Baste Duterte to serve as acting Davao City mayor —Comelec
Vice Mayor Baste Duterte may serve as acting mayor of Davao City amid the detention of former President Rodrigo Duterte in The Hague, Netherlands, the Commission on Elections (Comelec) said Monday.
Citing the Local Government Code, poll chief George Erwin Garcia explained the rule of succession applies to cases of elected local officials who are temporarily incapacitated from performing their duties.
'Yes, by operation of the law,' Garcia answered when asked if the elected vice mayor will serve as Davao City's acting mayor.
''Yung mag-assume ng position will be assuming in an acting capacity unless maging permanent incapacity,' he said.
Section 46 of the Local Government Code states that 'when the governor, city or municipal mayor, or punong barangay is temporarily incapacitated to perform his duties for physical or legal reasons such as, but not limited to, leave of absence, travel abroad, and suspension from office, the vice-governor, city or municipal vice-mayor, or the highest ranking sangguniang barangay member shall automatically exercise the powers and perform the duties and functions of the local chief executive concerned, except the power to appoint, suspend, or dismiss employees which can only be exercised if the period of temporary incapacity exceeds 30 days'.
Meanwhile, Garcia said that upon assumption of office at 12 noon of June 30, local elected officials are now under the jurisdiction of the Department of the Interior and Local Government (DILG).
'Basta naproklama na at wala namang case sa amin na naka-pending, ang jurisdiction ay wala na sa amin. Basta walang kaso sa amin, walang nakapending, wala kaming naging desiyon, naproklama, kaagad ang jurisdiction ay malilipat sa DILG,' he said.
(As long as they were proclaimed and have no pending cases before us, the jurisdiction will be under the DILG.)
'Lalo na pagdating ng June 30. So kung sino ngayon ang uupo, sino papaupuin, ano nangyari sa kandidato, yan ay call na ng DILG,' he added.
(Come June 30, the DILG will have the say on who will serve and what will happen to the winning local candidates.)

Joey Uy seeks TRO vs. Comelec ruling affirming Abante's win
Initial poll winner Luis 'Joey' Chua Uy on Monday asked the Supreme Court (SC) to issue a temporary restraining order (TRO) against the ruling of the Commission on Elections (Comelec) affirming Bienvenido 'Benny' Abante as Manila representative in the midterm polls. In his petition, Uy also asked the SC to issue a writ of preliminary injunction and a status quo ante order preserving the status of the parties and their respective positions. Uy's filing came after the Comelec En Banc junked his motion for reconsideration against its June 18 resolution that voided his certificate of candidacy. Comelec annulled Uy's proclamation, leaving Abante as the sole qualified candidate with the highest number of votes. The respondents are the Commission on Elections (Comelec) and Abante. GMA News Online asked Comelec for comment but has yet to receive a response as of posting time. Meanwhile, in a statement issued earlier, Abante welcomed the poll body's ruling, saying that in upholding the law, Comelec also upheld the truth. ['It] highlights the importance of protecting the integrity of our democratic institutions and ensuring that those who seek public office do so with honesty and transparency,' he said. 'Our constituents—the people of Manila—deserve no less. In a separate move, Uy also asked the House of Representatives Office of the Secretary General Reginald Velasco to include him in the list of House members for the 20th Congress, saying that he remains the legitimate Manila Sixth District congressional race winner pending his appeal before the Comelec. Uy cited Article 6, Section 7 of the Constitution which reads 'the members of the House of Representatives shall be elected for a term of three years which shall begin, unless otherwise provided by law, at noon on the 30th day of June next following their election.' Comelec earlier voided Uy's proclamation, allegedly because he is not a natural-born Filipino. 'We write on behalf of our client, Congressman Luis "Joey" C. Uy, duly elected Congressman of the Sixth District of Manila. At 12:00 noon today, Cong. Joey assumed the position of Member of the House of Representatives, in accordance with Section 7, Article VI of the 1987 Constitution,' Gialogo said. In addition, Uy's camp cited Section 13, Rule 18 of the Comelec Rules of Procedure which provides that a decision in special cases becomes final and executory only after five days from promulgation, unless the Supreme Court issues a Temporary Restraining Order. 'Congressman Joey's assumption of office is pursuant to his valid proclamation and oath of office, and stands despite the Resolution issued by the Commission on Elections en banc earlier this morning,' Gialogo said. 'Accordingly, we respectfully request your good office to include Cong. Joey in the Roll of Members of the House of Representatives and to receive his proposed bill for official filing and consideration,' he added. The lawyer also said Uy tried to file a House Bill on Monday, June 30 or which was supposed to be Day 1 of Uy's congressional tenure. However, the House personnel did not allow them to file the bill. Uy said he wanted to file a bill granting free flu vaccines for senior citizens. 'I want all the senior citizens to get their flu vaccines. Comelec to hold mock elections for BARMM polls in July
The Commission on Elections (Comelec) will conduct mock polls for the first-ever Bangsamoro parliamentary elections on July 26. At a stakeholders' briefing on the 2025 BARMM polls on Friday, Comelec Chairperson George Erwin Garcia reiterated that the parliamentary elections will push through on October 13. 'The Comelec will proceed with the conduct of the elections in the Bangsamoro by October 13, and that is very clear,' Garcia said. The Bangsamoro polls were rescheduled from May 12 to October 13 after President Ferdinand Marcos Jr. in February signed the law postponing the elections. The postponement came months after the Supreme Court (SC), in September 2024, upheld the validity of the Bangsamoro Organic Law but declared that Sulu was not part of BARMM. The Court denied motions seeking the reversal of the decision in November 2024. The SC ruling necessitated the redistribution of the seven vacated seats originally allocated to Sulu under the Bangsamoro Electoral Code. However, the Bangsamoro government has yet to issue a decision on the reallocation. 'At this point, how can the Comelec comply with the 80 coming from Sulu? The Comelec doesn't have the power to reapportion…In the meantime, we are proceeding with our preparation based on 73 seats,' Garcia said. The poll chief also said the Comelec is eyeing repositioning certain forces of its deputized law enforcement agencies, such as the Philippine Army, the Philippine Navy, the Philippine Marines, the Philippine National Police, and the Philippine Coast Guard, as part of peacekeeping operations during the 2025 Bangsamoro polls and to neutralize any armed groups who may disrupt said elections.— VBL, GMA Integrated News
