Zayn Rayyan's Case: Zaim Ikhwan Acquitted Of Neglect Charge, Ismanira Ordered To Defend Herself
Judge Dr Syahliza Warnoh made the decision after finding that the prosecution failed to prove a prima facie case against Zaim Ikhwan, 30, at the end of the prosecution case.
However, the court ordered Zayn Rayyan's mother, Ismanira Abdul Manaf, 30, to enter her defence on the same charge.
Zaim Ikhwan and Ismanira were charged with neglecting Zayn Rayyan in a manner likely to cause physical harm to the victim in the vicinity of Block R, Idaman Apartments, Damansara Damai up to the nearby river area between 12 noon on Dec 5 to 9.55 pm on Dec 6 2023.
They were charged under Section 31(1)(a) of the Children Act 2001 read with Section 34 of the Penal Code which carries a maximum sentence of 20 years imprisonment or a fine of RM50,000 or both, if convicted.
Judge Syahliza in her summary judgment said that after examining the evidence of the prosecution witnesses in maximum assessment as well as the arguments of the prosecution and defence, the court found that the prosecution failed to prove a prima facie case against Zaim Ikhwan at the end of the prosecution case.
"Therefore, the first accused (Zaim Ikhwan) is discharged and acquitted while for the second accused (Ismanira), the court finds that the prosecution has succeeded in proving a prima facie case against the second accused and she is called to defend herself in accordance with Section 31(1)(a) of the Children's Act 2001," said the judge.
Ismanira, who gave her defence statement today, chose to give her statement under oath from the witness stand.

KALABAKAN: A 45-year-old local suspected of running amok and threatening to kill his biological mother was arrested by police in Kampung Mangga, Kalabakan on Sunday evening. Acting Tawau District Police Chief Supt Champin Piuh said the suspect was apprehended around 7pm outside the family home after behaving suspiciously. 'The arrest was made following a public tip-off received by a crime prevention patrol unit from the Kalabakan Police Station (BPK),' he said in a statement on Monday. Champin said the suspect was behaving aggressively upon the officers' arrival and was believed to have threatened not only his mother, but also other family members present at the scene. A physical search of the suspect was conducted on-site, but no weapons or prohibited items were found on him. 'The motive behind his aggressive behaviour is still under investigation. Further information will be provided once documentation and interrogation are complete,' he added. The suspect has since been brought to Kalabakan Police Station before being transferred to the Tawau District Police Headquarters (IPD) for further investigation under Section 506 of the Penal Code for criminal intimidation. Champin also urged the public to be vigilant and to report any signs of domestic violence immediately. 'Police take family violence cases seriously. Police report lodged over AI scam video using King's fake images
KUALA LUMPUR: Police have confirmed receiving a report regarding a 32-second video circulating on TikTok that uses AI-generated images of His Majesty Sultan Ibrahim, King of Malaysia. The video, found on the account @DATUKZULKARNAIN77, is suspected to be part of a fraudulent scheme. Bukit Aman Commercial Crime Investigation Department director Datuk Rusdi Mohd Isa stated that the clip falsely portrays Sultan Ibrahim announcing financial aid for Malaysians in distress. The video directs viewers to contact an individual named 'Datuk Zulkarnain,' raising immediate red flags. 'The content is fabricated and likely created using AI technology,' Rusdi clarified in an official statement. Authorities are actively investigating the case under Section 419 of the Penal Code (cheating by impersonation) and Section 233 of the Communications and Multimedia Act (misuse of network facilities). The public is urged to remain vigilant against such scams, especially those involving manipulated media. Sandakan MMEA foils RM830k fuel smuggling attempt
SANDAKAN: The Malaysian Maritime Enforcement Agency (MMEA) intercepted a smuggling attempt involving diesel, petrol, and gas worth RM830,000 near Tanjung Aru. A pump boat was detained 0.8 nautical miles offshore while heading towards a neighbouring country. Sandakan maritime zone director Maritime Captain Muhamad Suhairy Hussain confirmed the arrest at 1.05 am after detecting suspicious navigation patterns. The boat carried 250 blue barrels of petrol (50,000 litres), 15 barrels of diesel (3,000 litres), and 120 branded gas cylinders. 'The skipper and seven crew members, aged 27 to 50, failed to present valid travel or cargo declaration documents,' said Muhamad Suhairy. Four men and two women from a neighbouring country, aged 16 to 41, were also detained as passengers. The case is under investigation under the Control of Supplies Act 1962, Merchant Shipping Ordinance 1952, and Immigration Act 1959/63. 'This arrest reflects MMEA's commitment to curbing smuggling and safeguarding national waters,' he added.
