Alphabet's Google on Thursday failed to persuade a US appeals panel to overturn a jury verdict and federal court order requiring the technology giant to revamp its app store Play.The San Francisco-based 9th US Circuit Court of Appeals rejected claims from Google that the trial judge made legal errors in the antitrust case that unfairly benefited "Fortnite" maker Epic Games, which filed the lawsuit in 2020.Epic accused Google of monopolising how consumers access apps on Android devices and pay for transactions within apps. The Cary, North Carolina-based company convinced a San Francisco jury in 2023 that Google illegally stifled competition.US District Judge James Donato in San Francisco ordered Google in October to restore competition by allowing users to download rival app stores within its Play store and by making Play's app catalog available to those competitors, among other reforms.Donato's order was on hold pending the outcome of the 9th Circuit appeal. The court's decision can be appealed to the US Supreme Court.Google told the appeals court that the tech company's Play store competes with Apple's App Store, and that Donato unfairly barred Google from making that point to contest Epic's antitrust claims.The tech giant also argued that a jury should never have heard Epic's lawsuit because it sought to enjoin Google's conduct - a request normally decided by a judge - and not collect damages.Epic has defended the verdict and court injunction, telling the 9th Circuit judges that the Android app market has been "suffering under anti-competitive behavior for the better part of a decade."In the trial court and in the appeal, Epic disputed arguments by Google that changes to its app business ordered by the court would harm user privacy and security.Microsoft filed a brief backing Epic, as did the US Justice Department and Federal Trade Commission.Epic separately is battling Apple over a US judge's order requiring the iPhone maker to give developers greater freedom to steer consumers to make purchases outside its App Store.Apple has appealed a ruling that said it violated a prior injunction in a lawsuit that Epic filed in 2020.

Bengaluru: The Enforcement Directorate on Friday conducted searches against a Bengaluru-based real estate company and its promoters who are accused of duping home buyers worth crores of rupees in the name of selling them flats in their residential project, official sources said. At least ten premises of Ozone Urbana Developers Pvt. Ltd. and its key management personnel were raided in Bangalore and Mumbai under the Prevention of Money Laundering Act (PMLA), the sources said. The main promoter of the group is Satyamoorthi Vasudevan. The company and its promoters were booked by the ED after taking cognisance of multiple police FIRs registered against them related to a residential project named Ozone Urbana in Devanahalli Taluk of Bengaluru. The integrated township project was to be handed over to buyers in 2018. However, till 2024, only 49 per cent of the project was completed, the sources said. The company 'failed' to hand over the project and has neither returned the money to the buyers, they claimed. It is alleged that the accused company and its key management personnel 'cheated' gullible home buyers by promising to pay their bank EMIs (taken for purchase of homes) until completion of the project. The company also promised many buyers 'huge' discounts, if they pay full amount in advance against the bookings and it also allegedly lured them with a 'buyback scheme'. It is alleged that the directors of the said company cheated its buyers collectively to the tune of hundreds of crores and misappropriated the funds, the ED sources said.

It is also expected to make importers hold back on placing new orders, say industrialists. Industries in Punjab export yarn, textiles, hand tools, agri and tractor parts to the US, among other products. 'The tariffs announced by the US President are not just disappointing but very worrying,' said Amit Thapar of Ganga Acrowools Limited in Ludhiana, which exports yarn to the US. Thapar, who is also the chairman of CII's (Northern Region) export committee, said, 'Textile exports worth approximately $10.05 billion were made from India to the US last year and this year till May, the exports have already grown by 13 %.' Punjab contributes a significant 28% to India's total textile export of $36 billion. 'But the problem now facing the industry in the state is lower tariffs on competing countries like Turkey (15%), Vietnam (20%), Pakistan (19%), Bangladesh (20%) and Sri Lanka (20%), all lower than India. This puts Indian exporters at a huge disadvantage. Buyers have been calling us. We will start holding meetings to chart the future path amid uncertainty. I hope the situation improves,' he added. SC Ralhan, president, Federation of Indian Export Organisations (FIEO), who is the managing director of Ludhiana-based Sri Tool industries, said the tariffs were a major setback for the hand tools industry in Punjab that annually exports machinery worth ₹3,000 crore to the US. 'Our government is negotiating with exporters on this front. They are likely to compensate us, but if the tariff is implemented, it will be a huge setback. Countries like Vietnam and Turkey are set to benefit straight away,' he said. Upkar Singh Ahuja, president, Chamber of Commercial and Industrial Undertakings (CICU), said the industry in Punjab will be adversely hit, as besides textiles, hand tools machinery and auto parts were exported in huge quantities to the US. 'We are hopeful that the Indian government will provide a respite soon,' he said.
