Regional SA councils struggling to pay for roads call for fairer funding model
Wakefield Regional Council is responsible for a 2,687-kilometre road network, which is longer than the distance between Adelaide and Perth.
The council has a lower-than-average population of 6,780 people.
It means the council has a lower annual revenue to fund road projects.
"Three or four years ago we did a complete analysis of our road network and we worked out we had a $16 million backlog of road upgrades waiting for us," Mayor Rodney Reid said.
He said the council created a program to address the backlog by allocating additional money every year for a 10-year period.
"Even then, after 10 years, we won't get it back to zero, that's the level of difficulty a regional council like us faces," Mr Reid said.
He said the funding demand for road upgrades and maintenance meant the council had to put off other projects.
"We've got masterplans for various sporting precincts and we can't really do anything on it unless we get specific funding for it," he said.
Councils receive money from the South Australian Grants Commission, which the state government funds.
The federal government funds the state government.
Mr Reid said he had written to the grants commission asking for a fairer system for regional councils.
The commission said it was examining the distribution process to ensure it was fair.
"The commission is currently looking at elements of this methodology, including the proposal put to it by the Wakefield Regional Council regarding the distribution of identified local road grants," a spokesperson said.
A state government spokesperson said the commission was an independent body that made recommendations for the distribution of grants in accordance with Commonwealth legislation.
South Australia receives 5.5 per cent of the identified local roads grants component of financial assistance grants.
However, South Australia's population represents 7 per cent of the nation's total population.
It has 11.7 per cent of the nation's local road network.
The Mid Murray Council has a population of 9,160 people and the second largest road network in the state at 3,386km.
Its chief executive, Simone Bailey, said regional councils did not receive enough funding from the federal government.
"A lot of that money from the feds is going to councils in the metro area, who don't need funding," she said.
A parliamentary inquiry is examining the sustainability of local governments, with an interim report from February highlighting a need for increased funding to Australia's 537 local governments.
Wakefield Regional Council received $4.7 million over five years through the federal government's Roads to Recovery program, while Ms Bailey's Mid Murray received $5.8 million.
The City of Onkaparinga in Adelaide's south, which received $20.9 million, is responsible for a smaller road network of 1,530km.
Ms Bailey said her council's cost-cutting measures, such as closing the Mannum Pool last summer, had hit communities hard.
"It was costing us $35,000, which, maybe to some other councils that's not much but for us, it's a lot," she said.
"We're not like city councils where we can have huge parking stations or other forms of income.
"It was one of the hottest, driest summers on record and the town of Mannum didn't have a pool."
A total of 0.51 per cent — $3.45 billion — is allocated to local governments in this year's federal budget, with some council funding put up for tender as competitive grants.
Southern Mallee Council Mayor Ron Valentine said a tender system favoured larger councils.
"It's prejudicial against small councils like ours because the big players in town, big growth councils, have professional grant writers, directors and all the support teams to be able to come up with really great glossy tenders," he said.
"Even if we wanted to put a tender in, it's problematic because we don't have all those assets to put to it.
"And then, there's no guarantee you're going to get the money."
Mr Valentine said he had raised his concerns with federal government representatives.
He said the government already knew who needed funding.
"What's not coming is enough money from the federal government to do it," he said.
Federal Minister for Regional Development Kristy McBain said the government had initiated the Parliamentary Inquiry into the Financial Sustainability of Local Government, which was the first of its kind in two decades.
"We look forward to receiving the final report of the inquiry," she said.

Adelaide City Council plans for 50,000 CBD residents without 'destroying the city'
South Australia's first appointed town planner, Charles Reade, was a prominent exponent of "garden cities" — an early 20th century urban planning movement that emerged in response to the overcrowding in British cities during the industrial revolution. Mr Reade, a New Zealander, envisaged cities surrounded by green space, combining the best of urban and rural living. In 1914, before his appointment by the SA government, he toured Australia to spruik the concept, and the Adelaide City Council gave him access to Town Hall to deliver a lecture. Unbeknownst to the council, the title of Mr Reade's presentation was: "Garden cities versus Adelaide slums and suburbs". It was to be an exhibition of the poor state of the city's housing with images of dilapidated alleys and overcrowded backyards projected to the audience on lantern slides. It caused outrage. "NO SLUMS IN ADELAIDE," read The Advertiser front page the next day, quoting an indignant Acting Mayor of Adelaide Alderman Cohen. "We have long held the reputation of being the Garden City of Australia," Mr Cohen reportedly said on October 5, 1914. "I therefore give this statement as to the existence of slums in Adelaide a most emphatic and strong denial, and I defy Mr Reade or anyone to point out the existence of any slums in our city." The slums controversy came in a year when the population of the Adelaide CBD had swelled to a record 43,000 people – more than double the population estimated to be living within the CBD today. Now, the council wants to return to its 1910s population peak. Town Hall adopted a "City Plan" last year that targets 50,000 residents living in the CBD