Friendship doesn't grant right to sexual relations without consent: Delhi HC

Mere friendship does not grant the right to have sexual relations without consent, the Delhi high court has said while denying bail to a man accused of repeatedly raping a girl after befriending her. The man was booked last year under the Indian Penal Code sections 376 (rape), 354D (stalking), 506 (criminal intimidation), and under the Protection of Children from Sexual Offences (POCSO) Act.
In his bail petition, the man said the girl consented to sexual relations and was a major. The Delhi police opposed the bail, citing the serious nature of the allegations.
Justice Girish Kathpalia rejected the man's argument and ruled that even if the girl had consented, it was unlawful since she was a minor. 'Further, even the consent would not be lawful in the present case because the prosecutrix was a minor. ...as specifically stated by the prosecutrix in the FIR [first information report] as well as her testimony, the accused/applicant repeatedly indulged in sexual intercourse with her despite her objections,' said Justice Kathpalia on Thursday.
Justice Kathpalia referred to the argument of it being a case of consensual relations and said merely because a girl befriends a boy, the latter cannot be given liberty to indulge in sexual intercourse with her without her consent.
The judgement came days after the government opposed in the Supreme Court any move to lower the age of consent under the POCSO Act or introduce exceptions for adolescent relationships. The government argued such dilution, 'even in the name of reform or adolescent autonomy,' would dismantle the statutory shield meant to safeguard minors and risk opening the door to child abuse.
In its written submissions in advocate Nipun Saxena's public interest litigation, the government said the threshold of 18 must remain strictly and uniformly enforced to maintain the integrity of child protection laws and uphold best interests of children.

New Delhi, Jul 30 (PTI) The Supreme Court on Wednesday pulled up the Tamil Nadu government for implicating more than 2000 persons in cash-for-jobs scam cases involving ex-minister V Senthil Balaji, and sought the details of all the accused and witnesses. Terming the trial in cases involving ex-minister as "rudderless ship", a bench of Justices Surya Kant and Joymalya Bagchi said that had there not been judicial intervention, the "reluctant state" wanted to give a decent burial of cases involving ex-minister Senthil Balaji in the cash-for-job scam case. "With over 2000 accused and 500 witnesses it will be the most populated trial of India. A small courtroom of the trial court will not suffice and a cricket stadium will be needed to even mark the presence of the accused. Several Artificial Intelligence-generated accused will pop up to mark their presence," the bench told senior advocate Gopal Sankaranaryanan, appearing for Y Balaji, representing victims of the scam and opposing the decision for clubbing of the cases. On a prayer for appointment of a special public prosecutor, the bench told senior advocate Abhishek Singhvi, appearing for the state, that when a powerful minister and affluent people are accused in a case, there is a perception that a lone public prosecutor will not be able to do justice. On Tuesday, the top court expressed displeasure over the Tamil Nadu government "attempting to delay" the trial in cases involving Balaji by implicating more than 2,000 people as accused in the alleged cash-for-jobs scam and described the attempt as a "complete fraud on the judicial system". Balaji resigned from the M K Stalin-led state Cabinet on April 27 after being pulled up by the top court. The apex court asked Balaji on April 23 to make a choice "between post and freedom" as it warned him that his bail would be cancelled if he did not step down as a minister. It took exception to the fact that Balaji was reinstated as a minister in the southern state, days after he obtained bail in a money-laundering case related to the alleged cash-for-jobs scam. On September 26, 2024, the top court granted bail to Balaji in a case probed by the Enforcement Directorate. With Balaji spending more than 15 months in jail, the top court had observed that there was no possibility that the trial would be concluded in the near future. Balaji (48) was sworn-in as a minister on September 29 last year, and assigned the same key portfolios of electricity, non-conventional energy development, prohibition and excise that he had held previously in the Stalin Cabinet.

Despite processing the higher pension claims, over 11 lakh applications for higher pensions were rejected by EPFO, with just over 4 lakh applications getting accepted. The turning point came with the Supreme Court's ruling on November 4, 2022, which clarified that EPF members enrolled before September 1, 2014, and still in service or retired thereafter, are eligible to opt for pensions based on higher actual salaries. In line with this decision, the EPFO has reviewed all related applications. So far, 4,00,573 demand letters have been issued to applicants confirming eligibility, while 21,995 applications remain under process. The government, however, has yet to disclose detailed reasons behind the high rejection rate or provide a clear resolution timeline. EPFO's Circular And SC's Ruling In 2014, the EPFO issued a circular that restricted higher pension benefits under the EPS to employees earning above a wage ceiling (initially Rs 6,500, later raised to Rs 15,000 per month). Employees earning above this threshold were not allowed to contribute to the pension scheme based on their actual salaries unless specific conditions were met. This led to widespread discontent, as many employees wanted to contribute to the EPS based on their full salaries to secure higher pensions upon retirement. The issue was challenged in various courts, leading to conflicting judgments, which ultimately reached the Supreme Court. The Supreme Court delivered a landmark judgment clarifying the eligibility for higher pension benefits under the EPS. Key points of the ruling include: Eligibility for Higher Pension: Employees who were members of the Employees' Provident Fund (EPF) before September 1, 2014, and either continued working or retired thereafter, are eligible to opt for a higher pension based on their actual salaries, without being restricted by the wage ceiling. This applies to both serving employees and retirees who were part of the EPF before the 2014 amendment.
