The Central Board of Film Certification (CBFC) on Wednesday told the Delhi high court that certain offending portions of the movie 'Udaipur Files', relating to the 2022 brutal murder of a tailor Kanhaiya Lal, had been taken down. 'Offending' parts of 'Udaipur Files' taken down: CBFC to HC The CBFC represented by additional solicitor general (ASG) Chetan Sharma submitted before a bench of chief justice DK Upadhyay and justice Anish Dayal that the board before granting certification to the movie, slated to be released on Friday, had proposed certain cuts, which have been affected. 'We've addressed all the issues as has been raised in the petition. These are the offending portions, references and dialogues, they have all been taken down by the central board. Anything which could have been offensive has been taken down,' Sharma submitted. The movie's producer submitted that the cuts, as suggested by CBFC, had also been implemented. Taking note of the submission, the court suggested the petitioner, Jamiat Ulema-e-Hind president Maulana Arshad Madani, to see the edited movie and directed the producer to arrange a special screening on Wednesday. This was after Madani's lawyer Kapil Sibal urged the court to view the edited version of the movie, saying that even if the board had taken down the alleged offending portions, there was still a problem, since its theme was to fuel violence and intended to target a 'particular community'. 'Before we make a decision (to go for screening or not), we're requesting you to go through those cuts and come before us tomorrow. The film needs to be viewed by you,' the court said to Madani's counsel Kapil Sibal. Accordingly, the court, while listing the plea seeking to stall its release and quash the CBFC certificate for Thursday, in its order said, 'In these circumstances we require the producer to arrange the screening of the film at the convenient time'. Even as the high court issued the direction, the Supreme Court in the morning refused to urgently hear a plea filed by one of the accused Mohammad Javed, also seeking a stay. 'You make a request before the concerned court on the opening day (July 14),' a bench of justices Sudhanshu Dhulia and Joymalya Bagchi, sitting during the partial court working days, said. Madani's plea painted a picture that the movie is 'highly provocative', capable of inciting communal tensions and disturbing public order. It went on to add that even its trailer had the potential to incite communal discord and presented a deeply divisive and inflammatory narrative, since it included references to the sensitive and sub judice matter of Gyanvapi Masjid, currently pending before the Varanasi district court and the Supreme Court and amplified the controversial statement made by former Bharatiya Janata Party (BJP) spokesperson Nupur Sharma. Lal was murdered in June 2022 with a cleaver in Udaipur district, Rajasthan, for allegedly sharing a social media post endorsing the disparaging remarks made against Prophet Muhammad by former Bharatiya Janata Party (BJP) spokesperson Nupur Sharma. She made the comments while participating in a television debate in May 2022. The assailants, who were arrested by the Rajasthan police, even prepared a video claiming responsibility for the murder. They even displayed the weapon of offence used for the crime. Considering the sensitivity of the case, the matter was probed by the National Investigation Agency and the accused was charged under the Unlawful Activities Prevention Act (UAPA). The trial in the case is pending before a special NIA court in Jaipur.

The Central Board of Film Certification (CBFC) on Wednesday said it was willing to revise its earlier demand for 96 cuts in the Malayalam film 'JSK: Janaki v/s State of Kerala' to just two cuts, which the producers of the film agreed to, marking the end of a three-week legal tussle. Advocate Haris Beeran, appearing for the producers, told reporters that his client agreed to the changes suggested by CBFC as they were facing mounting financial losses due to the delay in the release of the film. 'This is a case that we can win 100% on appeal. But, the producers have taken a commercial call. They are facing financial losses due to the delay in the film's release. They also have an OTT deal that they have to adhere to. That's why, they have agreed to make the changes. The high court has ordered CBFC to grant the censor certificate within three days of re-submission of the application. So hopefully, the film can release by next Friday,' Beeran told reporters. The Censor Board had earlier refused to grant certification unless the title was changed, citing potential religious sensitivity, as 'Janaki' is also an alternative name for the Hindu goddess Sita. Pravin Narayanan, the film's director, said that they would attempt to make the changes and re-submit the application for censor certificate within the next two days. 'We have reached an amicable solution. As an artiste, it's difficult to make such changes, but somewhere, we will have to compromise,' he said.

Though the affidavit was placed before the Kerala HC, which heard the case Tuesday, the document was not taken up for consideration after the court was told that the CBFC was ready to greenlight the film for release if the producer changed the title from Janaki vs State of Kerala to 'Janaki V' and mute the name during the cross-examination scene in the movie. Appearing for the movie producer, advocate Haris Beeran agreed. The CBFC's counsel Abhinav Chandrachud assured the court that once the revised version of the movie is submitted, the board would grant it censor certification within three days. What CBFC affidavit said The CBFC's 22-page affidavit gave elaborate reasons for the board's refusal to give it a censor certificate. It said that 'Sita holds profound religious significance in the Ramayana' and is 'revered for her devotion to Lord Rama, spiritual dedication and her sacrifice in abandoning a comfortable life to accompany her husband during his 14-year-old forest exile in accordance with Rajya Dharma'. It accused the producers of deliberately appropriating the name of Goddess Janaki/Sita for their lead character with the 'intention of exploiting and distorting her sacred identity'. 'Producers are aware that the name of the goddess Janaki holds deep reverence in the collective consciousness of the masses and have therefore intentionally chosen this title to capitalise on her religious significance,' the board submitted in its affidavit, insisting that the film's release in its preset form would set a dangerous precedent and open a 'Pandora's Box' for future productions. The board also felt that the film will embolden other movie producers to appropriate sacred religious names for characters in 'similarly inappropriate and offensive subject matter, thereby systematically undermining religious sentiments across communities and posing a serious threat to public order.' To the producer's contention that their film is not the first one where a character is named after a goddess, the board drew a distinction between the ones released previously and the film currently in question. In none of those previous films was the sacred name associated with sexual violence or systemic injustice, it argued. Stating that freedom of speech and expression is not absolute, the CBFC contended that the certification process is a 'careful balance between creative freedom and regulatory oversight'. While it safeguards a filmmaker's rights through a multi-tier review mechanism, the broader public interest is protected through the application of established guidelines and constitutional principles, it added. The CBFC accepted that it had given clearance to the teaser, while clarifying that the same cannot be a ground to grant clearance to the movie in entirety. It also advised the court to exercise judicial restraint when it is called upon to interfere with the decision of a specialised statutory body, particularly those entrusted with domain-specific expertise.
