Undocumented workers power LA's restaurants. Will the industry protect them?
That all changed on the evening of Friday, June 6, when more than 10 Immigration and Customs Enforcement vans filled the parking lot across from the restaurant, leaving guests and staff "spooked," said co-owner Chase Valencia.
"We were in a position of just reacting and in a state of shock because we didn't know how to respond accordingly," said Valencia, who manages a predominantly Asian and Latino staff.
Since that evening, the Lasita team has weathered canceled reservations and understaffing as the Greater Los Angeles metropolitan area has been swept by fear. Restaurant owners and managers have had to scramble to provide a framework of security and support for their staff, many of whom are undocumented immigrants.
"The industry is deeply confused," said Corissa Hernandez, the owner of Nativo, a Mexican bar and restaurant in Highland Park. "We're alarmed. We're frustrated about the lack of transparency, especially legal clarity.
"We're business owners, we're not immigration experts."
A status quo of undocumented labor
ICE has made sweeping arrests since arriving in the region, resulting in widespread protests as well as a financial downturn for businesses across the county as many workers and customers remain home out of fear of being profiled.
This absence of economic activity has been felt acutely in the restaurant industry, which is staffed overwhelmingly by Latinos and immigrants - 79% and 66% respectively, according to the the Public Policy Institute of California, a nonprofit, nonpartisan think tank.
Immigrant workers have always gone hand in hand with the restaurant industry, said Kevin Johnson, a professor of public interest law and Chicano studies at UC Davis.
"The thing about the restaurant industry is that there are very small margins, and it's hard to stay in business," he said. "Keeping down prices usually means keeping down labor costs. That is where immigrant labor comes in."
Bridgette Blackney, a co-owner of Butchr Bar in Echo Park, said immigrant communities are "willing to work hard, learn fast and show up when others wouldn't."
Over time, she said, immigrants became the "quiet backbone of the industry." Undocumented workers used borrowed or falsified employment eligibility documentation to secure work, and owners tended to not ask too many questions.
"Restaurants offer a rare space where skill can outweigh credentials, and where someone can build a life regardless of their background," said Blackney. "Language fluency isn't always required, training is often on the job and kitchens tend to value speed, dedication and reliability above all."
Know your rights
On June 16, Hernandez hosted a Know Your Rights workshop for people in the restaurant industry. Workers ranging from chefs to managers to line cooks crowded the main bar at Nativo, eager to learn how to respond if the worst happened: an ICE raid at their business.
"Okay, everyone!" An organizer from the South- and Southwest-centered labor movement Organized Power in Numbers gave participants succinct phrases to deter ICE and explained that anything they say can be used against them. "Repeat after me."
"I am not authorized to speak with you."
"I do not want to answer any of your questions."
The presentation - co-sponsored by the Independent Hospitality Coalition, a local advocacy organization for hospitality workers, and Mijente, a Latino social justice organization - was peppered with questions from attendees.
"As much as there is fear, as much as there is confusion, this is the time to really educate yourself quickly and in real time, because what is happening is not OK," Hernandez said.
Johnson added that restaurant leadership attending safety workshops can have a positive emotional impact on staff.
"Part of the benefit of the Know Your Rights sessions is telling human beings who are scared and fearful for themselves and their families that you care about them and want to try to provide whatever assistance that you can," he said. "That moral support right now, I think, goes a long way."
Hayley Porter, a veteran restaurant manager in Highland Park, said she left the workshop with more questions than when she arrived. But, she said, it felt good to open the door to such conversations with her team.
Such grassroots efforts, she said, can be as crucial as marching or calling representatives.
"Can I give you a ride home instead of taking the bus today?" she said, offering an example. "Can we order extra produce and staples from our vendors and send you home with some groceries instead of you being scared to go out to the grocery store?"
Troubling scenarios
During the workshop, news broke that the downtown L.A. curfew had been extended from 8 p.m. to 10 p.m. The Lasita owners in attendance - Steff Valencia and chef Nico de Leon, as well as Chase - faced a new dilemma:
Should they reopen for dinner service, giving their team much-needed hours and offering the business a financial boost? Reservations dropped by 95% the week after the downtown curfew was implemented. After closing for three days, they attempted transitioning hours to a 1 to 6 p.m. lunch service where sales were down 73%.
