Wheel tax, income tax boost likely for Porter County as burden of government support shifts

Discussion of the impact of property tax reforms passed by the Indiana General Assembly taxed Porter County Council members' brains Tuesday.
'Understand that nobody up here wants to pass an increase in taxes,' Council President Andy Vasquez, R-4th, said. 'We're stuck between a rock and a hard place.'
Putting local government on a property tax diet, something Gov. Mike Braun strongly urged the Legislature to do, leaves two choices: Reduce services or raise income taxes and other taxes to make up the difference.
'We're getting pushed from property taxes to local income taxes,' said consultant Jason Semler, a principal for Baker Tilly Municipal Advisors, as he walked the council through the long, complicated math of the new state law.
The result ends up shifting more of the burden of financing local government from businesses to individuals, Semler said.
A wheel tax for Porter County is virtually a certainty as a way to get the full amount available in the state's Community Crossings matching grant program. Technically, the wheel tax remains optional, but the new law requires it for the county to receive the full amount of matching grant money.
And although the county's income tax rate is the lowest in the state, at 0.5%, that's likely to increase as the property tax revenue shrinks.
'If you have to raise the income tax, this is a good time to do it,' Semler said.
'They're kind of forcing us to increase LIT (local income tax) anyway,' so consider gradual increases to cushion the blow, he suggested. 'We know we're going to need it down the road.'
Under the new law, cities and towns with more than 3,500 residents could adopt their own income tax in the future, up to 1.2%. Based on current population statistics, that would include Portage, Valparaiso, Chesterton, Hebron and Porter.
If those municipalities enact their own income tax, their residents would be taxed twice – by the county and by the municipality, Councilman Andy Bozak, R-At-large, said.
That would be the case for the wheel tax, too.
Councilman Jeremy Rivas, D-2nd, speculated that Porter County might eventually see people moving into unincorporated areas from cities and towns to avoid this double taxation.
'Everybody's looking to escape the tax,' Vasquez said.
One option might be for the county to work with the municipalities to give them a share of the county's income tax in exchange for not enacting their own tax, Semler said.
For Porter County, $3.5 million a year in dues for the Northwest Indiana Regional Development Authority has to come from income tax revenue, so that needs to be factored in. After that, the county can figure out where the income tax revenue should be divvied up.
The county has been pondering some important needs for information technology, road repairs and EMS service.
Councilman Red Stone, R-1st, said on his way from Portage to Valparaiso, driving on county roads for Tuesday's meeting, his vehicle was bouncing up and down because of the poor road conditions. Porter County's roads are in worse shape than the state average.
Among the drawbacks of shifting to more reliance on income tax revenue is that it's less stable. 'If there's a downturn in the economy, we're going to feel it much more than with property taxes,' Semler said.
The county shouldn't hoard money, but healthy fund balances are important when revenues plunge but needs increase.
Rivas and others blasted state legislators for setting themselves up as heroes for lowering property taxes even as they knew local officials would look like bad guys for raising income taxes to make up for the lost revenue. 'The legislators, this was a disingenuous action they took,' he said.
The council has until Oct. 31 to decide what direction to take.
'I think that's why some counties are looking at increasing their income taxes. They know they're going to have to do it eventually,' so they're acting this year so it goes into effect next year, Semler said.
Stone said in his meetings with department heads, he's looking for ways to reduce spending.
'I would strongly urge the council to put the work in,' he said.
Some funds and areas can't be touched, under state law, but he wants to dig deep to see what can be cut.
'I think this would be a good exercise for the public. If there's places to cut, let us find them,' he said.
Bozak disagreed with Stone's approach. 'We don't want to get too much into the weeds,' he said. A better way would be to tell department heads to decide where to make 3% cuts, hopefully not in salaries. That might be the result of cleaning less often or other ideas, Bozak said.
'Let's get in the weeds. Let's look at take-home cars,' Stone said. If there are people taking cars home who don't need to take them home, stop that.
'As far as who's taking cars home and all that, that's the commissioners,' Bozak said.
Rivas said the council has been cautious for years, which is why cash balances are high and tax rates are low.
