mr Donoghue quit "without any attempt at raising a grievance" about the warning.
"I am not persuaded by the complainant that resignation was his only option," she concluded, dismissing the complaint.

Wexford public warned of new scam involving Ebay, the post office and €1,000 in One4All gift cards
In the rural Wexford village of Wellingtonbridge, a local man had a close call with a group of scammers that seemed to be calling from some kind of call centre in India. The callers were convincing enough to persuade local man Anthony O'Neill to make a trip to the local post office while they remained on the line. "Basically, these guys rang and said somebody was trying to get €600 out of my eBay account," he explains. "They told me that they wanted to catch these scammers and that the situation required urgent action. I think I was passed between three people in total, all with Indian accents. "They asked me how far I was from the local post office, and I replied that I was around 2km. Then they said they'd stay on the line while I travelled there and they'd need me to purchase four €250 One4All gift cards.' At this point, alarm bells started to ring for Anthony. However, the callers had provoked a sense of panic and urgency. "I was thinking about picking up a hurl and bringing it with me,' he said. 'I was thinking to myself, 'is someone going to be waiting for me at the post office or something?'' Eventually, Anthony got in the car and drove to the post office, all while the scammers remained on the line. "They said that they don't need to talk to anyone, but that I should ask for the four gift cards,' he explains. 'When I asked the lady behind the counter and she saw that I was on the phone, she waved at me and asked me to put them on the phone. When I handed it over, they hung up.' As it turned out, Anthony was not the only intended victim locally. "She said that I was the third or fourth person who had turned up with the same thing," he said. 'I don't know what the next step was going to be, whether they were going to ask me for the numbers on the backs of the cards or what. ADVERTISEMENT "I was a bit suspicious, but these guys were very convincing.' While suspect phone calls from unknown numbers and messages purporting to be from the likes of eBay, PayPal, An Post and a whole host of couriers have become alarmingly commonplace, separately Wexford County Council issued a warning on Tuesday about a different type of scam doing the rounds. "Please be aware that people are being offered 'Free Tarmacadam' while Wexford County Council are undertaking road works,' a council statement said. 'These scammers are saying that the tarmacadam is left over and therefore 'free'. This is a scam and we'd appreciate if people would help us spread the word so that vulnerable people will not fall victim.'

Education worker who was falsely branded 'incontinent' takes discrimination case
Management at a state education provider falsely claimed that a senior employee was incontinent and had short-term memory loss with the aim of justifying their decision to suspend him, the Workplace Relations Commission (WRC) has heard. Martin Kelly is pursuing complaints against Mayo, Sligo and Leitrim Education and Training Board (MSLETB) under the Employment Equality Act and the Terms of Employment (Information) Act. He had been employed at Ballina Training Centre in Mayo since 1990, and claims that he should have been made a teacher in 1999, but was instead told to sign a contract as a resource worker. Mr Kelly told an adjudication hearing of the WRC that he 'hadn't a clue what this was', but was advised that it would 'enhance and improve' this position, so he signed it. When he was approaching retirement and made enquiries about his pension entitlement, however, he discovered that there had been a 'huge difference' in the roles of teacher and resource worker. The WRC heard that MSLETB management claimed in an email that Mr Kelly was incontinent and was suffering from short-term memory loss. These were 'outrageous untruths', according to Mr Kelly's legal representative. She alleged that these 'false matters' had been raised in an effort to provide some justification for the education provider's 'discriminatory acts of suspension' after Mr Kelly agitated for his entitlements. He told the WRC that he had taken summer holidays in June every year for 30 years but, in July 2023, received a letter from MSLETB management claiming that he had been absent without leave for the past month. Mr Kelly was subsequently asked to undergo a medical assessment. His legal representative claimed that this constituted discrimination because a younger person in his position would not have been asked to do this. He attended an appointment for medical assessment in Sligo in September 2023 but it did not go ahead because he did not know why he had been referred, and the doctor said she could not examine him if she did not know what was wrong, he told the WRC. Mr Kelly was placed on administrative leave on October 12, 2023, and underwent a medical assessment on November 16, when he was examined for 'seven or eight things', including incontinence and memory loss. He told the WRC that it was 'absolutely disgraceful' that management had alleged that he was suffering from short-term memory loss. He also recalled that the author of that email had asked him to 'drive a bus around for three days'. 'So, I find it hard to believe that he would think that I was incontinent,' he remarked. Mr Kelly said the same manager had also asked him to play football at the training centre at a time when he was 70 years old. He suggested that the manager would not have done this if he had any concerns about his health. The adjudication hearing was adjourned and will resume at a later date, when representatives of MSLETB will respond to the complaints. WRC finds Fair City photographer was not a freelancer