But part of Lasita's reason for closing was due to fearful staff calling out of work. If they reopened, would they potentially be putting their staff and customers at risk?
"You're trying to respond from a business point of view; you're trying to respond from a personal point of view," said Chase. "You care so much, but you don't even know how to care."
Across town in South-Central, owners Celia and Joe Ward-Wallace of South LA Cafe (SLAC) were navigating a different question: How could they provide support and resources for their staff and community without bringing unwanted attention from ICE upon themselves?
The Ward-Wallace's are vocal figures in the battle for racial justice and recently filed a civil rights lawsuit against the Los Angeles Police Department.
"Right now it's immigrants, but next it's going to be Black people, and next women, and we're seeing already the attacks on transgender and LGBTQIA folks," Celia said. "This is an intersectional issue. This affects all of us."
The pair decided to lean on and share information from local organizations such as the Coalition for Humane Immigrant Rights (CHIRLA), Inclusive Action for the City and the National Day Laborer Organizing Network, rather than centering themselves in the ongoing conversation, said Celia.
They also used SLAC's previously established newsletter subscription base to build a rapid response network, a community-based intervention, in case a raid were to occur.
"It's a lot of pressure to ask a manager or leader on the team to have to deal with ICE. They didn't sign up for that," Celia said. "So [we're] able to say to them, 'Hey, if there's ICE presence, immediately notify Joe and me and the executive team,' but also we're going to notify our rapid response network, and we're essentially alerting the community to say we have trouble on site. We need you to come and just be there, [providing] power in numbers."
'What would you do?'
As restaurants navigate what they can do in times of crisis, part of the frustration stems from reports of illegal tactics employed by ICE. Many videos on social media show agents snatching vendors and workers without presenting a warrant, or detaining and arresting American citizens.
"I think that's the scariest part that everyone is grappling with," said Celia. "We can literally be following our side of action to the letter of the law, and you can basically violate our constitutional rights, and there's no accountability for that."
Restaurants have also had to navigate the stress of not knowing "who is who," said Hernandez, as videos on social media have depicted off-duty ICE agents out of uniform and dining at L.A. restaurants.
On June 12, agents dined at the Silver Lake location of local smashburger chain the Win-Dow. The Win-Dow team members confirmed this interaction, and one employee who declined to give his name called the resulting dynamic - ICE agents eating at local restaurants where kitchen staff is primarily Latino and living in fear - "demeaning."
"It kind of makes you feel like, man, what are you truly doing, you know?" the employee said. "Like, you're coming to do raids, but you're gonna come and eat the food we prepare for you. We give you this hospitality, but you come in here and try to be hostile in our city."
News of ICE agents dining at the Win-Dow spread on social media, with Instagram users leaving comments criticizing the restaurant for not turning the agents away. The Win-Dow has so far not addressed any of the comments or posted a statement on social media, but employees told The Times they achieved the best-case scenario given the risks.
"What would you do?" said Paul Hibler, founder of American Gonzo Food Corp., which owns the Win-Dow in addition to local chains Pitfire Pizza, Superba and American Beauty. "Do you want to refuse service to somebody that would draw attention to you?"
"This is where we are right now in America," he added. "We're trying to figure out what we're supposed to do."
Out of the confusion, defiant solutions have emerged. Now, when the Win-Dow employees exit the kitchen to the Sunset Triangle Plaza, they immediately swivel around and lock the door tight. Managers in the area have started a group chat to keep each other informed about ICE movements, according to several working on Sunset Boulevard.
And when Lasita did reopen - on June 17, the day after the workshop - it was with new enforcements:
"STOP, This is a Private Space for Employees Only, No Public Entry," read signs posted in the back of house. Hosts and servers were given prompts to read in case ICE attempted to raid the restaurant. And the owners are working on an official emergency protocol to give to staff, whom Chase said feel more confident now that there is an open dialogue about safety protocol.
