Zayn Rayyan's father says child neglect charges against him, wife absurd
PETALING JAYA: Zaim Ikhwan Zahari contended today that he and his wife should never have been charged with child neglect in connection with the death of their six-year-old autistic son, Zayn Rayyan Abdul Matin, in 2023. The 30-year-old said this after he was acquitted of the charge by Sessions Court judge Dr Syahliza Warnoh. However, his wife, Ismanira Abdul Manaf, also 30, was ordered to enter her defence after Syahliza ruled that the prosecution had established a prima facie case against her. Speaking outside the courtroom, Zaim said he was disappointed with the police, despite the full cooperation he and Ismanira had given throughout the investigation. "I cooperated fully and placed my trust in the police to find and arrest my son's killer, who is still out there, free. "But this is the result of it (wife told to enter defence)? I am extremely disappointed. "There should have been no charges. This is all ridiculous," he said. Ismanira took the stand as the first witness today after Syahliza ordered her to enter her defence for the charge under Section 31(1)(a) of the Child Act. She is accused of committing the offence between 12pm on Dec 5 and about 9.55pm on Dec 6, 2023, around Block R, Apartment Idaman, Damansara Damai, up to a nearby stream. Zayn Rayyan was reported missing from Block R of the apartment on Dec 5, 2023, after Ismanira fetched him from school at 12.30pm. His body was found a day later in the stream, about 200m from his home. Lawyers Haresh Mahadevan, Ramzani Idris, and Lavanesh Haresh acted for the couple. The prosecution is represented by deputy public prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz, and Nur Sabrina Zubairi.

PETALING JAYA: The mother of Zayn Rayyan Abdul Matin told the Sessions Court here on Monday (July 21) that she had never neglected her autistic son, specifically on Dec 5, 2023 as stated in the charges she faces. Ismanira Abdul Manaf, 30, made the assertion during the examination-in-chief by her lawyer Haresh Mahadevan on the first day of her defence proceeding, as she shared with the court details of the day her son disappeared after she picked him up from school. "I picked Zayn up five minutes late, because I stopped at a supermarket to buy ingredients to cook Zayn's lunch, spaghetti bolognese, which he loves. After coming back, I park my motorcycle at Block C and take Zayn to the playground, where he loves to swing; that's our daily routine. "Halfway as I went up the stairs to my home, I realised that I couldn't hear the sound of his (Zayn's) shoes. I then went upstairs because I suspected Zayn had gone up, before me. When I arrived home, Zayn wasn't there. I didn't hear him running, because if he had, I would have immediately chased after him," she related. She also shared that she left both the grille door and front door open in hopes that Zayn could come in when he returned. "At that time, I called out Zayn, sometimes I call him abang because he is the eldest. I tried and called out where are you, but there was no reply," she said when recounting her movements when Zayn went missing at Block R of Idaman Apartment, Damansara Damai on Dec 5, 2023. When asked by her lawyer whether she had asked the police about what happened to her son after his body was discovered at a stream near her home the night of Dec 6, 2023, Ismanira replied that the police stated there were criminal elements, based on the injuries suffered by her son, police suspected a pedophile or a drug addict. Ismanira was testifying in her defence proceedings against charges of neglecting Zayn Rayyan that could possibly lead to physical harm around Block R of Idaman Apartments, Damansara Damai, to the area of the nearby stream between noon of Dec 5 and 9.55 pm of Dec 6, 2023. The mother chose to provide sworn evidence from the witness box after Judge Dr Syahliza Warnoh ruled earlier today that the prosecution successfully proved a prima facie case against her, while her husband, Zaim Ikhwan Zahari, 30, was acquitted of a similar charge. Ismanira faces a maximum jail sentence of 20 years or a fine of RM50,000 or both if found guilty of the charge under Section 31(1)(a) of the Child Act 2001. Ismanira recounted picking Zayn up from school five minutes late after stopping at a supermarket to buy ingredients for his favourite meal, spaghetti bolognese. She then took him to the playground near their home at Block C of Idaman Apartment, Damansara Damai, as part of their daily routine. 'Halfway up the stairs, I realised I didn't hear the sound of his shoes. I thought he might have gone ahead, but when I reached home, he wasn't there,' she said. She left both the grille and front doors open, hoping he would return. Desperate, she called out for him, using both his name and the affectionate term 'abang' (elder brother). 'I shouted 'abang... Zayn... where are you?' but there was no reply,' she told the court. When questioned about the police investigation, Ismanira said officers suspected criminal involvement due to injuries found on Zayn's body after his discovery near a stream on Dec 6, 2023. Authorities speculated the perpetrator could be a pedophile or drug addict. Ismanira faces charges under Section 31(1)(a) of the Child Act 2001, which carries a maximum penalty of 20 years' jail, a RM50,000 fine, or both. Her husband, Zaim Ikhwan Zahari, was acquitted of similar charges earlier. The trial continues tomorrow. – Bernama

Ismanira Abdul Manaf made the statement during the first day of her defence trial. She is charged with neglecting Zayn Rayyan in a manner likely to cause him physical harm. The mother of two told Judge Dr Syahliza Warnoh that she received this information after questioning the police about the injuries sustained by her special needs son. When questioned by her lawyer, Haresh Mahadevan, Ismanira recounted her observations at the forensic unit of Sungai Buloh Hospital. She saw her eldest son had head injuries, bruises around his eyes, blood coming from his nose and his mouth was not fully closed. She also stated that Zayn Rayyan's stomach was bloated, his legs had shrivelled, his skin had turned white and he emitted a foul odour. The following exchange occurred during the trial: Lawyer: Ismanira, did you contact the police to ask who was suspected of committing the crime? Ismanira: Yes. Lawyer: What was the police's response? Ismanira: They said there were several suspects, but the investigation is still ongoing. The police suspect that two types of individuals may have committed the crime against my son. Earlier on Monday, the court acquitted her husband, Zaim Ikhwan Zahari, of the charge. The prosecution failed to establish a prima facie case at the end of its proceedings against him. In contrast, the court ordered Ismanira to enter her defence for the charge under the relevant section. Besides Haresh, the 30-year-old couple was also represented by lawyers Ramzani Idris and Lavanesh Haresh. The prosecution was led by Deputy Public Prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz and Nur Sabrina Zubairi. The trial is set to resume on Tuesday. On June 13 last year, the couple pleaded not guilty to neglecting their child at the Sessions Court. According to the amended charge, they were accused of jointly neglecting 6-year-old Zayn Rayyan under their care in a manner likely to cause physical injury. The alleged offence occurred from Block R of Pangsapuri Idaman, Damansara Damai, to a nearby river area between 12pm on December 5, 2023, and 9.55pm the following day. The charge is framed under Section 31(1)(a) of the Child Act 2001 and punishable under the same section, read together with Section 34 of the Penal Code. If convicted, it carries a maximum fine of RM50,000 or imprisonment for up to 20 years, or both. Zayn Rayyan was found dead in a stream near Pangsapuri Idaman, Damansara Damai, at 10pm on December 6, 2023. He had been reported missing earlier and was discovered about 200 metres from his residential block.
