Telangana high court wants info on Bhoodan land donated so far and its current status

Hyderabad: Justice K Lakshman of Telangana high court on Wednesday directed the Bhoodan Board and the state govt to furnish to the court details of land donated by various donors under the Bhoodan Movement in the last 75 years and its current status along with particulars of the redistribution of the land by the state to the landless.
The judge was wondering whether the Bhoodan Board will be able to display any willpower to protect even a square yard of Bhoodan land in the state. While one petitioner in this case is seeking a CBI probe, the other was seeking a probe under the Commissions of Inquiry (COI) Act.
The Bhoodan Movement, a voluntary land reform movement, was initiated by Acharya Vinobha Bhave from Pochampallay village (now in Yadadri Bhuvanagiri district) in 1951.

Conveying the stand of the state, additional advocate general T Rajanikanth Reddy informed the court that they were ready to appoint a COI probe if the court orders a statewide probe on all the Bhoodan land issues. However, he clarified, "we are opposing any such probe in the current case, because the petitioners are espousing a private cause".
The judge was hearing pleas by two petitioners who sought a probe into the way Bhoodan land in Nagaram village in Rangareddy district was sold to scores of IAS and IPS officers.

Earlier, the high court had directed the state to keep the subject land in the prohibited list till further orders.
The bureaucrats, who purchased the land, approached the court urging it to vacate the restraint order. They said that the petitioners were seeking irrelevant reliefs with unconnected facts. There are four survey numbers in the village and the land they purchased has nothing to do with Bhoodan land. They also contended that the petitioners later started raising new contention that the land was not Bhoodan land but govt land.
The counsel for one of the petitioners, who was seeking a probe under the CoI Act, did not turn up for Wednesday's hearing and a proxy counsel sought time to present their case.
Senior counsel P Sri Raghu Ram appeared for the bureaucrats and said that the petitioners have no locus standi to raise the issues. They came to court without any material to make out a case, he said. Urging the court to vacate the restraint order, he said that courts could grant prohibitory orders only when the petitioners have any legal right over the land. "Courts can give such orders only when there are any legally enforceable rights under Article 226 of the Constitution," Sri Raghu Ram said.
The judge posted the case to Thursday for further hearing.

PRAYARGRAJ: The Allahabad High Court has directed that status quo be maintained with regards to the demolition notices issued by Ghaziabad Development Authority ( GDA ) over alleged illegal properties built on public land. Hearing a writ petition, a division bench comprising Justice Mahesh Chandra Tripathi and Justice Prashant Kumar granted time to the district administration and GDA to place on record how they intend to rehabilitate the old inhabitants of the properties. The court also restrained the petitioners from creating any third-party interests or undertaking any development on the disputed property. The court also observed, "In the facts and circumstances of the case, we also find that it is not in dispute that the petitioners have been occupying the place for the last 40-50 years." "At this stage, we find that some indulgence and reprieve is to be accorded to the inhabitants who belong to the weaker sections of society and we further direct the authorities to ensure the formulation and implementation of a rehabilitation scheme for such persons," it said. The bench said the rehabilitation scheme shall be provided by the district administration and the GDA in the next hearing. The next hearing is listed for August 22. The petitioners filed the present writ petition for quashing the demolition notice dated June 16, 2025, issued by the GDA under section 26-A of the UP Urban Planning and Development Act, 1973. The GDA initially issued notice to 172 illegal occupants of public land on September 6, 2024, which is earmarked in the master plan. Consequently, 89 persons filed their objections which were considered and the impugned order (order under challenge) was passed. During the course of hearing, the counsel for the petitioner submitted that the petitioners are old inhabitants and in absence of any rehabilitation scheme as per the law, the old inhabitants, who are occupying small pieces of land for their shelter and admittedly belong to the lower sections of society, will suffer irreparable loss, if uprooted. After hearing both sides, the court in its order dated July 31 passed the above directives and observed, "It is informed that in response to the earlier court's order, till date the GDA has not taken any remedial measures to rehabilitate the persons who were in illegal occupation for the last 40 years."

Udupi: Deputy commissioner Swaroopa TK said that the govt has already issued a circular granting certain exemptions for single-site plan approvals in the public interest. The DC instructed the engineers of the rural planning department to implement this as per the rules. The DC was speaking while presiding over a meeting held to discuss the issues faced in single-site plan approvals and Form 9/11 in the district on Saturday. Due to the geographical features of coastal areas, it is often not possible to widen roads. In such cases, the govt has issued a circular allowing competent authorities to grant exemptions during design approval. Approval should be granted as per the rules, she said. There were complaints that despite the public submitting applications to the concerned departments for single site plans and Form 9/11, there are delays in obtaining them. Applications should be processed on a priority basis, he added. Karkala MLA V Sunil Kumar said that the govt considers the local geographical area of the district from an administrative perspective and grants certain exemptions. MLA Kiran Kumar Kodgi said that there is a belief among the public that it is not possible to obtain single-site approvals for constructing their buildings in the urban planning authority. The issues found in the submitted applications should be patiently listened to and resolved to facilitate the public, he said. Zilla panchayat CEO Prateek Bayal said that there are complaints about difficulties in obtaining single layout design approval for plots granted under 94C and other approvals provided by the govt for the poor. The circular already issued by the govt precisely indicates what can be exempted. Approval should be granted accordingly, he said.
