Cuttack:
National Green Tribunal
(NGT) has ordered an investigation into alleged illegal sand mining at a quarry in the Brahmani river in Dhenkanal district.
The directive came during a hearing on Friday on a petition filed by a Talcher-based NGO which alleged that sand was being mined illegally over 11.80 acres from the river at Gunadei village under Odapada tehsil, flouting several environmental norms and guidelines.
The petitioner's counsels, Sankar Prasad Pani and Ashutosh Padhy (appearing virtually), claimed the project was operating in violation of the Sustainable Sand Mining Management Guidelines, 2016, issued by the Union ministry of environment, forests and climate change.
Taking note of the charges, NGT's east zone bench of Justice B Amit Sthalekar (judicial member) and Dr Arun Kumar Verma (expert member) constituted a five-member fact-finding committee comprising officials from the Dhenkanal administration, Odisha State Pollution Control Board, State Environment Impact Assessment Authority (SEIAA), and the mines department.
The Dhenkanal district magistrate will act as the nodal officer for coordination.
The committee has been directed to conduct a site inspection and file a report on affidavit within three weeks. The matter has been listed for next hearing on Aug 19.
NGT in its order noted that the original environmental clearance (EC) granted on March 30, 2021, to the Odapada tehsildar, was conditional upon submission of an annual rate of replenishment study (ARSS) by May 2022 — a requirement that was not fulfilled.

On July 12, 2023, the EC was transferred to a private lessee. However, SEIAA flagged it as a "violation case", acknowledging that the quarry had operated without proper transfer of clearance.
The petition alleged that although the lessee was permitted to extract only 8,618 cubic metres of sand in the third year, mining exceeded permissible limits within just four days, with over 100 trucks operating daily, suggesting extraction of nearly 2,000 cubic metres per day.
Other allegations include mechanical mining in violation of manual mining conditions, lack of demarcation at the site, unapproved district survey report and failure to display statutory clearances. Use of heavy vehicles was also said to be impacting the river's flow and local infrastructure.

Why has China barred Wells Fargo banker from leaving the country?

China on Monday said that a senior executive at Wells Fargo, one of the United States (US)' largest banks, has been restricted from leaving the country because of her involvement in a criminal case. The confirmation comes after reports of the same surfaced last week, according to a report in the South China Morning Post (SCMP). 'Mao Chenyue is involved in a criminal case currently being handled by Chinese law enforcement authorities and is subject to the exit restrictions in accordance with the law,' Chinese foreign ministry spokesperson Guo Jiakun said, as quoted by the SCMP. The spokesperson did not specify what Mao is alleged to have done, nor which law enforcement agency is handling the case. 'She cannot leave the country for the time being,' Guo added, noting that Mao is required to 'cooperate with the investigation pursuant to Chinese laws', the report added. Guo added that 'no matter whether they are Chinese or foreigners, they should abide by Chinese laws in China'. He also said that her 'lawful rights and interests' would be protected while the investigation is ongoing and framed the situation as 'an individual judicial case'. According to her LinkedIn profile, Mao has been a managing director at Wells Fargo since 2012. Wells Fargo suspends business travel to China Soon after reports of Mao's exit ban surfaced last week, the US-based bank suspended all business travel to the country. "We are closely tracking this situation and working through the appropriate channels so our employee can return to the United States as soon as possible," Wells Fargo told Reuters then. Not an isolated Incident China's use of exit bans can further worsen its relations with the United States. These travel restrictions can prevent individuals—both Chinese citizens and foreigners—from leaving the country if they are involved in legal disputes, ongoing investigations, or sometimes for reasons that are not made public. The US State Department has warned its citizens on multiple occasions to reconsider travel to China. "Exercise increased caution when traveling to Mainland China due to arbitrary enforcement of local laws, including in relation to exit bans," it said in an advisory issued in November 2024. According to the SCMP report, another US citizen—an employee of the US Commerce Department's Patent and Trademark Office—had also been blocked from leaving China a few days ago. The individual has reportedly been stuck in the country for several months, allegedly over national security concerns, the report added.

The court allowed the appeals filed by the accused challenging their conviction and sentences imposed on them by a special court in 2015. Live Events A special bench of Justices Anil Kilor and Shyam Chandak said the prosecution has failed to even bring on record the type of bombs used in the crime, and that the evidence relied on by it was not conclusive to convict the accused. The bench refused to confirm the death penalties imposed on five of the 12 accused and dismissed the confirmation appeals filed by the Maharashtra government.

12 Muslim men jailed for no crime: Owaisi on Mumbai train blasts verdict

After the Bombay High Court acquitted all 12 men convicted in the 2006 Mumbai train blasts case, AIMIM chief Asaduddin Owaisi questioned whether the government would take action against the investigators who probed the serial High Court's verdict, delivered nearly two decades after coordinated explosions in Mumbai's suburban trains killed 189 people and injured over 800, said the prosecution had 'utterly failed' to prove the charges. It also questioned the authenticity of the confessions and pointed to torture, calling the investigation deeply in his acerbic style, wrote on X, '12 Muslim men were in jail for 18 years for a crime they didn't commit, their prime life is gone, 180 families who lost their loved ones, several injured, no closure for them. Will government take action against officers of Maharashtra ATS who investigated this case?(sic)' Tearing into the investigators, Owaisi said, 'In such cases where there is a public outcry, the approach by police is always to first assume guilt and then go from there. In many such terror cases, investigating agencies have failed us miserably.'The Hyderabad MP didn't spare the Congress either, which was in power in the state back then. 'Please remember which parties were ruling Maharashtra in 2006. They are also responsible for disregarding complaints of torture,' he claimed. On July 11, 2006, seven bombs hidden in pressure cookers exploded across first-class compartments of Mumbai local trains within 11 minutes. The state's Anti-Terrorism Squad (ATS) later claimed the 12 accused were members of the banned Students' Islamic Movement of India (SIMI), allegedly linked with Pakistan-based terror outfit Lashkar-e-Taiba (LeT). A special court in 2015 convicted them — five were sentenced to death and the rest to life High Court, however, set aside the verdict after over six months of hearings. It ruled the confessions were inadmissible and noted signs of 'copying' across statements. Making sharp observations bound to leave the Maharashtra ATS red-faced, the court said the accused had "successfully established" that they were tortured to extract the "non-application of mind", the bench held that the prosecution had "thoroughly failed" to prove its case beyond reasonable judgment noted that 'creating a false appearance of having solved a case by presenting that the accused have been brought to justice gives a misleading sense of resolution This deceptive closure undermines public trust and falsely reassures society, while in reality, the true threat remains at large.'- Ends
