4 former Volkswagen managers convicted in 'dieselgate' fraud

May 26 (UPI) -- A German court convicted four former Volkswagen managers of fraud on Monday and a decade after "Dieselgate" exposed deceptive devices installed in many Volkswagen models to pass emissions tests.
Jens Hadler was sentenced to 4.5 years in prison and formerly was Volkswagen's diesel engine development chief, the New York Times reported.
Hanno Jelden, a former VW engine electronics manager, received a sentence of two years and seven months in prison.
Defendants Heinz-Jakob Neusser, a former systems development manager, and a former emissions expert identified as "Thorsten D.," received suspended sentences of 15 months and 22 months in prison, respectively.
A judicial panel in Braunschweig, Germany, entered its verdicts in the court that is located close to Volkswagen's headquarters in nearby Wolfsburg.
Panel chairman Judge Christian Schutz called the defendants a "gang" and said they were guilty of "particularly serious" fraud, the New York Times reported.
He said Hadler knew of the emissions-testing defeat devices that manipulated software to ensure the vehicles would pass emissions tests since at least September 2007.
Only a relatively small number of people within Volkswagen knew of the device's existence, according to emails used as evidence in the case.
The trial lasted almost four years in the "dieselgate" emissions scandal that was exposed when the U.S. Environmental Protection Agency in 2015 reported many diesel-powered VW models contained deceptive emissions-monitoring devices, Politico reported.
The "defeat devices" detected when system emissions testing was underway and automatically adjusted engine performance to ensure the respective vehicles met environmental standards.
Berlin's Federal Court of Justice in 2020 ordered Volkswagen to pay up to $31,000 to each of about 60,000 German owners of diesel-powered VWs.
The automaker paid billions of dollars in settlements for installing defeat devices on about 10 million vehicles sold in the U.S., Germany and other markets around the globe.
Legal cases remain open against 31 other defendants, but former VW Chief Executive Officer Martin Winterkorn is not among them due to health concerns, MarketWatch reported.
Winterkorn has denied any wrongdoing in the matter.

Puma shares plummeted 18% Friday after the German sportwear brand posted worse-than-expected second-quarter sales and cut its full-year guidance, flagging the impact of U.S. trade tariffs. In a preliminary updated after markets closed on Thursday, the retailer said it expects full-year sales to decline by a low-double digit percentage this year, compared with its prior forecast of sales growth in the low- to mid-single digit range. Puma also said it expects to post an operating profit loss in 2025 — a huge swing from the 445 million euro ($523 million) to 525 million euro profit it forecast prior to assessing the impact of tariffs. The company's shares were down 18.4% by 8:23 a.m. London time (3:23 a.m. ET). "Amid ongoing volatile geopolitical and macroeconomic volatility, Puma anticipates that both sector-wide and company-specific challenges will continue to significantly impact performance in 2025," the company said in a statement. "Key factors include muted brand momentum, shifts in channel mix and quality, the impact of U.S. Tariffs, and elevated inventory levels," it added. The company said U.S. tariffs were expected to have a mitigated negative impact on 2025 gross profit of around 80 million euros. Preliminary sales meanwhile fell 2% year-on-year on a currency adjusted basis in the second quarter to 1.94 billion euros ($2.27 billion), below the 2.06 billion estimated by analysts in an LSEG poll. Quarterly adjusted operating profit, excluding one-time costs, logged a loss of 13.2 million euros. Puma incurred one-time costs, including related to its cost efficiency program, of 84.6 million euro in the second quarter.

BERLIN (Reuters) -Volkswagen on Friday gave its first assessment of how U.S. President Donald Trump's trade war with Europe is expected to impact its 2025 earnings after tariffs dealt a blow to the German auto giant's operating profit in the second quarter. Europe's biggest carmaker now expects an operating return on sales in the range of 4-5%, compared with a previously forecast 5.5-6.5% range, the company said, giving its long awaited assessment of the impact of tariffs on its business. Full-year sales are now expected to be level with the previous year. The company had previously forecast a rise of up to 5%. Caught in the crosshairs of Trump's trade salvo on Europe, Volkswagen and its peers are pressing European trade negotiators to strike a deal to replace a 25% tariff on their cars in place since April.
