.
Appearing before special judge Vishal Gogne, additional solicitor general S V Raju argued the transaction between Associated Journals Limited (AJL), which published the National Herald newspaper, and Young India was a sham.

, late Congress leaders Motilal Vora and Oscar Fernandes, as well as Suman Dubey, Sam Pitroda, and a private company, Young Indian, of conspiracy and
money laundering
over the fraudulent takeover of properties valued at over Rs 2,000 crore belonging to Associated Journals Limited (AJL), which published the National Herald newspaper.

ED alleges Gandhis held the majority 76 per cent shares in Young Indian, which fraudulently usurped assets of AJL, in exchange for a Rs 90 crore loan.
"All India Congress Committee (AICC) was given funds, which were to be used properly, but the way they used Rs 90 crore (shows that) they have committed criminal breach of trust," the ASJ argued.

The transacation between AJL and Young Indian was a sham transaction, he added.
His arguments would continue on July 12.
The ED filed its chargesheet against Sonia and Rahul Gandhi and others under Sections 3 (money laundering) and 4 (punishment for money laundering) of the Prevention of Money Laundering Act (PMLA).
The chargesheet also names Suman Dudey, Sam Pitroda, Sunil Bhandari, Young Indian, and Dotex Merchandise Private Limited.
All accused have opposed the ED's plea on the point of cognisance of the chargesheet and denied the allegations.

NGT notice to ministry, state govt over ‘illegal' construction on forest land
1 2 3 Cuttack: National Green Tribunal (NGT) on Monday issued notices to the Union ministry of environment, forests and climate change, Odisha govt and several officials over alleged illegal construction on forest land in Jajpur district. The petition, filed by Kailash Chandra Nayak of Nuadihi village under Danagadi tehsil, sought intervention against construction being carried out by the state govt on forest land in Danagadi and Sukinda blocks without mandatory approval under the Forest (Conservation) Act, 1980. The petitioner, represented by advocates Sankar Prasad Pani and Ashutosh Padhy, claimed these constructions are being carried out without any forest clearance from the Centre. A representation was submitted to the authorities on March 30, but no action has been taken so far, the petition claimed. The case was listed for the next hearing on Aug 25. According to the petition, massive concrete structures are being built using funds from the District Mineral Foundation (DMF) with the approval of Jajpur district collector, who is also the managing trustee of DMF. It was alleged that on Nov 21, 2023, the collector issued a letter to the Sukinda BDO for constructing activity rooms in 132 primary schools at a cost of Rs 13.20 crore. On Jan 24, 2024, he again approved Rs 13.10 crore for additional classrooms and Rs 14 crore for activity rooms in 140 schools under Danagadi block. The petition sought a halt on all non-forest activities being carried out on forest land without prior central approval and demanded that such constructions be declared illegal.

SRA law tweak: Assets to be seized if bldr defaults on rent
Mumbai: State govt is putting the screws on builders as well as slum dwellers to speed up SRA projects, reports Chaitanya Marpakwar. To recover pending rent from builders who don't pay slum dwellers after demolishing their homes, govt has introduced an amendment to The Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 which allows rent money to be recovered from a company's property or the personal property of its directors/partners. Since outstanding rent will be considered arrears of land revenue, SRA will be able to attach and sell a builder's property to extract rent money. Govt has also reduced the time given to slum dwellers who don't agree to join a rehab scheme from 120 days to 60 days after more than 50% of slum dwellers have given consent. The amendment bill was introduced in the Legislative Assembly on Tuesday and will be discussed later this week. SRA CEO M Kalyankar said that the amendments would help fast-track SRA schemes and make sure that slum dwellers get rent on time. SRA officials said around Rs 620 crore in rent is still due from builders. Officials said to recover arrears of land revenue, govt has various legal processes at its disposal including serving notices, attaching property, and even imprisoning the defaulter. "Under the Maharashtra Land Revenue Code (MLRC), govt can attach and sell the defaulter's movable and immovable property to recover the dues. In some cases, bank accounts or lockers may be attached. Right now the SRA can only issue stop work notices to the builder for not paying rent or stop giving new permissions but beyond that there is no deterrent," an official said. Some other amendments in the bill include those related to handing over land to govt agencies like MMRDA, MHADA, MSRDC and CIDCO to redevelop slums on lease within 30 days of issuance of the letter of intent.

‘Nimisha Priya faces execution in Yemenon July 16'
Kochi: Keralite nurse Nimisha Priya, currently on death row at the central prison in Yemen's capital Sana'a for the murder of a Yemeni national, is scheduled to be executed on July 16, according to human rights activist Samuel Jerome, who holds the power of attorney for Nimisha's mother Prema Kumari. However, there has been no official confirmation of the execution date from the Indian embassy in Yemen, ministry of external affairs (MEA) or Save Nimisha Priya Action Council. Jerome said the execution order was issued by the public prosecutor's office and handed over to prison authorities, who fixed July 16 as the date. Nimisha, a native of Kollengode in Palakkad, was accused of murdering Talal Abdo Mahdi — with whom she had started a health clinic in Sana'a and later reportedly entered into a marriage — in July 2017. She allegedly chopped his body and dumped the body parts in a water tank. Mahdi had reportedly tortured Nimisha and illegally seized her passport, which led to the murder. A trial court sentenced her to death in 2018, a verdict later upheld by an appeals court. Jerome said Nimisha and the MEA had been informed of the execution decision. Subhash Chandran of the Save Nimisha Priya Action Council, however, said they had not received any confirmation of the execution date. "We are in close contact with multiple organisations in Yemen and embassy officials. We have not received any information regarding the execution so far," he said. Negotiations for Nimisha's release suffered a major setback last year when the lawyer appointed by the Indian Embassy demanded a pre-negotiation fee of over Rs 15 lakh. The action council managed to arrange $40,000 through mediators, but the effort fell through midway. Subhash said the council had established contact with Mahdi's family and was working to start negotiation talks, although the family has yet to make a demand for blood money. The prevailing political situation in Yemen is also a major challenge to secure Nimisha's release. While Sana'a is under the control of Houthi militias, the rest of the country is governed by an internationally recognised, Saudi-backed govt and UAE-backed Southern Transitional Council (STC). The Yemeni embassy in Delhi represents the Saudi-backed govt and has no official ties with the Houthis.