and North Adelaide by 2036. Lord Mayor Jane Lomax-Smith said the target reflects "the need to repopulate the city". "Setting a target of 50,000 means we'll be going back, back to the future, back to the sort of numbers we had in the last century," she told the ABC. Returning to 50,000 residents does not mean returning to the days of slums, Dr Lomax-Smith argues. "There's always progress in building development and the way people live," she said. But the population growth will, according to others, require a fundamental change to Adelaide's skyline. A 2023 council report found that accommodating even just 46,300 residents by 2041 could require building thirty-six 36-storey towers. The city currently has three. Meanwhile, the City Plan outlines that 1,000 new dwellings a year — or 2.7 homes a day — will be needed to reach the 2036 target. "If we were to achieve a doubling of our population in just 11 years, there would have to be cranes in the sky all over the central part of the city," said Greg Mackie, former chief executive of the History Trust of SA and a former city councillor. "But there's a massive amount of potential latent developable sites in the CBD, particularly if you think about the western end." The City Plan forecasts that the West End, including areas around Grote Street, West Terrace and Whitmore Square, can accommodate more than a third of the population growth needed to reach 50,000 residents. But other areas like North Adelaide, North Terrace and the East End are earmarked for much less growth, partly due to their high-level of heritage protection. "To get to 50,000, we don't want to destroy the city," Dr Lomax-Smith said. "It would be easy if we just demolished every building in the city and built tower blocks — 50 tower blocks, easy, get to 50,000 — but they would probably be mainly single-person units, and it would damage the character of our city. "One of the most important things is to protect the quality of life." Finding space for 50,000 residents is one thing — getting them to live in a city is another. "Australians on the whole have not been used to living in a house without a garden and off-street parking," Dr Lomax-Smith said. In the decades after Charles Reade lectured Adelaide about its slums, families flocked to the suburbs in search of more space. From 1947 to 1972, the city's population dropped from about 35,000 to 14,000, according to the council's archives. "Everyone was concentrated on building a house on a quarter-acre block and having their own place to live with their families," said Professor Emma Baker, director of the Australian Centre for Housing Research at the University of Adelaide. "So, there was kind of a gutting out of the city over those years, and it probably reached the kind of peak in the 1980s." While the CBD's population is growing again, it is more to do with migration and international students than suburban families attracted to city living. Most City of Adelaide residents either live on their own (40.8 per cent) or with their partner (25.6 per cent), according to the 2021 census. Just 8 per cent of city households — 970 in total — are couples with children. "The city has become a place where young people live maybe temporarily while they're studying," Ms Baker said. "About a quarter of the people who sleep in the city every night are students, so that's roughly the same proportion that Cambridge has. "So, we're a student city, we're a rental city, and people tend to … move into the city, live there for a while and move out later on as they get older." It's a vastly different picture than the early 20th century when big families lived in small city houses, or "slums". The average size of an Australian household in 1911 was 4.5 people; it is now just 1.7 in the City of Adelaide. Planning Institute of SA president Cate Hart said without families in the city, "what the city council is trying to strive for won't occur". "Single bed apartments to meet a student demand is not going to reach your 50,000 people," she said. "You actually need to build development that will accommodate three and four people per household." Ms Hart, who supports the council's plan, argues the public and private sector need to drive a "culture of living in the city" through good design and a diversity of housing. "Apartment living is not for everybody, and cookie cutter apartments will not drive a new culture," she said, adding that the city would need townhouses, "shop top living" and mid-rise development. The council will need help from the private sector to reach its target, but pulling off a major housing project within the CBD is not always easy. "It's not enough to just zone an area and think 'job done'," said Planning Minister Nick Champion. "Because the nature of private development is it comes in fits and starts, they have to get feasibility and capital, and they have to struggle against construction costs which are quite high at the moment." Further complicating matters is that the City of Adelaide is not the only local government area with housing growth on the horizon. The whole of Greater Adelaide will need another 315,000 houses by 2051, according to the state government's 30 Year Plan released last year. Around a third of this growth is earmarked for the sprawling northern suburbs. Jamie McClurg, executive chair of a real estate developer, said the suburbs are "typically a safer investment" for developers. "Certainly, those sort of markets are easier to produce and deliver stock," he said. It comes as his company nears completion on a major mixed-use apartment development on the former North Adelaide Le Cornu site. The land stood vacant for more than 30 years after various development plans fell over. "There's available land that can be just developed on straight away — it tends to be caught up in a lot of conversations and not probably enough action to my mind," Mr McClurg said. He is sceptical that the 50,000 population target will be reached. "I think that we have seen through the last couple of decade people set targets and not be responsible for achieving them," he said. "I just would expect the people that are leading us to understand the math that they're committing to and deliver on it."

