‘Reputation being tarnished': DNA to Karnataka HC in plea to quash judicial probe report on Bengaluru stampede

Event management company DNA Entertainment Tuesday expressed concerns in the Karnataka High Court about the damage to its reputation, and raised the issue of not receiving a copy during their submissions while challenging the Justice John Michael D'Cunha report on the June 4 Bengaluru cricket stadium stampede. A division bench of Justices Jayant Banerji and Umesh Adiga was hearing DNA's plea against the panel's report, submitted last Thursday, seeking to quash it. It also sought an interim stay on the implementation of its recommendations. Among the extensive findings and recommendations of the report are a recommendation for legal actions against DNA, Royal Challengers Bengaluru (RCB), the Karnataka State Cricket Association (KSCA), and police officers over the M Chinnaswamy cricket stadium stampede, where 11 people died. A meeting of the Karnataka Cabinet last Thursday, led by Chief Minister Siddaramaiah, had accepted the report. Recalling the events of the day, DNA's counsel Senior Advocate B K Sampath Kumar stated, 'It so happened that the function at the Vidhana Soudha drew a lot of crowds… at the behest of government officials and politicians, I wouldn't want to name them, the entire audience were asked to go to the stadium where the team was being facilitated.' Kumar also raised concerns regarding procedural aspects of the judicial inquiry. Referring to media reports seeming to have details of the judicial report and not the petitioners, he added, 'Panel holds so and so responsible for stampede. How do they (media) know about it? Against the names also….they are all named. Apart from that, TV9 has even published the names of all the people'. While noting that 'every second' the reputation of the petitioner was being tarnished, Kumar clarified that he was confining his submissions to the questions of right to reputation and natural justice. Meanwhile, Advocate General Shashikiran Shetty suggested that the matter be deferred to see the stand of the Chief Justice's bench in the matter, as it was hearing the suo motu Public Interest Litigation (PIL) in the Bengaluru stampede case. The matter is set to be heard again next Tuesday. Meanwhile, DNA requested a clarification before the bench of Chief Justice Vibhu Bakhru and Justice CM Joshi that the suo motu proceedings would not interfere with their petition before the other bench, while the court put on record that the Karnataka Government had sought time to put forward the SOP for managing large groups.

There is no legislation behind the creation of Sahyog portal, X argues in Karnataka High Court

The Karnataka High Court on Tuesday reserved its judgment on X Corp's challenge to central takedown orders issued for social media platforms under the Information Technology Act's section 79 (3) (b). In its closing arguments, X said there was no legal backing to the creation of the Sahyog portal, which it has called a 'censorship portal'. The Digipub News India Foundation, a non-profit organisation formed by digital news outlets, also made submissions before the single-judge bench of Justice M Nagaprasanna, which has been hearing the case. X has been arguing before the court that takedown orders against social media posts should be issued under Information Technology Act section 69A, and not section 79 (3) (b), stating that the latter section, along with certain rules, allows too much leeway for government officials to strip the 'safe harbour' provisions without a judicial process. 'Safe harbour' provisions protect intermediaries like X Corp from liability for content posted on their platforms by users. Objections have also been raised to the Sahyog portal, which the government has referred to as a way to 'automate the process of sending notices to intermediaries' but which X Corp has called a 'censorship portal'. The Centre has also argued that X is the only such intermediary not to join the portal. Making the last submissions for X in the case before the court, senior advocate K G Raghavan stated, 'Sahyog has no statutory backing and if there was a statutory backing, the law would have provided for it… upon consideration of the structure of the IT Act, it does not appear so.' He argued that section 26(2) of the IT Act indicated the circumstances in which such a website would be created, which was not found in the subsections of section 79 of the IT Act. He had also raised the possibility of conflict between the existing provisions, stating, 'Let us take a situation where one officer says 'I will use 79 (3) (b)'. Another officer says 'no, I should go under 69(A)' and all the procedure takes place – and the authority comes to the conclusion that it is not something we want to block… Direct conflict. This is exactly what should be prevented. 69(A) can be overridden by an officer sitting in any remote corner of the country.' Arguing on behalf of Digipub, senior advocate Aditya Sondhi stated, 'Even a subtle effort by the State….the right of a media house to hold land etc have all been found to be indirect methods of scuttling esteemed Solicitor General had placed some extreme examples of phishing, deepfakes etc to drive home the need for this sort of regulation. Extreme examples can make bad law.' He added, 'We need to deal with these, it cannot be disputed. But the use of the phrase 'unlawful act' in the rules being as vague…it is bereft of definition. If there is a need to fill a vacuum, it needs to be done legislatively and not in a roundabout manner.' The court subsequently reserved its judgment in the matter.

Bengaluru stampede: Karnataka revokes suspension of four police officers

The Karnataka government on Monday revoked the suspension of four senior police officers, including two Indian Police Service officers, against whom action was taken after the stampede outside the Chinnaswamy Stadium that killed 11 persons, The New Indian Express reported. The four officers are former Bengaluru Police Commissioner B Dayananda, Deputy Commissioner of Police (Central) Shekhar H Tekkannavar, Assistant Commissioner of Police (Cubbon Park Division) C Balakrishna and Cubbon Park Police Station Inspector AK Girish, Deccan Herald reported. While the officers have been reinstated with immediate effect, their new postings are not yet clear. #Breaking | Karnataka govt revokes suspension of ex-Bengaluru police commissioner B Dayananda and three others. Then Additional Commissioner of Police (West) Vikash Kumar Vikash's suspension stands as proceedings are underway at the #Karnataka High Court. @DeccanHerald — Prajwal D'Souza (@prajwaldza) July 28, 2025 A fifth official, the former Bengaluru Additional Commissioner of Police Vikash Kumar Vikash of the Indian Police Services, remains suspended as his case is being heard in the Karnataka High Court. He was in charge of stadium security, Deccan Herald reported. Vikash had approached the Central Administrative Tribunal to challenge his suspension. The CAT had quashed the suspension order, following which the state government filed an appeal before the High Court, where the case is pending. The tribunal is a quasi-judicial body to resolve the grievances of government employees. It had held in its July 1 order that the basis for such a conclusion was unclear as the order suspending the police officer did not explain how it came to the finding before the inquiry was completed. The stampede had taken place at Gate Number 3 of the stadium on June 4, where fans had gathered to celebrate the Royal Challengers Bengaluru's victory in the Indian Premier League. Eleven persons were killed and more than 50 were injured in the incident.
