Academician calls for compulsory dashcams in all Malaysian vehicles

KUCHING (June 11): Dashcams should be mandatory in all vehicles in Malaysia to enhance road safety and support legal proceedings, said Dr Muzaffar Syah Mallow.
In this regard, the Universiti Sains Islam Malaysia's Faculty of Syariah and Law associate professor urged the government to review existing laws, particularly the Road Transport Act 1987 (Act 333), to introduce new provisions making dashcams mandatory.
'The government can consider requesting vehicle owners in the country to instal dashcam inside their vehicle by themselves or requesting car manufacturers in the country to add a dashcam component to every vehicle which they produce.
'Whatever approach we take, we should never undermine the importance of a dashcam. With so many issues which occur on the road, dashcam footage can serve as vital evidence when needed,' he said in a statement today.
He explained that modern dashcams, now compact and easy to mount, allow drivers to record visuals of any road incidents they encounter.
'Drivers may opt to instal dashcams in their vehicles for liability protection. I f a driver is involved in an accident or is accused of a crime, the lawyer may be able to use the footage from a dashcam as evidence to assist the driver with their legal battle in court,' he said.
Highlighting the risks drivers face—such as accidents, snatch theft, road bullying, and harassment—Muzaffar said recorded visual evidence can assist them in filing police reports, insurance claims, and even in legal cases.
Legally, Dr Muzaffar said dashcam footage qualifies as admissible documentary evidence in court, provided it is relevant, strong, and credible.
He cited Section 3 of the Evidence Act 1950 (Act 56), which states that evidence includes both oral and documentary forms, such as visual recordings.
'This view is based on the case of Chin Seow Noi v PP (1994) 1 SLR 135, where the court said that 'The use of the single word 'includes' in our Section 3 is clearly intended to make the definition of evidence in our Evidence Act an extensive one.'
'The use of the word 'includes' in Section 3 of the Evidence Act 1950 [Act 56] was intended to make the definition of evidence in the section extensive. Meaning, we can use a dashcam footage as evidence.

IPOH: Three senior citizens were killed and three others injured in a collision involving two vehicles at Kilometre 328.9 of the southbound PLUS Highway near the Tapah–Bidor stretch today. Perak Fire and Rescue Department assistant director (operations) Sabarozi Nor Ahmad said the department received a distress call at 11.19am and deployed a team of seven firefighters to the scene. The deceased were identified as Chong Ong, 77; Teh Kim Kai, 76; and Tan Ah Tak, 70. "The crash involved a Toyota Vios and a Proton X50. One man in the Toyota Vios was injured, while five men were in the Proton X50 — two were injured and three died at the scene," he said in a statement. The injured were handed over to medical personnel, while the deceased were confirmed dead at the scene and referred to the police for further action. Tapah district police chief Superintendent Johari Yahya said initial investigations found that the Toyota Vios had rammed into the rear of the Proton X50, which was in the right lane. "The impact caused the Toyota Vios to veer off to the grassy area on the left side of the highway, while the Proton X50 spun and crashed into the left-side guardrail. "Three passengers in the Proton X50 died at the scene. Two of them were thrown from the vehicle due to the crash," he said. The driver and front passenger of the Proton X50 were injured and sent to Tapah Hospital for treatment. "The Vios driver will be brought to the Tapah magistrate's court tomorrow for a remand application," he added. Police are urging witnesses to contact Traffic Investigating Officer Inspector Mohd Faizan Ahmad @ Mohammed Razikin at 05-4011222 or 013-2087919. The case is being investigated under Section 41(1) of the Road Transport Act 1987 for reckless or dangerous driving causing death.

SEREMBAN: The driver of a car caught driving against traffic near here has been found to be suffering from mental health problems. Seremban OCPD Asst Comm Mohamad Hatta Che Din said police detained the 57-year-old man in Banting, Selangor, after the 25-second clip went viral on Monday (July 21). "A team was formed to track down the driver after we came across the clip showing a car being driven against traffic along Jalan Tuanku Antah on Monday night. "A background check on the driver revealed that he had mental health issues and had received treatment for it," he said in a statement. ACP Mohamad Hatta said the man's wife had also lodged a report confirming this. He said the man had a valid driving license and the car had road tax and insurance coverage. The driver had, however, previously been issued a traffic summons under Section 79(2) of the Road Transport Act 1987 for failing to adhere to traffic rules.

Muhammad Faris Rosaidee, 27, was travelling from his home in Batu Caves to Bandar Sri Damansara to meet a friend when he suddenly felt something touch his body, followed by a kite string wrapping around his neck. I couldn't see the string. I felt it first touch my body, then rise to chest level and up to my neck . Recounting the terrifying moments, he couldn't stop because there were cars on both sides. Muhammad Faris could only slow down the motorcycle and wait for the string around his neck to break on its own. The string cut through three layers of clothing on his body – his jacket, shirt, and backpack – all of which were torn, with the string slightly cutting the skin on his shoulder. Face Covering Saves Life Fortunately, Muhammad Faris was wearing a special face covering that extended to his neck while riding, which significantly reduced the severity of injuries to his neck area. Following the incident, he filed a report at the Gombak police district headquarters. Police officers from the Kepong Police Station then contacted him for verification and assistance with follow-up actions, including filing reports with Kuala Lumpur City Hall (DBKL) and the Kuala Lumpur Traffic Police Station. Muhammad Faris noted that this wasn't an isolated incident, as several other individuals had previously claimed to have been struck by kite strings. When he returned to the scene of the incident, he encountered two individuals in the middle of the highway. I asked them whose kite it was, and they said they were just there to help… I do not suspect them. Victim Calls for Designated Kite Zones Following the incident, Muhammad Faris urged authorities to establish special zones for kite-flying activities in open areas and advised others who have been victims to file reports. Taman Tasik Metropolitan Kepong is a popular destination among kite-flying enthusiasts, with its open spaces ideal for launching and flying kites. I made that video for awareness. Police are investigating the case according to Section 80 of the Road Transport Act 1987, which pertains to ropes, wires, or other similar objects placed across a road. This dangerous encounter highlights the serious safety hazards posed by kite strings stretched across busy roads, which can potentially cause fatal accidents to motorcyclists and other road users.