RTÉ has failed to have employment rights claims by the former on-set photographer for Fair City thrown out, after the Workplace Relations Commission (WRC) ruled, for the first time, that a supposed freelancer at the national broadcaster was actually an employee. The statutory complaints were brought by photographer, Beta Bajgart, who was previously the subject of commentary at the Public Accounts Committee when it emerged the national broadcaster was paying €60,000 per year for promotional images of the Dublin-based soap opera. Ms Bajgart's case against RTÉ under the Protection of Employees (Fixed-Term Work) Act 2003, the Organisation of Working Time Act 1997, the Terms of Employment (Information) Act 1994 and the Unfair Dismissals Act 1977 will now proceed to a full hearing, following a preliminary ruling today. It is the first WRC case where the principles of a major Supreme Court ruling in 2023 on the distinction between employees and contractors have been applied to the position of a worker at RTÉ. The alleged misclassification of media workers as freelance contractors by RTÉ is a major legacy issue at the national broadcaster. She claims her job as a photographer on the set of RTÉ's flagship soap opera was terminated without notice on 15 December 2023. The broadcaster's lawyers had argued Ms Bajgart was not an employee, but a freelance contractor - giving the employment tribunal "no jurisdiction" her complaints. Adjudication officer Catherine Byrne noted that Ms Bajgart suffered "negative commentary" in September 2023 after attention was drawn to Ms Bajgart's role following a hearing of the Oireachtas Public Accounts committee, which had been scrutinising RTÉ's finances. In the wake of the publicity, Ms Bajgart's solicitors wrote to RTÉ asserting that she had acquired a contract of indefinite duration and was an employee, the tribunal noted. The broadcaster's director of human resources replied that RTÉ's relationship with the photographer was "not an employment relationship" but that she was "a supplier of services". Ms Bajgart was first engaged for the work as an independent contractor for a year starting in June 2011 at €750 a week. There were repeated renewals of the contract and Ms Bajgart won tender competitions in 2017 and 2019, with the rate for the job rising to €980 a week over that period, the tribunal noted. However, Ms Bajgart did not apply when the work was put out to tender again in September 2023, and ultimately ceased working on the Fair City set on 15 December 2023, when the tender process was readvertised, the adjudicator noted. Ms Bajgart gave evidence that she was interviewed for the job in 2011 and "got the contract", with "no discussion about the legal implications". She explained that she set the rate for the job based on her previous work for another production, Off the Rails. Addressing a gap in her contracts between 14 October 2018 and 21 January 2019, Ms Bajgart said she "simply continued to work" and got paid. Her barrister, Michael O'Doherty BL, who appeared instructed by Conor McCrave of Setanta Solicitors, asked if she had "consented to doing the job as an independent contractor. Ms Bajgart replied: "I wanted the job," and added that it was "never offered" to her as a position of employment. Under cross-examination from RTÉ's solicitor, Louise O'Byrne of Arthur Cox, asked Ms Bajgart whether she had done other work while engaged for Fair City. Ms Bajgart said she ran her freelance business around the Fair City shot list and that it was difficult to look for clients because she never knew when she was due on set. Ms O'Byrne also referred to a letter sent by the complainant to the Irish Times and the Irish Independent in September 2023 following remarks by Fine Gael senator Micheál Carrigy about Ms Bajgart's, in which the complainant had stated: "The photographer on RTÉ's Fair City is an independent contractor." Ms O'Byrne argued this showed the claimant "did not consider herself as an employee" of RTÉ. Mr O'Doherty said she had described herself as an independent contractor "because she did not want to upset her employer and potentially lose her job by publicly describing herself as an employee". Adjudication officer Catherine Byrne wrote that the "day-to-day reality" of Ms Bajgart's working relationship with RTÉ was "not consistent with how she was described in her contract as 'a supplier' and 'not an employee'". Ms Byrne noted that Ms Bajgart had been working 20 hours a week, part-time, for 12 years on "a series of fixed-term contracts" in a role which "contributes to the promotion and success" of Fair City. The worker had had a desk on set, "no discretion" about her level of attendance there, and could only work elsewhere three or four hours a week, and performed the work personally 95% of the time, Ms Byrne said. There were limits to Ms Bajgart's "artistic independence" and her freedom to alter her way of working in a bid to increase her earnings, with a fixed weekly rate being paid, Ms Byrne added. Ms Byrne also noted that during a period between October 2018 and January 2019, when there was no contract in place, Ms Bajgart "continued to turn up for work" and got her normal weekly rate "without any dispute". "This continuity of employment, in the absence of a contract, is indicative of a relationship of interdependence and trust, and not that of a commercial agreement," Ms Byrne wrote. "The authors of the agreements… may have genuinely believed that the working relationship with [Ms Bajgart] was that of an independent contractor, at least in the early years," she wrote. "However, it seems to me that the sustained nature of her job and the sole reliance by the respondent on the complainant to do the work, means that the legal basis of the agreement evolved from a supplier's agreement to that of an employee," she added. Ms Byrne wrote that her investigation of Ms Bajgart's status was clouded by the fact the photographer appeared to have "acquiesced" to being classified as self-employed for years - and even described herself as an independent contractor in open letters to two newspapers in 2023. "This acquiescence has no bearing on my conclusion that her relationship with the respondent was that of an employee," the adjudicator wrote.