"A lot of people open their businesses because it was a dream of theirs to have these spaces, but there is a sense of responsibility that we owe our team," Hernandez said. "Our industry doesn't exist without immigrants, and it is morally wrong to not be there for those that have created the opportunities that we are able to realize at this point."
"They've had our backs," she added. "It's time to have theirs."

Late-night noise latest tactic used in LA immigration protests: ‘No sleep for ICE'
The clanging of pots and pans. The steady thud of beating drums. The honking of passing cars with waving flags sticking out of the window. Bands playing traditional Mexican songs. Speakers shouting into megaphones. Chants coming from dozens of people. All unfolding into the middle of the night outside the Home2 Suites by Hilton in Montebello, California, in late June. The goal of this latest protest? Make as much noise as possible to try and keep U.S. Immigration and Customs Enforcement officers from sleeping and force them elsewhere. 'They were just making noise, playing music, and some people were dancing,' said Verita Topete, a leader of the immigration committee with Centro CSO, who took part in the protest. 'A lot of people were holding signs saying, 'ICE is not welcome here.'' She said she arrived by 8:30 p.m. on June 20, and before she knew it, a crowd began to show up on the sidewalk outside the hotel. By 10 p.m., dozens more protesters joined the group, and they didn't disperse until 3 a.m. Topete said that the next day, they returned with enough people to take over the two-lane street to block people from going into the front of the hotel. The protests were part of a nightly 'No Sleep for ICE' campaign in and around Los Angeles County, where protesters gather outside the hotels where ICE agents are staying and make noise to put pressure on the hotel staff to kick ICE out and prevent agents from sleeping. Topete said the protest is important 'to apply pressure and let city and state officials know that we don't agree with this' at a time when 'ICE agents are hunting down our working class community members as if they're criminals, throwing them to the pavement and taking them away from their workplaces.' During the second night in Montebello, Topete said a band showed up with drums and guitars and many people were dancing to traditional Mexican songs like "Caballo Dorado" and "La Chona." Others attended with their families. While most people were on foot, others passed by in their cars, waving Mexican flags and honking their horns. 'It was a very peaceful protest, just very noisy,' she said. An ICE spokesperson pushed back on the protests when asked for comment about the demonstrations outside of hotels. 'This violence is fueled by a disinformation campaign, which includes dangerous rhetoric by local elected officials," the ICE spokesperson said. "Our brave officers are out there every day enforcing the laws set by Congress, removing public safety threats from communities.' A spokesperson for Hilton Hotels did not return a request for comment. Other noise protests include one on June 8, two days after ICE began its raids in Los Angeles. Community members rallied outside the AC Hotel in Pasadena, about 10 miles from Los Angeles, to protest ICE agents' staying there. Hundreds of people had shown up outside the hotel in the early afternoon after a photo of ICE vehicles parked outside the hotel circulated on local group chats and social media pages. When some of the first protesters arrived, they learned that many of the hotel workers had left in fear. They chanted 'Chinga la Migra' and 'Fuera ICE,' and by the evening, the agents were kicked out of the hotel. Since then, protesters have continued rallying together outside hotels every night. 'The point is to drive ICE out of these hotels, and make their existence impossible here,' said Andrew Guerrero, a law student at the University of California, Los Angeles and PhD candidate at Harvard University. 'We don't want them to be able to access these amenities. We don't want our local neighborhoods to be harboring what a lot of us consider kidnappers.' Guerrero said he has attended multiple protests outside hotels in Los Angeles County, including ones in Hacienda Heights, Downey, Long Beach and Montebello. He said the protests 'let it be known that they cannot sleep peacefully when they're in our neighborhoods.' He attended a protest outside the Hilton in Montebello the day before Topete. When he got there around 11 p.m., he said there were already dozens of people, significantly larger than some of the other hotel protests he had been to. He said he brought pots and pans, a speaker, and a case of water for the protesters. 'It's like a little community building around it,' Guerrero said. 'Folks are going to multiple protests in one night and sharing resources and knowledge about what's happening and trying to keep each other informed.' Guerrero said the protests have also drawn support from those staying at the hotel. He said one man who came out of the hotel was nodding at the protesters, and another family going into the hotel gave them a thumbs up. He said that he sympathizes with anyone else staying there who might feel like 'it's creating a hostile environment,' but he believes 'it is a legitimate and just reason that this disruption is occurring.' 