'The reason we are the lowest-tax county is because of the work we put in,' he said.
'I think the rubber's going to meet the road,' Stone said. 'If someone can come up with an extra $7 million for paving the roads, I'm all ears.'
'We are going to have to be very creative and work together the best we can and come up with some solutions,' Vasquez said.
Councilwoman Michelle Harris, R-At-large, has high hopes for department heads. 'I think they're going to come up with ways to be so efficient, I think they're going to just wow us,' she said.
Vasquez said he would be open to a data center being located in an area already zoned for light industrial, bringing a big boost to the county's tax coffers.
'Like all things, time will tell, and I pray God we will hold the line the best we can,' he said.
Semler walked the council through the implications of Senate Enrolled Act 1 to see how Porter County will be affected as the property tax reforms are phased in.
'A lot of these are going to be phased-in impacts, and a lot of the significant impacts are going to hit us two, three years down the road,' he said.
The math is long and complicated, but the upshot is that the property tax base will shrink, and as tax rates increase, more and more properties will qualify for the circuit breaker that caps the property's total tax bill.
For a single-family, owner-occupied home, that's 1% of the home's value. Rental properties, utilities, assisted living homes and some other types of property have bills capped at 2% of the property's value.
'You can see how those tax bases are going to be greatly reduced' in downtowns and other areas where these properties are concentrated, Semler said.
County government loses $1.8 million a year to circuit breaker relief for property owners, Semler said, but that will increase in the future. 'You lose about 3.5% of your revenue because of the circuit breaker cap,' he said.
For business personal property, the tax currently begins after the first $80,000 in value. But that's changing, too, with only the value above $2 million being taxed. It's a boon to corporations but not to local government and citizens who will pay more in taxes to make up the difference.
Stemler said he expects this new law to result in some discussion about consolidation. 'I can see some small cities and towns throughout the state have some difficulty surviving,' he said.
Schools don't get any income taxes under this new scenario, so they'll face difficulties, too.
The massive, sweeping changes resulting from the new law have increased demand for advisors like Baker Tilly. 'We don't need a marketing department. We've got legislators,' Stemler said. 'This is not what we prefer to be doing, but we're happy to help out.'

DeSantis signs boater safety law named for Miami-Dade teen who died in 2022 crash

Florida Gov. Ron DeSantis signed into law Friday a boater safety bill named after a teenage girl who was killed in a Biscayne Bay vessel crash that also seriously injured her friend, and in which the boat's operator initially only faced minor charges. House Bill 289 was named Lucy's Law by its legislative sponsors after 17-year-old Luciana 'Lucy' Fernandez, who was embarking on her senior year at Our Lady of Lourdes Academy when she died in the Sept. 4, 2022, boat crash. The main thrust of the law is that boat drivers whose reckless operation of their vessels result in serious injuries now face felony convictions, previously only a misdemeanor. It also boosts the penalties for providing misleading statements to law enforcement during a boat-crash investigation and boating under the influence of alcohol or drugs. The Legislature overwhelmingly passed the bill May 2 after a years-long campaign by Lucy's parents, Melissa and Andres Fernandez, to gain lawmakers' support. READ MORE: 'Lucy's Law,' named after teen killed in Biscayne Bay boat crash, passes in session's final hours 'This moment marks not only the fulfillment of a promise, but the continuation of a movement — one born from heartbreak, sustained by hope, and propelled by a shared mission to protect lives and bring meaning out of unimaginable loss,' the Fernandezes said in a statement via The Lucy Fernandez Foundation, a boater safety nonprofit they founded in honor of their daughter. The tragedy shook the tightly-knit South Florida religious school community, as all 12 girls on board the 29-foot Robalo that collided with a fixed channel marker either attended Lourdes, Carrollton School of the Sacred Heart or Westminster Christian School. One of those girls, now 20-year-old Katerina Puig — a standout soccer player at Lourdes — suffered traumatic injuries that will likely require a lifetime of physical rehabilitation. The family, including Katerina and her parents, Rudy and Kathya, issued a statement to the Herald thanking the governor for signing the bill. 