Bihar voter list revision: 5 key flashpoints between EC, Opposition; how poll body has responded so far

The Supreme Court is set to hear on Thursday, July 10, a bunch of petitions challenging the Election Commission's "Special Intensive Revision" of Electoral Rolls in Bihar.
The Election Commission had issued instructions on June 24 to carry out a Special Intensive Revision in Bihar to weed out ineligible names and ensure all eligible citizens are included in the electoral roll.
The EC's direction, which came just months ahead of the Bihar Assembly Election, sparked controversy.
Several activists and the Opposition objected to the provision that required large sections of Bihar voters to submit proof of citizenship to remain on the electoral rolls.
RJD MP Manoj Jha, the Association for Democratic Reforms (ADR), PUCL, activist Yogendra Yadav, Trinamool MP Mahua Moitra, and former Bihar MLA Mujahid Alam filed petitions challenging the ECI decision
This is just the latest among the challenges that the Election Commission faces since the Haryana and Maharashtra Assembly elections. In 2024, the Opposition levelled a slew of allegations against the poll body, saying the elections in these states were "rigged".

The Opposition parties have maintained that the exercise could deprive genuine voters of their right to benefit the ruling parties in Bihar.
The Association for Democratic Reforms (ADR), which is one the of petitioners in the matter, said the EC's June 24 order asks one category of citizens to submit proof of date of birth and place of birth.
"For another category, it asks for proof of date of birth/place of birth of self and one of the parents. For another category, proof of date of birth and place of birth for both parents is required," Jagdeep Chhokar, co-founder of the election watchdog, the ADR, explained.
"So this is a change in the criteria for eligibility of a voter. This is illegal when done by the Election Commission," he said, while explaining why this revision is "illegal and impractical". Full interview here
EC's response: In a statement, the poll panel said the revision of electoral rolls is must as it is a dynamic list which keeps changing due to deaths, shifting of people due to migration and addition of new voters who have turned 18.
The Election Commission officials further addressed the issue of duplicate voter cards numbers — same card numbers erroneously issued to two different persons.
They told news agency PTI that the issue of many persons enrolling in different places by giving different unmatching details to procure more than one electoral photo identity card can only be resolved through SIR. It is practically impossible to detect such cases through software tools.
Questioning the Maharashtra Assembly elections results, Congress leader Rahul Gandhi alleged irregularities in the state's voter list -- "large-scale additions and deletions of voters."

He later claimed that, 'Between the 2019 Vidhan Sabha elections and the 2024 Lok Sabha elections, 32 lakh voters were added to Maharashtra's electoral rolls over five years.'
"However, between the 2024 Lok Sabha elections and the 2024 Vidhan Sabha elections, 39 lakh new voters were added in just five months,' Rahul Gandhi said.
Election Commission's response: The ECI said that there were no arbitrary additions or deletions in Maharashtra.
The Opposition also raised questions on the "gap" in voter turnout between the end of polling hours (5 pm), the end of polling day and the final turnout.
EC's response: The Election Commission said it was incorrect to compare the figures directly.
In a letter to the Congress, the ECI explained how an increase in voter turnout from 5 pm to 11:45 pm is normal as part of the process of aggregation of voter turnout and how there can be fide but inconsequential differences in "votes polled" and "Votes Counted" data.
During a court hearing, the ECI had argued that the real-time voter turnout figures given by the Voter Turnout App are tentative because it is being updated on a real-time basis. "So any mismatch with the App Data and Form 17C data is not material," the EC's counsel had said. Read more here
Congress leader Jairam Ramesh had questioned the 'unexplained slowdown in updating of results of Haryana Assembly Elections 2024' on the EC website.
EC's response: The poll body said there was nothing on record to substantiate the Congress leader's "ill-founded allegation" of a slowdown in the updation of Haryana poll results.
The Election Commission found itself in the broil after the Opposition raised doubts over the absolute mismatch between the exit poll results and the official election results --which had triggered a political upheaval in Haryana.
In Haryana Assembly elections 2024, most of the exit polls had forecast a clear win for the Congress. On the result day, early trends showed the Congress leading in the Haryana polls. However, a major turnaround declared the BJP as the winner of the state polls.
EC's response: In October 2024, the then Chief Election Commissioner (CEC) Rajiv Kumar slammed early election trends on the vote-counting day as "nonsense."
He said the Election Commission follows a process of counting and declaring results. The CEC said it's impossible to reveal results around 8:05 am when actual counting starts at 8:30 am. He said the EC usually updates its website with official results around 9:30 am on a regular counting day.

