Surgeon sues McLaren after he was left with brain injury after crash on £24,000 snowmobile safari trip

An American neurosurgeon is suing McLaren after suffering a 'very significant' brain injury in a crash during a snowmobile safari trip organised by the firm, the High Court has heard.
Andrew Cannestra's snowmobile crashed near Ivalo, northern Finland, on February 2 2020, during a four-night 'Pure McLaren Arctic Experience' arranged by McLaren Automotive Events.
The Florida native, 54, who specialises in spinal surgery, is alleging the company was in breach of contract and negligent after the crash left him with a trembling hand which he previously said would mean he will have to retire prematurely.
Barristers for surgeon told the first day of a trial in London that Mr Cannestra and his then-partner, Kaitlin Mealor, were given a safety briefing, but this did not include information on the layout of the track or the emergency stop button and tether cord on the snowmobile.
The motorsports group is defending the legal action, with its lawyers saying there was 'no evidence' that the briefing did not meet safety standards and that the 'irreducible risk' of the activity was 'reasonably controlled'.
Opening the trial on Wednesday, Neil Block KC, for Mr Cannestra, said his client and Ms Mealor were 'absolute novices' on snowmobiles, and that 'a duty was owed by McLaren to use reasonable care'.
He said that while Mr Cannestra's case was not 'that the track was inherently unsafe', he and Ms Mealor 'did need to receive a proper and adequate briefing, and proper and adequate guiding'.
In written submissions, Mr Block said: 'The briefing did not include any information about the layout of the track, the position of potentially hazardous bends, corners or other hazards.
'It seems to be McLaren's case that this was not required.
'It is common sense that this was required, and the failure to do so must be a breach of duty.'
Mr Block told the court that Mr Cannestra and Ms Mealor's 'couples package' cost almost £24,000 before flights, with activities including driving a McLaren car on ice, and optional events such as snowmobiling.
Mr Cannestra and Ms Mealor used a 'dedicated snowmobile track' about four kilometres long, and signed a driver declaration, a waiver and a self-liability form beforehand.
They were given a safety briefing by two guides - Arto Pitkanen and Jouni Satta - which Mr Block said lasted 'approximately five minutes', with the barrister adding: 'There is an issue about what it actually included.'
Mr Block said the Lynx Xtrim 900 snowmobiles had three modes - eco, standard and sport - with the tour beginning in eco mode, which had a top speed of 40kph.
A few hundred metres into the activity, Mr Block said the group stopped, and Mr Pitkanen approached Mr Cannestra and changed the mode, which increased its top speed and was 'not appropriate'.
Mr Pitkanen is alleged to have then set off at speeds of up to 60kph, causing Mr Cannestra to lose sight of him and speed up as he 'did not want to be on his own', Mr Block said.
Mr Cannestra then lost control of the snowmobile on a bend, with the vehicle veering off the track into deep snow and hitting a tree, leaving him with a 'very significant' brain injury and 'orthopaedic injuries'.
Matthew Chapman KC, for McLaren, said in his written submissions that the turn where Mr Cannestra crashed was 'quite safe if negotiated at an appropriate speed' and that the court 'can confidently conclude that reasonable care and skill was exercised' in organising the outing.
He continued that Mr Pitkanen changed the snowmobile's mode as Mr Cannestra was 'eager' for this to happen and that he 'explained the switch' to him.
He added that Mr Cannestra's speed was 'wholly within his control', and claims that Mr Pitkanen had driven too far in front 'cannot sensibly succeed'.
He said: 'In this case, there was a well-organised, risk-assessed activity which was delivered by well-trained and experienced guides who complied with the local standard.
'The irreducible risk was, in other words, reasonably controlled.'
While acknowledging that the content of the safety briefing was 'contentious', Mr Chapman said it included the hand signal to stop, how to use the throttle and brake, starting the engine and 'bodyweight shifting/leaning for turns'.
The trial before Mr Justice Ritchie, which is only dealing with the issue of liability, is expected to conclude this month, with a written judgment expected at a later date.

The Australian will line up alongside Ferrari's pole-sitter Charles Leclerc at the Hungaroring on Sunday with title rival and teammate Lando Norris in third place. "Pretty confident," Piastri, 16 points clear of Norris, said of his chances of taking a seventh win from 14 races. "It was good last year, so hopefully it can be good again this year." Piastri started second last year, with Norris on pole, and went on to take the first win of his F1 career. Sunday's race could see some rain, which could make things tricky on a twisty circuit where overtaking is already difficult and strategy can be crucial. McLaren were fastest in all three practice sessions but Leclerc made the most of the conditions to seize a surprise advantage. "If you're sat where Charles is, fantastic. If you're sat where I'm sat, bizarre and somewhat frustrating," he said when asked to sum up the session. "I think the conditions completely changed, and it was just weird. "I think our pace has been good, but Charles has been quick all weekend, in certain sessions," added the Australian. "It is a very difficult track to overtake on, and it's not going to be the easiest place to try and regain the lead." Norris, winner of four races so far this campaign, agreed with his teammate. "I think we always have, at least in the race, a bit more of an advantage. But our main competitor over the last four, five races has been Charles and it's been the Ferrari," said the Briton. "So, if there was anyone else that's going to be on pole today, it was going to be Charles. And if there's anyone that's going to make our life tough tomorrow, it's going to be the same guy."