'We are overcome with joy and deep gratitude to Gov. Ron DeSantis for signing Lucy's Law. This is an emotional and profoundly meaningful moment for our family, and we thank him sincerely for honoring Lucy's legacy in such a powerful way,' the family said. The Puigs also praised the Fernandezes 'for their tireless dedication and perseverance throughout this journey. Your incredible efforts have been an amazing example of love and faith to us all.' An incomplete investigation Compounding the devastating loss of a child and the permanent injuries endured by another, was the way the investigation into the crash was handled by the Florida Fish and Wildlife Conservation Commission, which initially only led to three misdemeanor careless boating counts against the Robalo's driver, Doral real estate broker George Pino, in August 2023. The Miami-Dade State Attorney's Office a year later reexamined the case after witnesses who had never been interviewed by investigators came forward disputing major aspects of the probe. Three of the witnesses — boaters who were at the scene in the aftermath of the crash — spoke to the Miami Herald, prompting a fourth witness to come forward. That witness is a Miami-Dade Fire Rescue medic who was on the scene, and said Pino appeared intoxicated when he pulled him from the water, according to sources. When Pino hit the channel marker at nearly 50 mph, his boat capsized, throwing all 14 people on the boat — the 12 teenage girls and George Pino and his wife Cecilia— into the bay on that Sunday evening of Labor Day weekend. They were returning to Ocean Reef Club in north Key Largo after a day celebrating his daughter's 18th birthday on Elliott Key. Lucy was trapped under the boat after the crash and died the next day in a hospital. Katerina was found unconscious in the water along with another girl, Isabella Rodriguez, who has recovered. Pino told the FWC investigators that a larger boat's wake caused him to lose control of his boat. However, all of the witnesses — including those who were on his boat — as well as photographic and global positioning satellite data, dispute that claim. Last October, the State Attorney's Office dropped the misdemeanors and charged Pino with reckless boating resulting in death — or vessel homicide — a second-degree felony. Prosecutors homed in on GPS data from Pino's boat, which they determined contradicted his version of events prior to striking the concrete channel marker. But, in order to re-charge Pino, the Puig family had to agree to drop the careless boating count related to Katerina's injuries. That was because Florida law did not have a felony charge for the reckless operation of a boat that resulted in serious injuries. Had Pino pleaded guilty to the misdemeanors at any time before prosecutors charged him with the felony, his maximum penalty if convicted would have been 60 days in county jail and a $500 fine. He now faces up to 15 years in state prison and a $10,000 fine if convicted of the vessel-homicide charge. His trial is scheduled for the fall, but the witness list has grown to dozens of people, meaning, with depositions, that's likely to be pushed back. Changes to boating laws Under Lucy's Law, reckless boating resulting in serious injury is now a third-degree felony, instead of a misdemeanor. Reckless boating resulting in death remains as a second-degree felony. And, anyone convicted of boating-under-the-influence manslaughter will be punished with a mandatory minimum four-year prison sentence. If the operator of a vessel in a crash that results in the death of a person provides misleading statements to police, that person could be charged with a second-degree misdemeanor under the new law. Lucy's Law originally contained another stipulation that would have impacted Florida's deeply ingrained boating culture regarding vessel safety training. Florida law requires those born after Jan. 1, 1988 — or those 37 years old and younger — to complete a boater-safety course before they can operate a vessel. Lucy's Law would have expanded that requirement to those older than 37, but who haven't lived in Florida for five consecutive years at the time they first began operating a boat. That part of the bill was stripped before the final vote. According to the FWC's latest data, in 2023, 83% of boat operators in fatal accidents had no formal boating education. The Puigs, in their statement also thanked the bill's sponsors, Representatives Vicki Lopez and Vanessa Oliver, and said that in a state that has more than 1 million registered boat owners and leads the nation in fatal vessel crashes, more needs to be done to prevent the types of tragedy that took Lucy's life and forever changed Katerina's. 'The need for enhanced boater safety and education is undeniable. It is our hope that Lucy's Law will help prevent future tragedies and save lives. Lucy's life was beautiful, and now her memory will help protect others. This law is a step toward ensuring that no family has to endure the heartbreak that changed Katy's life forever.'

