Kerala urges Supreme Court to dismiss president's reference about timelines for bills assent
In its application, the state argued that the reference was an attempt to reopen and overturn the Supreme Court's April ruling in Tamil Nadu government's case against the governor.
On July 22, the court issued notice to the Union government and all states on the reference made by President Droupadi Murmu under Article 143 of the Constitution.
According to Article 143 of the Constitution, the president may refer any question of law or fact of public importance to the Supreme Court for its opinion. The president makes such a reference based on the advice of the Union council of ministers.
In May, referencing 14 questions, Murmu asked whether the actions of governors and the president could be tried in court and whether such timelines could be imposed on them in the absence of any such provision in the law.
The president also said that Article 200 and Article 201 of the Constitution do not prescribe deadlines or specific procedural requirements.
In light of the reference, the Supreme Court set up a Constitution bench comprising Chief Justice BR Gavai, and Justices Surya Kant, Vikram Nath, PS Narasimha and AS Chandurkar.
In its application on Monday, Kerala argued that the reference was based on an 'erroneous statement' that Article 200 does not stipulate a time frame for governors to act on bills, Live Law reported.
The state said that 11 out of the 14 questions raised by the president had already been addressed in the Supreme Court's ruling in the Tamil Nadu case.
It alleged that the reference was a 'serious misuse' of Article 143, the legal news outlet reported.
Kerala also said that the Union government had not filed a review or curative petition against the April judgement and had therefore accepted it.
SC's ruling on Tamil Nadu versus governor
The ruling on April 8 had come on a petition filed by the Tamil Nadu government after Governor RN Ravi did not act on several bills for more than three years before rejecting them and sending some to the president.
In its judgement, the court held that governors must decide on bills within a reasonable time and cannot delay indefinitely under Article 200. Similarly, it said that the president must act within three months under Article 201, and any delay beyond that must be explained and communicated to the state government.
Both sections outline the process of assent to bills by governors and the president.
The judgement had also introduced the concept of ' deemed assent ' in cases of prolonged inaction by the governor or president, allowing pending bills to be considered approved.

Unfortunately, Ballari's civic issues show that the authorities have forgotten this. Despite slogans like Swachh Bharat, our streets remain filthy. If our problems are not addressed, what is the point of having a municipal corporation?' Retired inspector and BNHS advisor Murtuza Saab, who helped lead the month-long preparations for the convention, said that over one lakh signatures have already been collected in support of the demands. 'This has already forced the municipal body to carry out some minor works. This is the power of people's movements,' he noted, urging citizens to intensify their participation in future protests. Presiding over the meeting, BNHS district coordinator R. Somashekhar Gowda said that the municipal corporation is creating new civic problems instead of solving the existing ones. 'Residents must form local citizen committees and fight back. Struggle is the only way forward,' he said. BNHS advisor and industrialist Shyamsundar, executive committee members N. Pramod and A. Shanta addressed the gathering. Information on the problems affecting various neighbourhoods and possible solutions was shared. A new 47-member action committee was formed to spearhead future efforts. The committee plans to submit a memorandum to the Mayor on Wednesday. The convention witnessed participation from numerous resident welfare associations and citizens across Ballari.

'Don't undermine power of court': SC says no interim stay on Bihar voter revision, asks EC to accept Aadhaar
The Supreme Court on Monday refused to put an interim stay on the publishing of draft electoral rolls in Bihar, with Assembly elections in the state slated to be held soon. The SC bench observed that the last order passed by the top court noted the petitioners not pressing for interim stay. (ANI) While passing the order, the SC said it would once for all decide the pleas against the Election Commission of India's (ECI) special intensive revision (SIR) of the electoral rolls. The bench of Justices Surya Kant and Joymalya Bagchi said they would on July 29 fix the schedule for conducting a final hearing on the matter. Appearing for NGO Association for Democratic Reforms, Senior advocate Gopal Sankaranarayanan submitted before court that the electoral rolls should not be finalised in the interim, and asked for a stay on publishing them on August 1. The bench observed that the last order passed by the top court noted the petitioners not pressing for interim stay. Replying to this, Sankaranarayanan said the interim relief of stay was not pressed because of SC's assurance that the matter would be listed for hearing before August 1. However, the bench said that the stay could not be granted now and the pleas would be decided once for all. 'Don't undermine the power of the court. Trust us,' the bench said, adding that if court was in agreement with the submissions and if any illegality was found, everything would be quashed 'there and then'. SC asks EC to continue accepting Aadhaar, voter cards Meanwhile, the SC also asked the EC to continue accepting Aadhaar cards and voter IDs for the SIR in Bihar and comply with its order stating that these documents had a 'presumption of genuineness'. The top court reiterated the July 10 order by a bench headed by Justice Sudhanshu Dhulia, which had asked the poll body to consider Aadhaar, voter and ration cards as valid documents. 'As far as ration cards are concerned we can say they can be forged easily but Aadhaar and voter cards have some sanctity and have presumption of genuineness,' the bench said.
