12-year-old who allegedly sodomised schoolmate cannot be charged under current Malaysian law: Kelantan police chief
Kelantan police chief Datuk Mohd Yusoff Mamat confirmed that while the 12-year-old suspect has been arrested and investigated for the alleged sodomy incident, he cannot face charges in court due to Section 113 of the Evidence Act 1950.
The law stipulates that children below 13 years of age are considered incapable of committing rape based on an 'irrebuttable presumption,' effectively placing them beyond prosecution for such offenses.
According to Buletin TV3, the alleged sexual assault occurred approximately two months ago between the two boys, who attend the same primary school in Kelantan.
The victim subsequently informed his mother about the incident, prompting her to file a police report.
'The incident took place once and following that, the victim's mother came forward to lodge a police report,' Mohd Yusoff was quoted as saying.
The police chief expressed concern about the legal limitation, calling for amendments to address what he sees as an increasing problem involving underage perpetrators.
'Therefore, I am of the view that this section should be amended to allow for the perpetrator to be charged, as there have been many cases involving suspects who are also underage children,' he said.
The case underscores ongoing debates about how Malaysia's legal system should handle serious crimes committed by children, particularly as incidents involving juvenile offenders continue to emerge across the country.

"Their actions included breaking window panes with stones, pasting threatening notes, and padlocking borrowers' gates as a form of intimidation," he said in a statement on Sunday night. Kelantan loan shark ring busted in Op Vulture raids
KOTA BARU: Police have crippled an illegal moneylending syndicate following a series of raids under Op Vulture targeting loan shark activities involving threats and property damage in Kelantan. State police chief Datuk Mohd Yusoff Mamat said the operation, jointly conducted by the Commercial Crime Investigation Department of the state contingent and the Kota Baru district, was held from July 17 to 22. He added that the two separate raids around Kota Baru led to the arrest of five suspects, aged between 25 and 39, believed to be involved in criminal intimidation and vandalism linked to unlicensed moneylending activities. "The suspects are believed to have carried out acts such as splashing red paint on victims' houses, pasting threatening notes, smashing windows with stones and locking the victims' gates as a form of harassment and pressure," he said. Mohd Yusoff said the first suspect was nabbed on July 23 during a raid in Pasir Tumboh near Kubang Kerian. "This was followed by the arrest of four more suspects on July 25 in connection with a paint-splashing incident in Pasir Hor," he added. During the operations, he said police have seized 34 items and they included red paint, pens, threat notes, clothing, face masks, mobile phones, and motorcycles believed to have been used in the crimes. "Early investigations revealed that the suspects were linked to at least nine cases of criminal damage across Kota Baru, Tumpat and Tanah Merah districts," he said. The case is being investigated under Section 5(2) of the Moneylenders Act 1951 and Sections 427 and 506 of the Penal Code for mischief and criminal intimidation. "All five suspects have been remanded to assist in further investigations," he added. Mohd Yusoff advised the public not to seek loans through unlicensed sources, including those offered on social media and unverified applications. He urged borrowers to verify lenders through official channels and conduct financial transactions only with licensed institutions. He also reminded the public not to accept payments for carrying out red paint attacks or other intimidation acts, as even being hired for such activities constitutes a criminal offence. "The police will not compromise with anyone who attempts to instil fear in the public for personal gain. "Any suspicious activity should be reported to the nearest police station or through our official channels," he added.

Opposition MP seeks clarification over conflicting accounts of Kemumim raid
KUALA LUMPUR: An opposition Member of Parliament has urged the Health Ministry to clarify details surrounding the recent raid on a gathering in Kemumin, Pengkalan Chepa, Kelantan last month. Datuk Ahmad Saad (PN–Pokok Sena) described the conflicting statements from the ministry and the police regarding the incident as puzzling. "I would like the ministry to respond regarding the recent arrests at what has been described as a gay party, as the statements issued about the event are contradictory, which is rather strange. "There appears to be a conflict between the Health Ministry and the police. In other words, who is telling the truth – or who is not? "Kelantan police have confirmed that there was no involvement from non-governmental organisations, health clinics, or the Health Ministry at the event. In fact, no representatives from any NGOs or ministry agencies were present," he said during the debate on the 2023 Annual Report and Financial Statements of the Human Rights Commission of Malaysia (Suhakam) in the Dewan Rakyat today. On July 17, it was reported that police had foiled a secret gathering involving more than 100 gay men in Pengkalan Chepa, believed to be on the verge of escalating into immoral activities. Kelantan police chief Datuk Mohd Yusoff Mamat said the event was held at a rented bungalow in Kemumin in mid-June, following a tip-off from the public about a planned closed-door gathering of a gay group in Kota Baru.
