ANCYL welcomes sentencing of Sindiso Magaqa's killer

The African National Congress Youth League (ANCYL) has welcomed the sentencing of Sibusiso Ncengwa, the hitman who murdered its former secretary-general Sindiso Magaqa.
Magaqa was ambushed and shot multiple times on 13 July 2017 for blowing the whistle on corruption in his hometown of Umzimkhulu in KwaZulu-Natal, where he was also a councillor at the time. He later died in September the same year at the age of 35 as a result of his injuries.
Last week, Ncengwa pleaded with the Pietermaritzburg High Court not to impose a life sentence as he has already spent eight years in prison. However, on Monday, 7 July, the High Court imposed an effective sentence of 25 years' imprisonment on Ncengwa for his role in the 2017 assassination that sent shocking waves across the country, along with related charges.
The National Prosecuting Authority (NPA) in KwaZulu-Natal said Ncengwa was sentenced to 25 years imprisonment for conspiracy to commit murder, 25 years imprisonment for murder, five years imprisonment for each of the three counts of attempted murder, three years imprisonment for each of the three counts of malicious injury to property, five years imprisonment for unlawful possession of a prohibited firearm, five years imprisonment for unlawful possession for firearm and 1 year imprisonment for unlawful possession of ammunition. The court ordered that the sentences run concurrently, resulting in the effective sentence of 25 years' imprisonment.
The ANC Youth League said this sentencing is a long-overdue but crucial step toward justice, accountability, and the truth behind the politically motivated murder of a dedicated revolutionary and fearless youth leader.
ANCYL secretary-general Mntuwoxolo Ngudle said Sindiso Magaqa was a brave and principled cadre of the ANCYL who represented the finest traditions of activism, truth-telling, and resistance to corruption.
Ngudle said Magaqa paid the ultimate price for standing against wrongdoing, particularly in local government, and his murder was a devastating blow to the Youth League and broader democratic movement.
'While we welcome this sentence, the ANCYL remains deeply concerned by the web of alleged political conspirators who remain unaccountable. The confession made by Ncengwa implicates high-ranking individuals, including municipal officials and political figures.
'We therefore call on the National Prosecuting Authority (NPA) and law enforcement agencies to move with urgency in pursuing every lead and ensuring that those who planned and financed this assassination are brought to book,' he added.

The family and National Prosecuting Authority (NPA) welcomed the 25-year prison sentence handed down to Sibusiso Ncengwa at the Pietermaritzburg High Court on Monday. In deviating from the life sentence, Judge Nontuthuzelo Mlaba sentenced Ncengwa, who is already serving a lengthy sentence for unrelated crimes, to 25 years for conspiracy to commit murder, 25 years for murder, and shorter terms for attempted murder, malicious damage to property, being in possession of illegal firearms and ammunition. All sentences will run concurrently. Ncengwa is now expected to testify against the two other accused, who were allegedly present during Magaqa's shooting on July 13, 2017. 'The NPA is glad and we are happy for the sentence passed in court, which will be effectively 25 years imprisonment,' said NPA spokesperson Natasha Ramkisson-Kara. Ncengwa's two accomplices were former police officer Sibonelo Myeza and businessman Mbulelo Mpofana. The third accomplice, Mlungisi Ncalane, will not see his day in court as he was declared mentally unfit to stand trial and has been confined to a mental institution. 'The offences were very serious,' said Ramkisson-Kara. Ramkisson-Kara said police will have to investigate former senior Mzimkhulu Municipality officials whom Ncengwa implicated in his affidavit as having conspired and hired hitmen to kill Magaqa. One of the alleged conspirators was the late former Mzimkhulu mayor, Mluleki Ndobe, who was later elected as the ANC provincial treasurer after the murder. Ndobe died on November 6, 2020. Had it not been for his admission of guilt and offer to testify for the state, having already served eight years in detention for this matter, and having apologised to Magaqa's family, Ncengwa would have received a life term, which was the minimum sentence appropriate for a crime of this nature. Judge Mlaba accepted the deviation from the prescribed minimum sentence, which Ncengwa's defence team and the State agreed on. Lwazi Magaqa, a spokesperson for the Magaqa family, told the media that the family was happy, although the punishment would not bring Magaqa back to life. 'The day we have been waiting for, the sentencing of the hitman has finally arrived. 'As the family, we see the light, and the sentence is fit for (such a) brutal offence. 'Sindiso's children are still without a father, his mother is still without a son, as the family we still don't have a brother, and the ANC is still without its member,' said Magaqa. Two councillors, Jabulile Msiya and Nonsikelelo Mafa, who were with Magaqa during the attack at a car wash, were also shot but survived. 'We have been crying for justice to be served, and this is only the beginning of what will follow. 'Magaqa's mother always cries, this sentence might help her to find closure,' said Msiya. During the mitigation of his sentence last week, Ncengwa confessed that a day before the shooting, he visited Mzimkhulu from Durban to confirm Magaqa's identity. On the day of the murder, he spotted Magaqa arriving at the car wash he often frequented.

