SIU investigates R3. 1 billion in Housing Development Agency deals

The Special Investigating Unit (SIU) is probing dodgy transactions valued at about R3.1 billion approved by the state-owned Housing Development Agency (HDA) and eight provincial Human Settlements departments since 2016.
Several of the HDA's deals now under scrutiny were for the identification, acquisition, holding, development, and release of state, communal, and privately owned land for residential and community purposes by the agency, in its name, or for and on behalf of the provincial departments or by the departments.
The provincial Human Settlements departments involved are from the Eastern and Western Cape, Free State, Gauteng, KwaZulu-Natal, Mpumalanga, North West, and the Northern Cape.
According to details of the property sales being probed, the highest amount paid was the R389.1 million spent in Chris Hani in Ekurhuleni for 2,560 serviced residential stands in 2021/22, R279m for land in the City of Tshwane in the 2020/21 financial year, while R213m was paid in the Eagles Nest township transaction also in Ekurhuleni in 2019/20.

Another R195m was for land in Palm Ridge, also in Ekurhuleni, in 2020/21, while the lowest transaction was R120,000 in Theunissen, Masilonyana, in the Free State in 2021/22.
Strangely, the three valuations of the land eventually bought for R120,000 ranged between R285,000 and R13.2m.
The SIU is investigating any alleged serious maladministration in connection with the agency's affairs and the departments' improper or unlawful conduct by their employees, unlawful expenditure of public money, as well as offences committed in violation of the Prevention and Combating of Corrupt Activities Act.
The offences include unlawful or improper conduct by any person, which has caused or may cause serious harm to the interests of the public between April 2016 and this year.
The corruption-busting unit will also determine whether there was any irregular, improper, or unlawful conduct by applicable service providers of the agency and departments, or any other person or entity.
In addition, the SIU will investigate whether the manner these contracts were entered into was not fair, competitive, transparent, equitable, or cost-effective and contrary to applicable legislation, manuals, guidelines, practice notes, circulars, or instructions issued by the National Treasury or the relevant provincial Treasury.
It will also check if manuals, policies, procedures, prescripts, instructions or practices of, or applicable to the agency and departments and the related unauthorised, irregular or fruitless and wasteful expenditure incurred or losses suffered by the agency, departments or the State.

IFP and EFF alliance could lead to leadership change in Nongoma Municipality
The IFP is expected to reclaim the Nongoma Local Municipality in a motion of no confidence. Image: supplied The IFP in KwaZulu-Natal is poised to reclaim Nongoma Local Municipality following the resuscitation of its relationship with the EFF in the province. The EFF's two councillors are expected to back the IFP's motion of no confidence against both NFP mayor Mshangane Ndabandaba and ANC Speaker Babongile Sithole. The motion meeting is scheduled to take place late on Monday. The meeting will be chaired by the municipal manager Mpumelelo Mnguni as the Speaker is also affected by the motion. Mnguni confirmed the motion, saying he hoped by the end of business on Monday, the proceedings would have been completed and there will be new leadership if the motion succeeds. He said the motion was filed by the IFP. The EFF was reportedly angered by both the ANC and the NFP's failure to remove the Speaker and the mayor who are facing corruption allegations. The mayor and the Speaker were arrested alongside former deputy mayor Sabelo Nkosi who was fired a few months ago for his alleged involvement in the corruption. The trio are out on bail. Last week the ANC said it was in the process of taking action. NFP acting secretary-general Sunset Xaba said the party had long taken a decision to remove Ndabandaba, however the party caucus requested the party to give the mayor two months in office. It was an agreement that was reached between the national leadership and the Nongoma caucus,' said Xaba. The EFF's change of heart towards the IFP paved the way for ousting of an ANC mayor in Mpendle Local Municipality last week. The parties worked together in a motion of confidence that was filed by the IFP. Although the EFF and IFP controlled fewer seats while the ANC governed alone with six seats, the motion was passed because all five councillors, except the mayor, abstained paving the way for the mayor's removal. After the 2021 local government elections, the IFP reached an agreement with the EFF to co-govern close to 20 municipalities that were hung, however in 2023 the EFF pulled out of the arrangement and struck a deal with the ANC. This resulted in the IFP losing Nongoma and other municipalities.

The world's richest person - and Trump's biggest political donor in the 2024 election - had a bitter falling out with the president after leading the Republican's effort to slash spending and cut federal jobs as head of the so-called Department of Government Efficiency (DOGE). Musk has clashed with Trump over the president's massive domestic spending plan, saying it would explode the US debt, and vowed to do everything in his power to defeat lawmakers who voted for it. Burton's Foods trademark dispute against Boxer Superstores dismissed

Image: Online The wording 'Wheels' in relation to biscuits came under the legal spotlight after a company selling biscuits under the name 'Wagon Wheels' objected to a competitor wanting to register its biscuits using the name 'Wheels' on its packaging. Burton's Foods turned to the Gauteng High Court, Pretoria, as it is opposing two trademark applications filed by Boxer Superstores under the Trade Marks Act, to enable it to use the word 'Wheels' on its biscuits. Burton's Foods asked the court for an order refusing Boxer Superstores' trademark applications and directing that the trademark applications be removed from the register. Burton's Foods opposition is premised on the contention that the respondent's trademark is highly similar to theirs, and that it covers goods that are identical, or at least highly similar. The applicant told the court that its 'Wagon Wheels' trademark contains the word 'Wheels', which retains an independent identity within the composite mark 'Wagon Wheels'. It said its trademark and the opposed trademark applications are visually similar in that they both contain the word 'Wheels'. But the judge said the applicant cannot claim rights in the individual words contained in the composite trademark. The question is not whether the word 'Wheels' is identical in each mark, but whether the trademark 'Wagon Wheels' is so similar to the trademark 'Wheels' as to cause deception or confusion. Burton's Foods trademark is registered simply as Wagon 'Wheels', with no description as to colour or design. Boxer Superstores trademark carries a specific design in specific colours, namely yellow, black, and white. Visually, the two marks are quite distinct from one another, the judge said.
