
South Africa, look to the Freedom Charter
Seventy years on, as South Africa reflects on the charter's legacy, the question is: has the dream been deferred? Is the charter a moral compass that can guide the country away from corruption, inequality and political disillusionment and back to our better selves?
This year's commemorations unfold under a dark cloud — a public fallout between the KwaZulu-Natal police commissioner and the police minister over alleged ties to criminal networks and tenderpreneurs.
Generations of activists, cadres and civic leaders placed their hopes in the Freedom Charter, seeing in it a roadmap to liberation. But even as it was being drafted, apartheid's machinery was already erasing the very communities that embodied those ideals.
The Group Areas Act (7 July 1950): Apartheid was in full stride, enforcing the Act, one of its most brutal instruments. This law forcibly removed hundreds of thousands of black, Indian, coloured and Chinese South Africans from inner-city areas of Johannesburg such as Fordsburg, Pageview and Vrededorp.
As activists in Kliptown imagined a non-racial democracy, trucks and trailers loaded with furniture and frightened families rolled down the streets. They were carted off to racially zoned outposts — Lenasia for Indians, Eldorado Park for coloureds, Soweto for Africans — grim apartheid gulags far from the economic and cultural lifeblood of the city.
This was not isolated. The Act segregated cities and rural areas and dismembered communities throughout South Africa.
From Durban's Cato Manor and Warwick Avenue Triangle to Cape Town's District Six and the mixed suburbs of East London and Port Elizabeth, the Group Areas Act tore through multiracial communities like a wrecking ball. It erased history, memory, identity. The irony was stark: while the Congress Alliance was fine-tuning the most progressive political document ever to emerge from colonised Africa, the apartheid state was redrawing the map with bulldozers and police.
The Congress of the People (26 June 1955): A historic gathering in a divided nation. Representing the ANC, the South African Indian Congress, the Coloured People's Congress, the Congress of Democrats and the South African Congress of Trade Unions, more than 3 000 delegates — workers, students, religious leaders, professionals — descended on Kliptown. They gathered in makeshift tents, surrounded by spies and state agents, and proclaimed the charter's enduring declaration: 'South Africa belongs to all who live in it, black and white.'
This was no mere manifesto. It was a moral declaration and revolutionary charter, forged in unity across racial and ideological lines, and it transformed Kliptown into sacred political ground.
But Kliptown was not only the site of vision, it was a victim of apartheid's violence. Once a vibrant, multiracial township like District Six or Sophiatown, it was gutted by the Group Areas Act, its dynamic cultural life replaced by decay and marginalisation.
Lenasia: A paradox born of pain. One of the Act's most visible legacies is Lenasia, established as a segregated Indian township but later transformed through grit and community spirit into a story of survival and reinvention.
Lenasia's success rests on four pillars: entrepreneurship, education, cultural cohesion and political activism. Small businesses, from cafés to wholesalers, became the backbone of a self-sustaining local economy. Sacrifices by working-class families produced generations of professionals. Mosques, temples and community halls fostered unity and resistance. Lenasia produced leaders and journalists who fuelled the anti-apartheid movement.
Today, Lenasia has malls, new schools and clinics. But inequalities persist. Its story mirrors that of South Africa: potential stifled by paradox, promise shadowed by injustice.
The Charter's legacy and the Indian contribution: South Africans of Indian descent played a pivotal role in drafting and defending the Freedom Charter. Braving bans, detentions and threats, they stood with comrades of all colours. Among them were Dr Yusuf Dadoo; Ahmed Kathrada; IC Meer, Nana Sita, Kay Moonsamy, Debi Singh, Thambi Naidoo (Jr), Monty Naicker, Dr K Goonam and Swaminathan Gounden — each fearless in defiance.
As Kay Moonsamy put it: 'Our struggle was not for favours, it was for freedom.'
The apartheid state retaliated. In 1956, 156 leaders were charged with treason, including Chief Albert Luthuli, Nelson Mandela, Helen Joseph and Yusuf Dadoo. The trial ended in acquittals in 1961.
A long arc of struggle:
1955, the Freedom Charter is adopted in Kliptown;
1956-61, the Treason Trial;
1960s-80s, the Charter is the underground symbol of resistance;
1990, the ANC is unbanned and Mandela released;
1994, the first democratic elections;
1996, the Constitution is adopted, echoing the Freedom Charter.
As Justice Albie Sachs said: 'The Constitution of 1996 is the legal child of the Freedom Charter.'