With suspensions, commissions, and political shielding on the table, will Mkhwanazi meet the same fate as Vusi Pikoli? Towards the end of former president Thabo Mbeki's rule, explosive allegations were made against then national police commissioner Jackie Selebi. Selebi was not only a top ruling party member, but the former United Nations ambassador was also at the time president of Interpol, the international crime fighting organisation. When the head of the National Prosecuting Authority, Vusi Pikoli, attempted to effect arrest and search warrants against Selebi, it resulted in his own suspension and later firing. On Sunday, KwaZulu-Natal provincial police commissioner Lieutenant-General Nhlanhla Mkhwanazi made similarly explosive allegations of possible criminal conduct by sitting Minister of Police Senzo Mchunu and head of this country's detectives, Shadrack Sibiya. Mkhwanazi made the public allegations that much like Selebi back in the day, the top politician and cop have direct relationships with bosses of crime syndicates who have been linked to drug cartels and assassinations. Selebi was temporarily shielded from arrest by the immediate suspension of Pikoli by Mbeki, whom, it was alleged, was a close friend and confidant of the police commissioner. It is widely accepted that President Cyril Ramaphosa owes his first term as president to, among others, Mchunu and former deputy president David Mabuza who died last week. And the question uppermost in everyone's mind is: will Ramaphosa follow in Mbeki's footsteps to first shield his political ally Mchunu and, second and most importantly, put in motion steps that might result in the end of the career of Mkhwanazi? It is not every day that a provincial police commissioner alleges that his political principal has been caught out in a lie to parliament about being an associate of an alleged crime syndicate boss. The easiest way to make all these unsavoury allegations go away is to get rid of the one making the allegations, by either removing them from their position or, as is common in mafia movies, make him an offer he cannot refuse – resign or be killed. The president's way of shielding those close to him politically is to 'apply his mind' to matters. It will not shock anyone if he institutes a commission of inquiry into Mkhwanazi's allegations, while Mchunu and Sibiya continue in their jobs and Mkhwanazi is sidelined. Mkhwanazi's allegations, if not proven untrue in an official manner, will confirm that the descent of this country into a mafia state is in full swing. It is known that kidnappings have now become an accepted daily occurrence. The recent assassination of financial forensic investigator in the Ekurhuleni metropolitan municipality showed that the murder of Babita Deokaran under similar circumstances was not the first, nor the last. These crimes will continue because those in charge protect the criminals. There are calls for Mkhwanazi to follow 'the proper' police channels and not act 'rogue'. Those people must ask Pikoli what following the proper channels did for him and his career. Mchunu and Sibiya can easily refute the allegations made by Mkhwanazi under oath. And if they prove him to be a loose cannon who is out to destroy their careers, he will pay the price. But people deserve to know that this country is not being run by criminals with a badge. The self-confessed killer of former ANCYL secretary-general Sindiso Magaqa was sentenced to an effective 25 years' imprisonment by the Pietermaritzburg High Court on Monday. Sibusiso Ncengwa was convicted after he pleaded guilty to murdering Magaqa in 2017. He was sentenced to 25 years for conspiracy to commit murder, 25 years for murder, 15 years for three counts of attempted murder, nine years for malicious damage to property, 10 years for unlawful possession of a firearm and one year for possession of unlicensed ammunition. The sentences are to run concurrently. Ncengwa is already serving 95 years in prison for armed robbery convictions. His defence lawyer, advocate Andrew Matlamela, had pleaded with the court to hand down a lenient sentence, saying his client had shown remorse by pleading guilty. However, the prosecutor, advocate Elvis Gcweka, told the court Magaqa's family is battling to come to terms with their loss and his mother breaks down in tears when her son's death is brought up. Three other co-accused —Sbonelo Myeza, Mbulelo Mpofana and Mlungisi Ncalane — were charged with conspiracy to murder, murder, attempted murder, possession of unlicensed firearms and ammunition and malicious damage to property. Ncalane has been declared unfit to stand trial after two psychiatric reports revealed he was mentally ill. He is a patient at Napier Hospital in Pietermaritzburg.
