Another reason to drive safe on Indian roads: You may lose insurance claim for rash driving
A bench consisting of Justices P S Narasimha and R Mahadevan refused to give relief to a wife, son and parents of a man who died in a car accident due to its high speed, which led the vehicle to topple over read more The Supreme Court has said that insurance companies are not bound to cover the costs of a road accident caused by the recklessness of the driver, in a stark reminder to rash drivers. According to a report by Times of India, a bench consisting of Justices P S Narasimha and R Mahadevan refused to give relief to a wife, son and parents of a man who died in a car accident due to its high speed, which led the vehicle to topple over. STORY CONTINUES BELOW THIS AD The top court dismissed a compensation claim filed by the family of a deceased man, who had sought Rs 80 lakh from United India Insurance Company. The bench ruled that family members are not entitled to an insurance payout when the death results from the deceased's own mistake, with no external factors involved. The Court upheld the Karnataka High Court's decision from November 23 last year, which had also rejected the claim. The case finds its origins in an accident that happened in 2014 when N S Ravisha was driving from Bengaluru's Mallasandra to Arasikere city along with his sister, her children and father. The vehicle met with an accident as the man drove rashly and at high speeds, breaking traffic rules. Ravisha died from injuries sustained in the accident. His wife, son, and parents filed a claim seeking Rs 80 lakh in compensation, arguing that he was a successful contractor earning ₹3 lakh per month. However, the police chargesheet stated that the accident was caused by Ravisha's rash and negligent driving. Based on this, the Motor Accident Claims Tribunal dismissed the family's compensation request. During a hearing at the Karnataka High Court, Ravisha's kin's claim that the accident was caused by a burst tyre was rejected, with the court saying, 'when a claim is made by legal representatives of the deceased, it has to be proved that the deceased was not himself responsible for the accident by his rash and negligent driving and it would also be necessary to prove that the deceased would be covered under the policy so as to make the insurance company liable to make payment to the legal heirs.' STORY CONTINUES BELOW THIS AD The court added, 'In the instant case, admittedly the accident occurred due to the rash and negligent driving of the deceased himself and he being a self-tortfeasor, the legal heirs cannot claim any compensation for his death'.

Insurance Companies Not Obliged To Pay For Deaths Caused By Rash Driving, Rules SC
Last Updated: The apex court rejected a plea filed by the kin of a victim who died due to rash and negligent driving. Insurance companies are not obligated to pay compensation to victims who die due to rash driving, said the Supreme Court on Wednesday. A bench of Justices PS Narasimha and R Mahadevan denied compensation to the wife, son, and parents of a man who died in a car accident. The man was reportedly driving the car at high speed and in a rash manner, making it an act of negligence, reported the Times of India. The court dismissed a plea by the kin of the victim, seeking Rs 80 lakh compensation from the insurance company, United India Insurance Company, and said that the family cannot demand compensation as the death was caused by the man's own negligence and did not involve any extraneous factors. The top court upheld the Karnataka High Court's decision on November 23 last year, dismissing the compensation claim. What's The Case? The case dates back to June 18, 2018, when N.S. Ravisha was on his way from Mallasandra village to Arasikere town. He was travelling with his father, sister, and children when the accident took place. Notably, Ravisha was not only driving at high speed, but he also broke traffic rules before his car toppled over and rolled on the road near Mylanahalli Gate, Arasikere. The man died in the accident, said the report. After his demise, his wife and son claimed compensation of Rs 80 lakh, citing that the deceased was a busy contractor who earned Rs 3 lakh per month. However, the chargesheet filed by the police cites Ravisha's rash and negligent driving as the reason behind his death, and the claim was rejected by the Motor Accident Tribunal. Medical store owner among three held for smuggling of oxytocin
1 2 3 Lucknow: The Uttar Pradesh Special Task Force on Wednesday busted an inter-state oxytocin smuggling racket, arresting three people, including a medical store owner, and seizing approximately 5.87 lakh ml of illegally packed oxytocin worth Rs 1.20 crore from the Kakori police station area. According to STF officials, Anmol Pal, a BPharma graduate and resident of Mayapuram, Budheshwar, runs a medical store. "Using his pharmaceutical knowledge and access, Anmol began sourcing high-density oxytocin from Bihar, falsely labelled as mineral water. He allegedly used his medical store as a front while setting up supply routes and illegal packaging units in a rented house near Mohan Road," said STF officials. To expand operations, Anmol brought in Awadhesh Pal, a resident of Budheshwar Model City, who assisted in bottling and repackaging the drug. Khageshwar, a driver from Sitapur, was hired to transport the illegal consignments across districts in a mini-truck. The STF team intercepted the trio on July 2 at 11:10 am near Budheshwar Chauraha–Mohan Road under Kakori police station limits. During the operation, 5,87,880 ml of oxytocin, one mini-truck, three mobile phones, Rs 12,000 in cash, 800 empty vials, 136 rubber caps, 40 aluminum seals, and other miscellaneous items were seized. Additional SP, STF, Amit Nagar said the gang repackaged oxytocin into smaller ampoules before distributing them in Lucknow and adjoining districts. The drug, a Schedule H hormone, is illegally used to stimulate milk production in cattle and accelerate artificial growth in fruits and vegetables — posing serious risks to public health. An FIR has been registered at Kakori police station under Sections 318(4), 280, 276, and 112 of the Bharatiya Nyaya Sanhita (BNS).