Arizona governor caps off quarrelsome legislative session with budget approval

PHOENIX (AP) — Arizona Gov. Katie Hobbs signed on Friday a bipartisan budget that boosts pay for first responders and increases spending on social services, capping a quarrelsome session of the Republican-led Legislature that brought the state to the brink of a government shutdown. The first-term Democrat broke her veto record, sparred with Republicans over agency leadership nominations and got on board with bipartisan proposals that ruffled the feathers of some members of her party. The session unfolded while Hobbs' 2026 bid to hold the reins of the battleground state loomed large. Hobbs began the session with an uphill climb, confronting expanded Republican majorities in the House and Senate. Arizona is one of eight states where the governor's office and legislature are controlled by opposing parties. Hobbs' office chose to negotiate on just a handful of issues this session, including water policy, funding for some of Arizona's most vulnerable residents and renovations to a stadium used by the Arizona Diamondbacks. Budget barbs The Legislature sent the governor a $17.6 billion budget after GOP lawmakers traded barbs with each other and Hobbs' office. The Senate approved one version, but it lacked votes in the House, leaving lawmakers in that chamber to introduce a measure meant to keep state operations running while negotiations continued. On Wednesday, Hobbs vetoed the proposal favored by House Republicans and the continuation measure, calling them partisan and reckless. House Speaker Steve Montenegro introduced amendments to the budget proposal Thursday, and the chamber passed it that night, clearing the way for the Senate to sign off. 'Our principles haven't changed. We've led responsibly in a divided government, fought to preserve conservative priorities, and made this budget better than it would have been without us,' Montenegro said in a statement Friday. Border security Hobbs indicated last fall that she was willing to work with President Donald Trump's administration on border security issues like stopping fentanyl trafficking and followed up in January calling the Laken Riley Act 'an important step forward" in a post on the social platform X. The act requires detention of unauthorized immigrants accused of theft and violent crime. Hobbs' stance drew praise from GOP Senate President Warren Petersen, while members of her own party criticized the measure. She signed an executive order in February to create a task force that would oversee expanded operations at the border, but she later vetoed a measure that would have required local and state officials to cooperate with federal immigration enforcement efforts. Senate Minority Leader Priya Sundareshan, a Democrat, said her caucus pushed Hobbs to limit spending on border support, saying it had 'drawn a hard line' and planned to withhold votes on the state budget until the border funding was reduced. Democratic Senate Assistant Minority Leader Sen. Catherine Miranda, who voted against the budget, said last week that she could not support a budget that has language that opens the door to immigration enforcement. 'And while I know that Gov. Hobbs has promised she will not use the Local Border Support Fund to enforce immigrant laws, the language included in a bill has as much impact as the actual policy implementation,' Miranda said. Progressive lobbyist Marilyn Rodriguez said she would have liked to see Hobbs take a less hawkish posture on border security. Despite some frustrations, House Democratic Leader Oscar De Los Santos said the budget delivers on priorities that include public education, Medicaid and expanded health care for certain patients. 'We also make big investments to bring down the cost of childcare and make college tuition free for Arizona's students from working families,' he said in a statement. Hardball with Republicans Hobbs is no stranger to the veto pen, which she has wielded to knock down what she considers proposals that are out of touch with the state's purple electorate. This year, she vetoed about 170 bills, including an attempt to speed up the counting of ballots. She's repeatedly accused state Sen. Jake Hoffman, who chairs the Legislature's Freedom Caucus, for politicizing the confirmations of her agency head nominees. Her fight with Republicans over funding for a state agency that provides services for some of Arizona's most vulnerable residents led to a moratorium on bill signing, and she has criticized Republicans for hitting the breaks on a proposal that could have led to increased regulation of groundwater pumping in rural areas of the drought-stricken state. Hobbs has said she'd take action on the water front in the absence of a legislative deal, which could set up another round of sparring with Republican lawmakers as she prepares to seek another term. With no Democratic challenger, Hobbs is expected to face either Karrin Taylor Robson or U.S. Rep.
