Mehul Choksi challenges fugitive status in PNB fraud case from Belgian prison
Through his counsel, Advocate Vijay Aggarwal, Choksi has argued that the legal basis for declaring him a fugitive is fundamentally flawed. He is currently lodged in a Belgian prison following his arrest recently, which was carried out on the basis of a non-bailable warrant issued by an Indian court and under an official extradition request made by the Indian government.
Aggarwal contended that Choksi is, therefore, in the "constructive custody" of Indian authorities.
"How can someone be considered a fugitive when he has been arrested at the behest of India and is in custody due to Indian proceedings?" Aggarwal told ANI.
He further explained that under the Fugitive Economic Offenders Act, a person must meet two conditions: one is leaving India to avoid prosecution, and the second, refusing to return to face legal proceedings.
"In my client's case, neither criterion is fulfilled," Aggarwal stated. "He left India for medical treatment in New York with due police clearance from Mumbai, and at that time, no case had been filed against him. So the allegation that he fled to evade prosecution is baseless."
As for his alleged refusal to return, Aggarwal pointed to a Dominican court order from 2021, issued after an alleged abduction attempt on Choksi. The order barred him from leaving Antigua, and significantly, it was passed in the presence of the CBI, effectively making it a restriction imposed with the knowledge of the Indian government.
Aggarwal stated that the FEO plea has been pending in the Mumbai court for years without resolution. "Now that my client has been arrested in Belgium, at India's request, and remains in custody in Antwerp prison in relation to Indian charges, he is effectively under Indian jurisdiction," he argued. "Judicial precedents recognise such custody as valid under Indian law. Hence, there's no ground to continue the FEO proceedings."
Simultaneously, Choksi is also fighting legal proceedings in Belgium. In a recent petition filed before the Belgian Court of Appeal--prepared by Advocate Aggarwal and submitted by his local legal team--Choksi has alleged that his arrest violated Belgian legal procedures and fundamental rights.
The plea claims that Belgian authorities failed to follow due process, infringing on Choksi's basic legal protections and violating principles of natural justice. He has sought immediate release, citing these procedural lapses.
This petition follows the recent rejection of Choksi's bail by a three-judge bench of the Belgian Court of Appeal, which conducted proceedings in Dutch. The court has yet to schedule the next hearing in the matter.

Robert is also being probed for his links with Bhandari, who fled to London when multiple agencies started investigating him in 2016. The judgment came on the ED's application filed under the Act in 2019. The court said the "fugitive" tag is to an individual who has committed schedule offence or offences involving an amount of Rs 100 crore or more and who has absconded or refused to return to avoid criminal prosecution. This will allow ED to confiscate his properties anywhere in the world and bar Bhandari, who is wanted by Indian agencies in multiple cases, from filing or defending any civil proceedings in India. The judge dismissed Bhandari's counsel's argument that the UK high court's order disallowing ED's plea for his extradition makes him eligible to stay in London, and therefore, FEO won't apply to him. "The said argument is without any substance as the extradition failure will not make any difference as the extradition of the accused was one of the means to bring the accused to India to face trial in the said offence under Section 51 of the Black Money Act," the judge said. The court stressed Bhandari wilfully refused to return to face criminal prosecution, and said, "...this court is satisfied that the total value of the schedule offence is Rs 100 crore or more i.e. the schedule to the present FEO Act which is Section 51 of Black Money Act." The court also rejected Bhandari's contention that declaring him a fugitive economic offender entails very serious consequences, effectively amounting to economic death penalty. "Bhandari always has an option to return... when he chooses not to return to India, he cannot take the plea of avoiding all the legal consequences... In any case those who play with fire should be aware of its consequences," the court said.

Land grab: ED scours 8 Goa, Pune locations
Panaji: The enforcement directorate (ED), Panaji, conducted search operations at eight premises in Goa and Pune in connection with an alleged land grab case and seized incriminating documents pertaining to immovable properties and records of cash entries. The ED said that the searches were part of a Prevention of Money Laundering Act (PMLA) investigation against John Paul Valles, Sandeep Vazarkar, and their associates. The search operations, conducted at the residential and office premises of those involved, resulted in the seizure of multiple electronic devices and a significant volume of incriminating documents. Key seizures included various deeds of sale, powers of attorney, documents related to multiple inventory proceedings, and a diary containing details of cash payments. These items were primarily seized from the residences of Vazarkar, Valles, Sandeep Manjrekar, and Avinash Naik. 'The seized evidence is being scrutinised and is expected to provide crucial leads for tracing the proceeds of crime and furthering the ongoing investigation into the land grabbing conspiracy,' the ED said. The directorate initiated the investigation based on an FIR registered by the Porvorim police station. The case pertains to a criminal conspiracy to illegally grab an ancestral landed property measuring 5,000 square metres at Survey No. 210/5 at Socorro, North Goa, belonging to the complainant, Jeronimo Oliveiro Desouza, the ED said. The investigation pertains to the modus operandi with which the accused allegedly conspired to create a fraudulent inventory proceeding (No. 134/2019/C). 'This document falsely claimed that the father of Sandra De Sa and Maureen Saldanha had the same name as the complainant's father, thereby enabling the fraudulent transfer of the property to the names of the two sisters,' the ED said. 'Subsequently, John Paul Valles obtained a power of attorney (POA) from them in Pune and proceeded to subdivide the land into plots and sell them to multiple buyers.' The ED said that Vazarkar accompanied Valles to Pune for the execution of the POA and was instrumental in arranging buyers for the plots. 'During the PMLA investigation, Vazarkar admitted to receiving Rs 10 lakh as brokerage. The investigation also found large, unexplained cash deposits in the personal and business bank accounts of Vazarkar,' the ED said.