Patna (Bihar) [India], July 13 (ANI): Bihar Congress President Rajesh Kumar on Sunday expressed strong concerns over the Election Commission's Special Intensive Revision (SIR) of electoral rolls in Bihar. Speaking on the recent Supreme Court decision allowing the Election Commission to conduct a special investigation, Kumar questioned the necessity of the SIR, given that the electoral roll was updated in January 2025. Rajesh Kumar said that the move has exposed flaws in the electoral process and raised serious concerns about the credibility of the 2025 election results. He implied that the 2025 elections, which the central government won, might also be flawed if the current electoral roll revision is necessary. While speaking to ANI, Kumar said, 'In the 2024 Lok Sabha elections, they had the figures with them. What was the problem with the electoral roll of 6 January 2025, which was finally printed? Within 25 days, they had to redo the process. This means the 2025 elections that the central government has won are also wrong, so why did this exercise not happen then?' Earlier in the day, Union Minister Gajendra Singh Shekhawat accused the Opposition of politicising the ongoing special intensive revision (SIR) of electoral rolls in Bihar and sought to know who all experienced 'stomach aches' when the Election Commission reviews the voter list. 'It is the Election Commission's right and responsibility to conduct the elections in accordance with the system provided by the Constitution, to conduct them fairly, without any controversy. If the Election Commission reviews the voter list regarding the fairness of the elections, then that is a matter of their jurisdiction,' Shekhawat told reporters. 'There is no need for anyone to have any doubt or suspicion in this. However, some tried to politicise this issue. The Supreme Court verdict was also issued on the same lines. My second question is: Which people are experiencing stomachaches if the Election Commission reviews the voter list after the Supreme Court's order?' he later added. Earlier, the Election Commission of India said 80.11 per cent electors in Bihar submitted their forms, adding that the commission is moving ahead to complete the collection of Enumeration Forms (EFs) before the stipulated time, July 25. These efforts of ECI are being supplemented 1.5 Lakh BLAs appointed by all political parties who are also visiting door to door and leaving no stone unturned to ensure inclusion of each and every existing elector whose names are in the Electoral Roll in Bihar as on 24 June 2025. Special efforts are also being made to assist senior citizens, PwD electors, and other vulnerable groups by over 4 lakh volunteers. In order to get their names included in the draft electoral rolls to be published on 1st Aug, electors have to submit their EFS, preferably, along with eligibility documents. In case any elector needs more time to submit the eligibility documents, he can submit them separately till 30 Aug, i.e. the last date of filing claims and objections and take the help of volunteers as well. NEW DELHI: Undeterred by the raging controversy over theSpecial Intensive Revision of electoral rolls in poll-bound Bihar, it is learnt that the Election Commission has sent a communication to Chief Electoral Officers (CEOs) of all the states to activate poll machinery for a possible roll out of the exercise on a pan-India basis. It appeared that the Commission moved to activate the poll machinery across the country in the backdrop of the Supreme Court's observation last week that the SIR is a 'constitutional mandate' and permitted the poll panel to continue with the exercise in Bihar. Several opposition parties and other civil society organisations had moved the top court challenging the intensive revision, saying it will deprive eligible citizens of their right to vote for want of documents specified by the poll panel for inclusion in the voters' list. However, Union Home Minister Amit Shah in an interview with TNIE on Saturday said, 'I believe that if anyone has any concerns about the process, he/she should approach the Election Commission. Not with presumptions, but with examples of the outcomes of the process. Roll revision is not happening for the first time. It happened in 1991, too. Also, it's not being done only in Bihar. I think it will be done across India. Anyway, the matter is before the Supreme Court.'

Patna (Bihar) [India], July 13 (ANI): Rashtriya Janata Dal leader Tejashwi Yadav on Sunday rubbished claims that the Election Commission's Special Intensive Revision (SIR) of voter lists for Bihar elections revealed names of people from Bangladesh, Nepal, and Myanmar. He questioned the credibility of sources making such claims, likening them to rumors about Islamabad, Karachi, and Lahore being captured. 'Who are these sources? These are the same sources that said that Islamabad, Karachi, and Lahore have been captured. 'Ye sootra ko hum mootra samajhte hai' (We consider these sources to be nonsense),' Yadav said. Yadav emphasised that SIR was last conducted in 2003 under the UPA government, and since then, multiple elections have taken place, including in 2014, 2019, and 2024, where the opposition lost by a margin of three to four lakhs. He questioned whether this implies that foreigners voted for Prime Minister Modi. 'SIR was conducted for the last time in 2003 under the UPA government. Since then, we have seen many elections, including the ones in 2014, 2019, and 2024. In those elections, we lost by three to four lakhs. Does that mean all these foreigners voted for PM Modi?' he added. Yadav alleged that the NDA is responsible for any dubious elements' names getting added to the voter lists, implying that their electoral victories might be tainted by fraud. He accused the Election Commission of working as a cell of a political party, calling the SIR process a 'complete eyewash'. 'This means that the NDA are at fault for any dubious elements' names getting added to the voter lists... That means all the elections they have won have been a fraud... SIR is a complete eyewash. The EC is working as a cell of a political party...,' said the RJD leader. Slamming both the Centre and Nitish Kumar, the RJD leader said that if any 'dubious names' were added in the voter lists, the responsibility lies with the government who has stayed in power since 2005. 'Since 2005, whose government has been in Bihar? NDA's government, BJP, Nitish Kumar's government is there. For 11 years who has been the Union Home Minister, who is the PM for the last 11 years? Modi and Amit Shah. This means that the NDA are at fault for any dubious elements' names getting added to the voter lists. That means all the elections they have won have been a fraud,' he said. Earlier, ECI sources said that a large number of individuals from Nepal, Bangladesh and Myanmar have been found by Booth Level Officers (BLOs) with Aadhaar cards, domicile certificates and ration cards during house-to-house visits carried out as part of the SIR. ECI sources say that after a proper enquiry to be conducted from 1 Aug till 30 Aug, if found true, such names shall not be included in the final list to be published on 30 Sep 2025. The State will have assembly polls later in the year. Notably, the BLOs have already digitised and uploaded 4.66 crore Enumeration Forms in ECINet by 6 PM today. ECINet is the newly developed integrated software that has subsumed all the different 40 ECI Apps that had existed earlier. (ANI)