'It feels like we're under an occupation, and you just hear back-to-back stories, like, 'They took this person, they took this person,'' Guerrero said. 'They're literally disappearing people.' Some protests have been met with law enforcement resistance. When Kuali Aleman, an indigenous organizer and artist, arrived at a protest outside the DoubleTree by Hilton in Whittier, California, on June 11, she saw many people marching up and down the street with flags and signs. Other protesters stood huddled by the entrance of the hotel, chanting 'no one is illegal on stolen land' and 'get the f out of LA.' People were also blasting music through speakers and their cars or revving their motorcycles. But not long after that, Aleman said the Whittier police came out of the hotel and began launching less lethal weapons into the crowd. She said the protesters ran for cover, but not long after, they came back and resumed the protest. 'We just continued to protest and raise our voices because we don't like what's happening,' Aleman said. 'We demand answers because our friends or their relatives, neighbors, kids, adults, everyone of all ages, of all backgrounds, are being abducted.' The Whittier Police Department did not respond to requests for comment. Aleman said the decision to send federal agents to hotels in Los Angeles is a waste of resources that could otherwise have been put into community resources. 'It just doesn't make any sense to concentrate all our resources and manpower or people power on capturing hardworking people, people who are just trying to survive, selling fruit on the street or working in construction or on the fields or working anywhere, just not committing any crimes,' Aleman said. Topete said it is 'crazy to see how many cities are allowing ICE agents' to stay in their hotels. However, she said she is proud to see people taking to the streets to protest peacefully. 'I love seeing that the community is coming out and speaking up for undocumented community members that are being kidnapped,' Topete said. 'We have power over authority if everybody were to unite and come together, they just need to be fearless and not be scared to stand up for our people.' Justice Department sues Los Angeles to end 'sanctuary' immigration policies
WASHINGTON – The Department of Justice filed a lawsuit on June 30 against the city of Los Angeles to end policies that restrict cooperation with President Donald Trump's enforcement of immigration laws. The lawsuit comes after sometimes violent protests in Los Angeles earlier in the month against federal Immigration and Customs Enforcement officials, which led Trump to mobilize the National Guard. It is the latest to challenge so-called 'sanctuary' policies, in which state or local law enforcement do not collaborate with ICE, which the Trump administration contends are unlawful. The department has also sued New York state and filed criminal charges against a Wisconsin judge over immigration enforcement. It also sued federal judges in Maryland on June 25 for blocking deportation orders. 'Sanctuary policies were the driving cause of the violence, chaos, and attacks on law enforcement that Americans recently witnessed in Los Angeles,' Attorney General Pamela Bondi said in a statement. 'Jurisdictions like Los Angeles that flout federal law by prioritizing illegal aliens over American citizens are undermining law enforcement at every level – it ends under President Trump," Bondi added. ICE raids earlier this month in Los Angeles sparked several days of protests that included people hurling rocks at federal officials and setting fire to cars. Attacks on federal officials are up 500%, according to the Department of Homeland Security. Los Angeles Mayor Karen Bass didn't immediately reply to a request for comment. But she and California Gov. Gavin Newsom have opposed Trump's tougher immigration enforcement and said the federal mobilization enflamed tensions. 'Unmarked cars. Masked men with guns. People being snatched off the street,' Bass said on social media June 28. 'This isn't law and order − it's fear and chaos in Los Angeles. And it's deliberate.' Protesters have resorted to clanging pots and pans outside a hotel where ICE agents were staying, to prevent them from sleeping. The Los Angeles Dodgers baseball team said they denied federal agents access to the stadium's parking lot on June 20, although federal officials said there was no enforcement action. But federal officials said they would continue strict enforcement of immigration laws, one of Trump's top domestic priorities. "We will keep enforcing federal immigration law in Los Angeles, whether or not the city's government or residents agree with it," Chad Mizelle, the department's chief of staff, said on social media. "And we will not tolerate any interference with the federal government's duty to enforce the law."
