The eThekwini Municipality has been given five days to pay R53 million to a service provider or face having its assets attached by the Sheriff of the Court.
Lawyers representing the service provider, Daily Double Trading, have stated they will not tolerate any further delays in this matter.
This situation follows the Constitutional Court's dismissal of the municipality's application for leave to appeal. The city is embroiled in a protracted battle with Daily Double Trading 479, trading as Pholobas Projects. At the centre of the dispute is an agreement reached between representatives of the City and those of the company.
The company was contracted to do work for the City however the municipality decided to terminate the contract. When the company challenged the cancellation of the contract in court, an out of court settlement was struck.
In terms of the agreement, which was dealt with by a lawyer representing the City, the company would be paid R30 million.
However, the City later disowned the agreement, arguing that the lawyer had no authority to enter into such an agreement on its behalf. The municipality fought the matter in court and lost; its final appeal to seek the right to appeal the earlier judgments was denied by the Constitutional Court. The City now finds itself obligated to pay the original R30 million plus millions of rand in interest.

Anusha Ganas, the attorney for Daily Double Trading, said the Constitutional Court has brought finality to the dispute that has dragged on since 2018.
'The current amount owed is now R53 million.'
A letter of demand sent to the municipality stated, 'The said calculation is as per the judgment of Pitman AJ amounting to a total sum due of R53,120,136.99. You will further note from the schedule that the increase escalates currently at the amount of R8,630.14 per day.
'We demand on behalf of our client that your client immediately effects payment of the total within five calendar days from the date hereof. Kindly ensure that this payment also provides for the additional daily interest accruing from 6 June 2025 to the date of payment. We reiterate that our client will not permit any further dilatory steps to delay justice.
'Should your client not effect payment into our trust bank account within the stated period, the Sheriff of the High Court will be instructed to immediately attach and remove assets to the value of the amount specified,' the letter concluded.
Councillors in the City have urged the municipality to comply with the court judgment and pay the service provider.
DA councillor Thabani Mthethwa stated: 'It is very unfortunate that the municipality has had to incur that expenditure. We encourage the mayor to table the report. We urge the municipality to comply with the court order while the council addresses the internal matters. We will have to review the court judgments and assess the reasons that led the judges to reach their decision, and we will determine if anyone should be held accountable for this. It is very unfortunate that the ratepayers will now have to bear the cost of this fruitless and wasteful expenditure.'
IFP councillor Mdu Nkosi stated that the city has no option but to comply with the judgment. 'We believe that we will be called by the mayor soon to engage us on this matter. Remember that the decision to challenge the matter in court was taken; the officials briefed us on their reasons at the time. But seeing that the judgment has been issued in this manner, we now have to engage with them again. This judgment is coming from the Constitutional Court; there is no other court beyond this one, so the council has to comply. What is very painful is that ratepayers' money will now be spent on this matter,' Nkosi said.

Four clubs that could sell their elite status to Comitis after Cape Town City's relegation

TS Galaxy owner Tim Sukazi and Cape Town City boss John Comitis have been good friends for some time. Now that Galaxy have been slapped with a hefty Fifa penalty, it may be a good time to sell. Photo: BackpagePix Cape Town City owner John Comitis, one of the wealthiest club bosses in the PSL, is reportedly actively exploring avenues to purchase the top-flight status of another club. This comes in the wake of City's relegation to the Motsepe Foundation Championship, following a disappointing play-off campaign. Born in Kinshasa, DRC, Comitis is a former professional player who turned out for Wits University, Jomo Cosmos, Hellenic, Cape Town Spurs, Vasco da Gama, and Korinthos FC in Greece. During a recent radio interview, Comitis reflected on the daunting challenge of fighting for promotion in the second tier. Said Comitis: 'The shortest route (buying a franchise) is the best route.' The sentiment echoes Comitis' initial entry into the PSL, when he acquired the status of Mpumalanga Black Aces and subsequently founded Cape Town City in July 2015. He has acknowledged the financial complexities involved and the potential backlash from sponsors, many of whom are hesitant to continue their backing while the club operates outside the top division. City currently have several sponsors on board, but Comitis confirmed they are likely to withdraw if the club competes in the second tier. Questions now swirl around which clubs might be willing to part with their top-flight status — a decision that would come with serious financial implications. While nothing has been confirmed, four clubs have emerged as potential candidates for Comitis' pursuit:

EFF demands Minister Tau explain ANC appointments to IDC board

The EFF is calling on Minister of Trade and Industry Parks Tau to explain the recent appointments of high-profile ANC figures to the IDC board, questioning the criteria and motivations behind these appointments. Image: Cape Argus Mzwandile Masina, chairperson of a Parliamentary Portfolio Committee on Trade, Industry and Competition, is mulling over a request by the EFF to summon Minister Parks Tau to appear before committee to be grilled on the appointments of prominent ANC figures to Industrial Development Corporation (IDC). Masina said on Sunday that he has responded to the EFF in writing, undertaking to provide a detailed answer within 48 hours after Monday, pending consultation with Parliament's legal advisors. The EFF had asked Masina to summon Tau to explain the appointment process for Ayanda Dlodlo, Dr Nomusa Dube-Ncube, and Dr Sydney Mufamadi to the IDC board, questioning the criteria used and suggesting the appointments are politically driven. Asked if he will grant the EFF's request and summon Tau to appear before the committee, Masina said: 'I have written to the EFF and undertook to respond fully in writing within 48 hours after Monday. This will be after receiving full legal counsel from Parliament.' Video Player is loading. Next Stay Close ✕ EFF national spokesperson and MP Sinawo Thambo expressed grave concern over the recent appointments of the three ANC loyalists to the IDC board. 'All three of these individuals are deeply entrenched ANC loyalists, with lengthy careers inside government structures under the ANC-led administration,' the party said in the letter to Masina. The EFF pointed out that Dlodlo has a history of serving in senior government positions as an ANC-aligned official, including stints as Minister of State Security and Minister of Public Service and Administration. The EFF also highlighted that Dube-Ncube is a former ANC-elected Premier of KwaZulu-Natal, while Mufamadi is a veteran ANC figure who remains deeply embedded in the party's political circles. Thambo said: 'It is further alarming that Dr Dube-Ncube was recently removed from a proposed appointment to the BANKSETA (Banking Sector Education and Training Authority) board, following concerns over the irregularity of her nomination. Her reappearance on the IDC board, so soon after this debacle, suggests that public institutions are being used to recycle and reward ANC-aligned figures, and not based on skill or strategic fit, but due to political favour.' He questioned the appointments, saying they are not only inappropriate but also compromise the IDC's role as a developmental finance institution aimed at driving industrial transformation, supporting black industrialists, and fostering inclusive economic growth. He said the EFF has formally requested the portfolio committee to urgently summon Tau to appear and provide a full explanation of the selection process for the IDC board appointments, among other pressing concerns. The party also wants Tau to explain the criteria used to assess the suitability of the appointees and whether they possess the necessary industrial or developmental expertise and experience to justify their appointments. 'As the legislative oversight body, the Portfolio Committee has a duty to prevent the continued erosion of governance, and to ensure that public entities like the IDC are not transformed into political patronage networks,' the EFF said. Tau's spokesperson, Yamkela Fanisi, has yet to respond to a request for comment on whether the Minister considers the appointments of the trio to be above board and fair. The IDC, on the other hand, has welcomed Gloria Serobe as its new board chairperson, along with six other new members. Serobe, co-founder and CEO of Women Investment Portfolio Holdings, brings extensive experience in governance and business leadership, having held senior roles at Denel, Adcorp, Sasfin, Old Mutual, and Nedbank.