For so long this season Ferrari have looked to take their place at the front of the grid but when they finally did so at the Hungarian Grand Prix, it was with an extraordinary contrast in fortunes. Lewis Hamilton was left berating his performance as 'useless' and doubting his own ability as he was knocked out in Q2 before his teammate Charles Leclerc celebrated taking the Scuderia's first pole of the campaign. For all that Ferrari will be buoyed by Leclerc's remarkable run in a tight contest at the Hungaroring – where he beat the McLarens of Oscar Piastri and Lando Norris into second and third and with the top four cars separated by four-hundredths of a second – it was a disconsolate Hamilton that captured the attention. The seven-time champion is the most successful driver here with a record nine poles and eight wins. He has weaved his way around the tight, complex circuit in Budapest with such success in the past it might almost be considered second nature. Yet on Saturday it fell apart for the 40-year-old. His lap in Q2 was not good enough to see him through, Hamilton reduced to questioning himself. 'I'm useless, absolutely useless,' was his blunt assessment. 'It's not their [Ferrari's] problem, the other car is on pole. They probably need to change driver.' Hamilton's frustration had been clear from the moment he had finished that final lap 'Every time. Every time,' he told the team on the radio after he was eliminated. The performance compounds what has been a torrid season thus far for Hamilton. After 12 seasons with Mercedes, he is not finding the Ferrari to his taste. He has been working relentlessly with the team to come up to pace but is clearly deeply unhappy with his own failure to deliver. He will start 12th. In Belgium he chastised himself for what he called an unacceptable error that left him in 16th place on the grid and this is now the fourth time he has failed to make it into Q3 this year. He will be even more vexed because after a difficult first half of the season, Ferrari's recent upgrade to the rear suspension, aimed at addressing the car's weakness through slow corners, have been effective at least in bringing them closer to the dominant McLarens. However, fortune favoured Leclerc as he took his first pole in Hungary, and the 27th of his career. For the final runs in Q3, with rain beginning to fall, the track temperature dropping and a sudden change of wind direction, a tense final showdown ensued. It brought the Ferrari alive and Leclerc had its measure to perfection to take the top spot. Norris and Piastri could not improve on their times, caught out by the shift in the wind. The Monegasque driver edged out Piastri by two-hundredths of a second. He had been hopeful of a top-five spot and was taken aback when he emerged on top. 'Today is a day where I don't understand anything anymore about the sport,' he said. 'I mean, honestly, qualifying felt horrible. Everything felt out of place. It really felt like we had done a step backwards from FP3. And in terms of competitiveness, Q1, I was on the limit and I barely made it to Q2. I basically just did a clean lap, which was a really good lap because those conditions were very difficult to get everything right. The task on Sunday facing Leclerc and Ferrari remains enormous, with the McLarens expected to once more have an advantage, but Leclerc is at least in position to try to dictate from the off in what promises to be a fascinating battle. George Russell was in fourth for Mercedes and Fernando Alonso and Lance Stroll fifth and sixth for Aston Martin. Gabriel Bortoleto was seventh for Sauber, Max Verstappen eighth for Red Bull and Liam Lawson and Isack Hadjar ninth and 10th for Racing Bulls.

Charles Leclerc beat Oscar Piastri and Lando Norris to pole position at the Hungarian Grand Prix but Ferrari also suffered a blow with Lewis Hamilton well down the order Lewis Hamilton declared himself "useless" and told Ferrari they "probably need to change driver" after another galling qualifying performance at the Hungarian Grand Prix. But there was joy on the other side of the garage as Charles Leclerc secured a shock pole position in Budapest. ‌ McLaren dominated practice and, like this season's Formula 1 title race, the battle for pole looked likely to be a straight duel between Oscar Piastri and Lando Norris. But as the wind changed, in swept Leclerc to seal "one of the best poles I've ever had", and Ferrari's first Grand Prix qualifying success of the year. ‌ He was the only one representing the team in the final part of the session with Hamilton already back in the garage. The seven-time champ was 13th quickest but gained a place when Kimi Antonelli had a lap deleted and was dropped to 15th. ‌ It was the latest in a string of qualifying disasters for Hamilton who was in the bottom five in both sessions at Spa-Francorchamps last weekend. The 40-year-old has been on pole nine times at the Hungaroring in his F1 career but could not connect with a track he loves. And he was visibly emotional in a tough-to-watch interview afterwards, in which he made it clear he believes he is the problem. Hamilton mumbled: "It's just me, every time. I'm useless, absolutely useless. The team has no problem – the other car is on pole. They probably need to change driver." Ferrari have generally lacked the pace to fight for victories so far this season but Leclerc has still managed five podium finishes up to now. And he could make it six today, or perhaps even get the team's first win of the year, having stunned even himself by denying the McLarens. On Thursday, Leclerc said the Hungary circuit is "by far my worst track of the season". But he changed his tune after qualifying and said: "It's a track where I've never really been successful, but since practice I felt like there was something that had changed this year. ‌ "It was the most surprising pole position I have had I think, because after Q1 and Q2 I was expecting maybe P5 if I did everything perfectly. But it was a lot better than that! It's been a very tricky qualifying for everybody, but we managed to do a really good job anyway." Piastri joins Leclerc on the front row with Norris third ahead of fellow Brit George Russell in his Mercedes. Fernando Alonso is the first man since Graham Hill in 1975 to compete in F1 beyond his 44th birthday but has overcome a back injury to drive this weekend and will start fifth as Aston Martin found pace. Rookie Gabriel Bortoleto also shone in his Sauber, qualifying seventh ahead of Max Verstappen who has never won a race from eighth on the grid in his career. And he doesn't expect that to change today in a Red Bull car he is not enjoying one bit, saying: "No grip front or rear and no real balance in the car, not one lap the whole weekend. It's not been too bad in the past but, for whatever reason, this weekend nothing has really worked."
