
Man, Thai girlfriend freed of drug trafficking charge
Judge K. Muniandy ordered the couple, Tan Kah Soon, 49, and his Thai girlfriend, Pattarathida Petcharanon, 39, to be freed after finding that the prosecution had failed to prove a prima facie case against them at the end of the prosecution's case.
"There were significant weaknesses in the prosecution's case, including issues related to the chain of custody of the evidence and the unexplained time gap between the discovery of the material and its delivery to the laboratory for analysis.
"The scientific evidence presented raised reasonable doubts about the identity and authenticity of the dangerous substance and its direct link to the two accused.
"Accordingly, both accused are acquitted and discharged of the charges made against them without being called to defend themselves," said the judge.
The couple was jointly charged with trafficking the drugs, namely 647.1g of methamphetamine and 561.6g of ketamine, at a condominium in Taman Desa Petaling, Cheras, at 10.50pm on Nov 9, 2021.
They were charged under Section 39B (1) (a) of the Dangerous Drugs Act 1952, which provides for the death penalty or life imprisonment and if not sentenced to death, a maximum of 15 strokes of the cane, if convicted.
The case was handled by Deputy Public Prosecutor Zaileen Nadia Zubir, while both accused were represented by lawyer Sivahnanthan Ragava.

JOHOR BARU: The High Court here today discharged and acquitted a labourer of a charge of murdering a single mother and her male friend at a flat unit in Taman Ungku Aminah, Skudai here, seven years ago. Judge Datuk Abu Bakar Katar made the ruling after finding that the prosecution had failed to establish a prima facie case against the accused, M. Jaykumar, 39, at the close of its case. In his judgment, Abu Bakar said the prosecution had failed to prove that the deaths of K. Kamala, 51, and S. Silvaraja, 59, were caused by injuries inflicted by the accused. He said the court also took into account that no traces of the victims' blood were found on the accused's clothes or belongings, and that the investigating officer did not seize these items to test for the victims' deoxyribonucleic acid (DNA). "The prosecution also failed to prove that the jewellery pawned by the accused belonged to Kamala, as her children could not confirm its ownership during testimony. There is reasonable doubt since some jewellery was still found with Kamala," he said. "The prosecution attempted to rely on the theory that the accused was the last person seen with the victims, setting the timeline between 7pm on Oct 31 and 3am on Nov 1. "However, according to a witness, Kamala was still on the phone at 11.50pm. "How could the prosecution fix 7pm as the starting time when the victim was still alive? "This court finds that without other supporting evidence, it is insufficient to link the accused to the murders," the judge said. M. Jaykumar was charged with the murders of K. Kamala and S. Silvaraja at a flat unit in Jalan Hang Jebat 14, Taman Ungku Aminah, between 7pm and 3am on Oct 31 and Nov 1, 2018. The charge, framed under Section 302 of the Penal Code, carries the mandatory death penalty upon conviction. A total of 20 witnesses were called by the prosecution, led by deputy public prosecutor Juanita Mohd Said, while Jaykumar was represented by lawyers Datin Freda Sabapathy and K. Police probing death of student found in drain near Papar school dorm

The victim is believed to have fallen from a third-floor dormitory at Sekolah Menengah Kebangsaan Agama (SMKA) Tun Datu Mustafa Limauan, before being discovered at around 3am. Papar District Police Chief, Superintendent Kamaruddin Ambo Sakka, said they received a report on the incident at 8.16am the same day. He said the student was immediately rushed to Queen Elizabeth I Hospital in Kota Kinabalu for treatment. 'However, she was pronounced dead at around 1pm on Thursday,' he said in a statement today. Contract manager among four detained in RM180m Johor data centre graft case
PUTRAJAYA: A contract manager from a leading construction firm is among four individuals detained by the Malaysian Anti-Corruption Commission (MACC) for alleged corruption linked to a RM180 million data centre project in Johor. The arrests were made during Op Ways in the Klang Valley, with RM7.5 million in cash seized from the manager's home. A source revealed that the money is suspected to be bribes received for securing six project tenders.