Lawyer for ATO whistleblower Richard Boyle urges court not to impose convictions
An Australian Tax Office whistleblower has argued he should be spared convictions because he was motivated by public interest, and his actions led to change within the federal agency. Former debt collection officer Richard Boyle went public with concerns about the culture at the ATO in 2018 — marking the start of a years-long legal battle. He had faced 66 charges but over time many were dropped, before he in May pleaded guilty to four counts under a deal struck with prosecutors. At a sentencing hearing on Friday, prosectors said Boyle's offending constituted a serious breach of privacy, and a period of imprisonment was warranted — but they were not opposed to the term being suspended. Boyle was charged after he made a series of allegations on the ABC's Four Corners program, including that his area was instructed to use heavy-handed tactics on taxpayers who owed the tax office money. Over the years since he spoke out, Boyle had made several failed attempts to secure immunity from prosecution using whistleblower protections. He eventually pleaded guilty to disclosing protected information, making a record of protected information, using a listening device to record private conversations and recording another person's tax file number. Defence counsel Steven Millsteed KC said the court should recognise Boyle was not acting out of any nefarious motivation, self-interest or malice. Instead, he was guided by a "sincere belief that he was acting in the public interest". "His conduct, though unlawful, was grounded in a moral courage and a deep commitment to public service," he told South Australia's District Court. Mr Millsteed added that the allegations raised by Boyle "did some public good". "It resulted in the Inspector-General of Taxation conducting an investigation into the ATO's use of garnishee notes, and changes were made in respect of that," he said. In urging the court not to record convictions, Mr Millsteed said the ongoing legal action had taken a toll on Boyle's family, financial situation and mental health. Prosecutor Nick Robinson KC said Boyle's motivations did not change the fact he acted unlawfully. "This is the court of law, not the court of morals," he said. He said Boyle's actions were long-running, criminal and threatened the protection of privacy and commercial interests. Mr Robinson said general deterrence should be factored into his sentence, and urged Judge Liesl Kudelka to record convictions against him. Boyle shook his head from the dock as Mr Robinson disputed the submission that he was remorseful for his actions. Outside court, Whistleblower Justice Fund founder Rex Patrick said the lengthy legal proceedings had taken a toll on Boyle. "Richard has been dragged to hell and back," he said. "The message it sends anyone who's sitting inside the public service who wants to blow the whistle [is] that you should not do this. This is going to wreck your life." Mr Patrick said he hoped Judge Kudelka would record no conviction. "Then Richard can get on with his life," he said. Boyle did not make any comment as he left court with his supporters — some of whom became visibly distressed during the hearing. He will be sentenced later this month.

Leaked emails reveal National Trust SA's dispute with volunteers over 'service fee'
A group of South Australian National Trust branches is protesting a new "service fee" on their earnings, imposed by the heritage group's head office. Then-chief executive Simon Ambrose contacted the state's 45 volunteer-run branches in April, advising the organisation would invoice them for 10 per cent of their gross annual revenue. According to Mr Ambrose's email, the annual fee would "address the increasing demands of our operating environment", including auditing and tax compliance. However, an email obtained by the ABC between Kingston SE branch chair Alison Stilwell and her counterparts from other branches indicated a pushback from the volunteer base. On July 7, Ms Stilwell wrote that a meeting with the NTSA Council — its board of directors — "did not offer any change to the service fee arrangement". "I am disappointed and have expressed that to the president, vice-president and interim CEO," Ms Stilwell wrote. "I've spoken at length with [President] Millie Nicholls, and she is going to ring or visit branches to explain and discuss." Ms Stilwell, also a council member, is understood to be mediating between management and volunteers. She said she received feedback about the plan from 31 branches. It is not suggested all feedback was negative, but Ms Stilwell said it indicated there was "a lot of work to be done" and she was "continuing to push for a better outcome". "My feeling is that despite things not being as we'd have hoped now, there will be changes not far away," she concluded. Ms Stilwell referred questions to the NTSA head office. The National Trust maintains more than 100 heritage-listed properties across the state, including landmarks such as Ayers House, Stangate House and Z Ward Glenside. It is currently attempting to secure UNESCO World Heritage status for the Cornish mining sites in Moonta and Burra, and has campaigned to keep Mintaro's Martindale Hall in public ownership. In a statement, NTSA president Millie Nicholls said the service fee was "part of an internal effort to ensure the ongoing success of the trust by supporting essential functions such as consolidated auditing, insurance, and financial compliance". "While the fee has been issued, we are continuing open discussions with branches to address concerns and clarify the benefits of centralised support," Ms Nicholls said. "Feedback is being incorporated and further engagement is planned over the next few months." The ABC also became aware that the trust this year sold an empty parcel of land in Moonta and was in discussions about the future of the 19th-century National Australia Bank building in Burra. In response, Ms Nicholls said the charity was aiming to "strengthen its financial sustainability" by "reviewing under-utilised assets", as well as seeking income through events, accommodation and donations. The ABC spoke with volunteers from 10 National Trust branches, none of whom wished to be identified. Branches said their biggest costs were insurance, utilities bills and general maintenance, and the service fee invoices ranged between several hundred dollars and five digits. None reported any preliminary consultation, but Ms Nicholls said branch meet-ups and communications occurred several months prior. One volunteer said they believed the need for a new charge was not properly communicated. "We were willing to acknowledge that they might have to operate differently, but they haven't explained how they calculated this figure," they said. "That means that we can't explain it to our members … so that level of accountability is missing." Ms Nicholls said the overall amount was "tied to the workload for managing each branch's operations". Several volunteers said they were holding off on paying in anticipation of a compromise.