Today, Kliptown is both a heritage site and a cautionary tale. The hall still stands, but around it are informal settlements, failing infrastructure and unemployment. It's a metaphor for a democracy unfinished.
To read the Freedom Charter today is to hear both a dream and a rebuke. Its bold declarations:
'The People Shall Govern!
There Shall Be Work and Security!
The Doors of Learning and Culture Shall Be Opened!
The Land Shall Be Shared Among Those Who Work It!'
These were demands for justice, dignity and equality. The gulf between Zimbali Estate's affluence and Cato Crest's deprivation, between District Six's memory and the Cape Flats' misery, reminds us how far we have to go.
The Freedom Charter remains a living document. Its power lies not in nostalgia, but in renewed action and radical hope.

MK Party urges patience as Zuma 'narrows down' shortlist of candidates for new secretary-general
The MK Party has called on its supporters to be patient as party leader Jacob Zuma finalises the appointment of a new secretary-general to succeed Floyd Shivambu. 'The president will soon call the national leadership and announce who will take over the SG position. He is still assessing, he asked that he not be rushed because he doesn't want to repeat past mistakes,' the party's head of presidency Magasela Mzobe said in Durban on Friday. 'Many people are eyeing the position but the president's priority is a candidate who can maintain stability and respect the chain of command without letting the role's importance go to their head,' he added. Mzobe was addressing MK Party supporters who had come to back former youth leader Bonginkosi Khanyile in his civil unrest trial at the Durban high court. Khanyile is facing charges of incitement of violence and contraventions of the Disaster Management Act related to the July 2021 civil unrest that followed Zuma's incarceration for contempt of court. Khanyile has often been mentioned as a possible candidate for the SG role since Shivambu's removal and on Friday party supporters chanted his name as Mzobe spoke about the position. His longtime ally Philani 'Gazuzu' Nduli, who is also a leader in the party's youth structures, has been campaigning for him on social media. However, Mzobe warned against speculation, saying Zuma was on the cusp of naming the new appointee. 'Let's not disturb him by bringing up names, he's almost there. He has narrowed down his shortlist of candidates from seven names to three and if we can give him a week he may reach a decision on that one name.' Shivambu was axed from the position at the beginning of June after a controversy surrounding his unsanctioned Easter visit to fugitive pastor Shepherd Bushiri in Malawi. Since then, the party has been plagued by internal squabbles in and outside parliament, including the well-publicised conflict between deputy president John Hlophe and Nhlamulo Ndhlela and Duduzile Zuma-Sambudla, and former Mpumalanga leader Mary Phadi torching the party's constitution after losing a court battle to Busisiwe Mkhwabane. Mzobe tried to downplay that, reassuring that supporters that they were 'small issues' instigated by the fallout with Shivambu. 'He (Zuma) wanted to calm your nerves on the media reports that makes it look like the party is in trouble. It's a small issue of a man he entrusted with the role of secretary, but that man acted in his own interests and ultimately had to be removed when more issues came to light about him, both locally and abroad. 'When he was redeployed he thought he was too big in the party to be disciplined and started his movement that we are not involved with as a party. We ask you to not take part in the plans that the comrade is busy with because they are not what the MK stands for.' Shivambu has since taken jibes at the party and has started a 'Mayibuye consultation process', where he is consulting the public on whether he should establish a new party, while maintaining he would remain a member of the MK Party. Khanyile drew parallels between his and Shivambu's situations in the party, pointing out he was also removed from his position as a founding leader of the youth. 'I was sure that I was the most effective leader; a leader with clarity and educated with more than five degrees.' He stated, however, that their responses to those situations differed, pointing out that he remained committed to the party when he was stripped of a position while Shivambu looked to be jumping ship and starting his own party. 'When you think the organisation is mistreating you and remain truthful to the party, that's when we can tell that you're a true volunteer and revolutionary of the organisation. You can't be removed today and tomorrow you're no longer a volunteer, even if you're the most educated and civilised person in society. As you expect to lead, you must also expect to be led.' Khanyile said he was sceptical about the prospects of the Mayibuye process, predicting it would not succeed. He urged supporters to welcome Shivambu back when that eventually happens. 'We don't hate Floyd Shivambu because we are led by president Zuma. He is going to fail in Mayibuye and come back here in the MK. Healing the wounds of the July 2021 unrest: a path to unity and reconciliation

