Karnataka HC quashes gag order on online media channel over Dharmasthala case reports

The Karnataka High Court on Friday quashed a gag order on Mangaluru-based online media channel Kudla Rampage related to its reports on the Dharmasthala 'secret burials' case.
'The concerned court, at the threshold and without the benefit of adversarial hearing, has ventured to grant a sweeping mandatory injunction, a relief which ordinarily ought to await the culmination of the trial,' Justice M Nagaprasanna said, remanding the matter to the lower court to be heard afresh.
The court also came down strongly on some of the reasoning in the gag order. 'The impugned order though spanning multiple pages, conspicuously lacks the foundational reason……the order may span pages, but spanning pages has not depicted application of mind. It is application of mind that is required, in a reasoned order, and not application of ink,' Justice Nagaprasanna added.
The Additional City Civil and Sessions Court in Bengaluru had on July 18 granted an ex parte injunction to delete 8,812 links related to the Dharmasthala burials case. The injunction was based on a petition filed by Harshendra Kumar D, brother of BJP MP D Veerendra Heggade and secretary of the Shri Dharmasthala Manjunatheshwara Educational Society.
The channel's counsel, A Velan, had argued that an injunction, which was doubtful at the closing stages of the case, had been granted in the interlocutory stage itself, and said that this was violative of the Civil Procedure Code (CPC).
Arguing that it was a case of restraint on freedom of speech, he further pointed out that there was no reasoning behind passing a 'John Doe' order in this case. John Doe orders are orders where a defendant is unknown. Velan also asserted that the order, in a matter of public importance, was creating a perpetual gag order on future speakers.
Representing Harshendra Kumar, senior advocate Udaya Holla argued that the petition by Kudla Rampage was not permissible under Article 227 of the Constitution, as the petitioner had not availed the remedy under the CPC to vacate the order. He also stated that the high court had twice directed the channel to be banned, stating that in a case which was being investigated, it was producing defamatory content projecting Kumar to be guilty and creating defamatory content.
The bench stated that the injunction at this stage had the character of a final order, explaining, 'The impugned order…while ostensibly couched as an interim measure, in truth and effect, partakes the character of a final determination.'
The bench also pointed out multiple Supreme Court precedents with regard to the type of reasoning required for passing an ex parte order or interim injunction in such cases.
The court also clarified that 'John Doe' or 'Ashok Kumar orders', as they are known in India, ought to be granted only with great caution, observing that the current order was wide enough that any voice against Kumar, his family or the location of the incident would be caught in it.
The court added, 'The order speaks of prohibition of defamatory statements. Not one word of what kind of statements are defamatory for the Court to pass the aforequoted order is found in the order.'
The court then quashed the ex parte order as far as it pertains to Kudla Rampage.

Speculation has been rife that the MNS and Shiv Sena (UBT) will form an alliance for the upcoming polls after Raj and Uddhav addressed a joint 'victory rally' last month to celebrate the Mahayuti government's decision to withdraw a controversial order making Hindi the default third language in primary schools. The rally was the first time in nearly two decades that the two cousins were seen together in public after Raj left the undivided Shiv Sena in 2005 and set up the MNS, allegedly due to differences with Uddhav. Raj also visited Uddhav's residence, Matoshree, last month to wish him on his 65th birthday, setting more tongues wagging.

Bengaluru: The Justice HN Nagmohan Das Committee on internal reservation among Scheduled Castes (SCs) submitted its final report to the govt Monday, marking a key step in the state's move to rationalise SC quotas based on empirical report, which contains six major recommendations, was formally received by chief minister Siddaramaiah and will be placed before the cabinet on Thursday for further consideration. Sources say the report recommends an allocation of 6.5% for SC (Left), 5.5% for SC (Right), 4% for 'untouchables', and 1% for other nomadic Das told TOI that since there was no reliable data on SC sub-castes, the commission undertook a fresh state-wide survey. This data forms the basis of the panel's recommendations."The govt agreed to our interim recommendation of having a fresh SC survey which was held between May 5 to July 6," Justice Das said. "The survey was conducted across 27.2 lakh families and just over 1 crore people. We have done our job and the govt is vested with our report to take further action."He also pointed out that his earlier report had suggested raising the overall SC quota in Karnataka from 15% to 17%, and this premise has also influenced the internal reservation framework recommended now."The 30-year-long struggle of communities seeking internal reservation came to a head when the Supreme Court on Aug 1, 2024 said providing internal reservation is permissible under the Constitution," Justice Das response to the Supreme Court's ruling, the Siddaramaiah govt, in Jan, formed a single-member commission headed by Justice Das. An interim report was submitted on March 27. The idea of internal reservation had also found traction during the previous BJP govt, which in Oct 2022, had proposed a similar matrix — 6% for SC (Left), 5.5% for SC (Right), 4.5% for 'touchables', and 1% for smaller final report submitted on Monday spans 1,766 pages and includes the panel's findings, the survey data, and supporting appendices.

STARTING TUESDAY, over 190 countries will get into a huddle in Geneva, Switzerland, to break an impasse and reach an agreement over the next fortnight on the first-ever Global Plastics Treaty that will create a legally binding framework to end plastic pollution, including in the marine environment. This will be the second installment of the fifth meeting of the Intergovernmental Negotiating Committee (INC-5) of the UN. Countries will push to address plastic pollution right from the production stage, which uses polluting oil and gas, to the challenges of plastic waste disposal and recycling. Negotiators will pick up from the previous meeting in Busan, South Korea, last December, where talks had collapsed over critical and unresolved issues. These issues and disagreements were over the draft treaty's provisions on putting a cap on production of polymers, elimination of harmful chemicals from plastic production and phasing out of harmful plastic products. As per the Centre for International Environmental Law, a US-based non-profit, the current draft text issued during Busan contains 370 brackets, which indicate areas of no agreement between countries. It was in 2022 in Nairobi that a resolution was adopted at the United Nations Environment Assembly to develop global rules to end plastic pollution. If successfully adopted, the treaty would be the most consequential one on environmental issues since the 2015 Paris climate agreement. The exponential growth in plastic production is one of the key drivers of plastic pollution. Globally, annual production has doubled, soaring from 234 million tonnes in 2000 to 460 million tonnes in 2019, while plastic waste has more than doubled from 156 Mt in 2000 to 353 Mt in 2019, as per a report of the Organisation for Economic Co-operation and Development. Production is likely to triple in a business-as-usual scenario by 2060, as per the UN EP. The talks on the global treaty will resume in the backdrop of a new Lancet report which said that 'plastics cause disease and death from infancy to old age and are responsible for health-related economic losses exceeding $1.5 trillion annually'. Civil society and environmental campaigners have termed the negotiations a once-in-a-lifetime opportunity to end plastic pollution and have called on countries to ensure significant cuts in plastic production.
