The Chhattisgarh High Court recently acquitted a man and his father in a 12-year-old matrimonial suicide case, ruling that mere quarrels and derogatory remarks in a marriage cannot amount to abetment of suicide unless there is extraordinary provocation or sustained cruelty.
The court was hearing an appeal filed by Kamal Kumar Sahu and his father Kaliram Sahu, who were convicted in 2016 by a Raipur sessions court for abetting the suicide of Kamal's wife, Sunita Sahu. The trial court had sentenced both to seven years of rigorous imprisonment under Section 306 read with Section 34 of the IPC.
Sunita had died on January 5, 2014, after sustaining severe burn injuries at her matrimonial home on December 31, 2013. The prosecution alleged that the deceased was humiliated and called 'Charkat' (a derogatory term) by her husband and father-in-law after she served food to a mason, which drove her to take the extreme step.
However, setting aside the conviction, the bench of Justice Bibhu Datta Guru held that the evidence on record did not satisfy the legal requirements to establish abetment under Section 306 IPC.
'Derogatory remark or quarrel by husband/in-laws in matrimonial life alone cannot be considered sufficient to the extent to constitute abetment unless something extraordinary, more than normal wear and tear of married life, is shown on or just before the date of incident," the court observed.
The judge relied on Supreme Court precedents, including Ramesh Kumar v. State of Chhattisgarh (2001) and Kumar @ Shiva Kumar v. State of Karnataka (2024), to clarify that for a conviction under Section 306, the prosecution must prove a clear and proximate link between the alleged act of instigation and the suicide.
The high court noted that Sunita and Kamal had been married for over 12 years and had two children. 'Thus, the ingredients of presumption of abetment of suicide that the suicide has been committed within seven years from the date of her marriage were not proved," the court added.
Further, court found no evidence of dowry demands or sustained cruelty. The only allegation was of repeated quarrels and the utterance of a derogatory term, which, according to the court, fell within the realm of 'normal wear and tear" of matrimonial life.
Therefore, setting aside the trial court's judgment, the high court stated, 'I am of the view that the prosecution has failed to prove its case and the trial court has not properly appreciated the evidence".
The court allowed the appeal, acquitting both appellants and directing that their bail bonds remain valid for six more months under Section 437A CrPC.

"After being granted bail, Veeru and his family members continued to abuse us and issued death threats because we lodged a case against him. When I refused to withdraw the case, they conspired to have a deadly attack carried out on me," Geeta said in her complaint. Raipur: In a first-of-its-kind initiative, Chief Justice Ramesh Sinha of Chhattisgarh High Court directed that penalties imposed in various court cases be deposited in homes for children with disabilities and in child observation homes. This initiative aims to ensure the holistic development of children residing in these institutions. Between 11 Sept 2024 and 11 July 2025, a total of Rs 4.02 lakh from penalties in various court cases was ordered to be deposited across child observation homes and homes for physically and mentally challenged children in different districts of the state. Of this amount, Rs 2.06 lakh was deposited in institutions for children with disabilities, and Rs 1.79 lakh in child observation homes. The funds will be utilised by these institutions to provide quality education, better healthcare facilities, sports equipment, educational books, and organise various activities for the mental development of the children.

Chandrapur: Acting swiftly on a housebreaking complaint filed in Chimur town, the local crime branch (LCB) of Chandrapur police cracked the case within 48 hours, arresting two suspects and recovering stolen gold ornaments weighing 38 tolas (approximately 370 grams). According to the Chimur police, the complainant, Kalpana Murlidhar Gonnade (46), a resident of Pragati Nagar, had locked her home and left for Gandhi town on the afternoon of July 6. Upon returning on July 11 around 6pm, she discovered the lock on her front door broken and valuable jewellery missing from a drawer in the bedroom. The stolen items included gold necklaces, bangles, earrings, finger rings, a nose pin, and other ornaments, collectively weighing over 38 tolas, which were valued at over Rs8.49 lakh, said police. An offence was registered under IPC sections 305(a), 331(3), and 331(4) against unknown persons at Chimur police station. Multiple search teams from the LCB were deployed to trace the accused. After a thorough investigation, the LCB team identified and apprehended two suspects — Sachin alias Badshah Santosh Nagarale, a resident of Gautam Nagar, Bhadravati, and Gopal alias Bada Kobra Jeevan Malkar (25), a resident of Shyam Nagar, Chandrapur. During questioning, both confessed to the crime, following which the entire stash of stolen jewellery was recovered, said police. The accused have been handed over to Chimur police. The operation was carried out by the team led by API Deepak Kakredwar and API Balram Zhadokar.