On the 4th anniversary of the July 2021 unrest, RAVI PILLAY explores the ongoing challenges of nation building in South Africa, the need for unity, and the importance of the National Dialogue in healing our communities 'TOWARDS Nation Building' is the title of a comprehensive submission that some of us made to the Human Rights Commission at its national investigative hearing into the July 2021 unrest. As we approach the 4th anniversary of this most traumatic period in our democratic era, we have to confront the reality that we have not moved forward towards nation building. At best we have treaded water. Many will argue that we have regressed. I remain convinced that there is an overwhelming body of goodwill among the majority of our people who are ready to support any credible effort towards unity and nation building. Yet there remains this wound that has not healed and which without care, may fester. Some 350 people died. Their families need closure. The issues are complex and difficult. I am inspired by the potential of the National Dialogue. It is the first opportunity since the Freedom Charter in 1955 (it is the 70th anniversary this year) and the adoption of our Constitution in 1996, for a grass-roots, people driven conversation and a new, substantially national, consensus and direction. The July 2021 unrest could be one important part of the conversation, especially in our province of KwaZulu-Natal. Our submission to the HRC was comprehensive. It is useful to recall a few salient aspects: We remain deeply committed to the building of a united, non-racial society and entrenching the values espoused in our Constitution - 'heal the divisions of our past and establish a society based on democratic values, social justice and fundamental human rights'. We cannot avoid the characterisation of the unrest as an "attempted insurrection" which included: incitement primarily through an intensive social media campaign; mobilisation by highlighting grievances relating to poverty and unemployment; incentivising by using money to instigate as documented; and organising through the use of "advance teams" who would break into identified targets creating access for others to loot, and then setting fire to property in a manner designed to cause maximum damage. One security expert suggested that the organized objective was to provoke an over-reaction from security forces leading to mass deaths which in turn lead to a mass uprising leading to a collapse of the state. The economic damage was devastating and calculated at R50 billion. Not many knew that we were 48 hours away from a full-blown food crisis. Fuel trucks were unable to refuel petrol stations. Delivery trucks were unable to reach retailers – the shelves were empty. It took an extraordinary effort to restore fuel supplies, secure the roads and replenish supplies in time. The submission also reflects on corruption and the culture of impunity that had developed leading to the type of complete lawlessness that was witnessed. The role of the police, the intelligence services and lack of coordination until the SANDF was deployed, and delayed at that. At least 350 people died. Initially all of these deaths were attributed to the Phoenix area until it was clarified that the Phoenix mortuary served a very large area beyond Phoenix. It was finally assessed that 36 deaths occurred in the Phoenix area. But the damage had been done. Phoenix became the focus area and it was alleged that the deaths were racially motivated. The narrative held. Rational analysis became impossible. Others asked: did the killings cause the unrest? Or, did the unrest cause the killings? We must refuse to be stereotyped whichever community we may hail from. The Human Rights Commission subsequently produced a report that made various credible findings and recommendations and does not use the highly provocative term 'massacre'. The Commission for Religious and Linguistic Rights produced a 'report' that consisted of some 21 slides. Despite repeated requests it was only some two weeks ago on June 25, 2025, that we were provided with a full report. Notwithstanding very grave reservations, patriotic South Africans must be committed to working with our chapter 9 institutions and all stakeholders to implement the many progressive recommendations that have emerged. However, progress has been slow. Prosecutions have been few and far between. The main instigators still escape accountability. This has to be challenged. It is very important to record that the submission to the HRC includes inter alia the following: '. . . we too are outraged and appalled by the brutality of the violence that marked several of the incidents. We condemn the perpetrators who carried out these vicious acts, without qualification …' Our humanity demands that we recognise those innocent people who were victims of the violence and that there is pain and suffering which endures until today. There are individuals and families who need closure. The Human Rights Commission and Commission for Religious and Linguistic Rights are jointly embarking on a process that seeks to bring this closure. It is a process that raises many difficult issues but the intention is in good faith and seeks to bring communities together and promote reconciliation. However not enough groundwork has been done. The commissions understand this and therefore resolved that on this anniversary they cannot go beyond launching the process. We await announcements in this regard. While experts in these social processes will be essential, it is clear that this initiative cannot succeed without the active participation of community organizations and leaders. Religious leaders in particular have a special role to play. Finally, as we reflect on this 4th anniversary, and in anticipation of the National Dialogue, we must draw a distinction between the very important soft issues of humanity or Ubuntu, religion, culture, language and sport on the one hand, and economic inequality on the other. We must resist those who seek to infuse a toxic overlap between race and inequality. An economic growth and development vision that is fair and just for all becomes fundamental to a sustainable future for all South Africans.
